Visibility for comfort, security, and driving: Glare from unshielded lights reduces our ability to see at night, by making shadows darker. Why does night sky preservation matter? Habitat: Preserving naturally dark nights is a vital part of preserving habitat. All of the plants and animals that live in Central Texas, including humans, are evolved for dark nights. All of the plants and animals that live in Central Texas, including humans, are evolved for dark nights. • Pollinators (eg moths) • Fireflies • Frogs • Birds • Bats • Deer • Coyotes • Etc. etc. Why does night sky preservation matter? Wasted electricity: It is estimated that 33% of all outdoor lighting is wasted by shining where it is not intended to be. VS. Why does night sky preservation matter? Wasted electricity: It is estimated that 33% of all outdoor lighting is wasted by shining where it is not intended to be. That amounts to between 10 and 15 million tons of CO2 annually in the US, for residential lighting alone. Overall, $3 Billion are spent annually in the US on outdoor lighting shining where it is unintended. Tourism and recreation: Central Texas destinations, including some in Austin, are enjoyed for their star-filled skies. SOUTH CENTRAL WATERFRONT ADVISORY BOARD APPROVED MINUTES FOR JANUARY 19, 2021 AT 1:00 PM The South Central Waterfront Advisory Board convened in a Regular Meeting on January 19, 2021 via Videoconferencing. The meeting was called to order at 1:05pm Board Members in attendance: Chair Samuel Franco (Design Commission) Vice Chair Lynn Kurth (Mayor & Dist 9 Appointee) Greg Anderson (Planning Commission) Alfred Godfrey (Trail Foundation) Linda Guerrero (Environmental Commission) Francoise Luca (Parks & Recreation Board) Jeff Seiden (Bouldin Creek Neighborhood Assoc.) Wendy Price Todd (S. River City NA) 1. APPROVAL OF MINUTES Ex Officios: Nazlie Saeedi (ATD) Molly Alexander (DAA) COA Housing and Planning Staff: Alan Holt, Executive Liaison Jodi Lane, Staff Liaison a. Board Member Wendy Price Todd made a motion, seconded by Board Member Samuel Franco, to approve the draft December 19 SCWAB meeting minutes. The motion to approve passed with seven yes and two absent (includes absentee Karen Paup and late arrival Jeff Seiden) votes. 2. ITEMS FOR PRESENTATION AND DISCUSSION a. Dark Skies presentation- A presentation was given by Cliff Kaplan, Program Director and Acting Executive Director of the Hill Country Alliance. Cliff will make these materials available to the Board. No Action was taken. b. Presentation and discussion with Austin Economic Development Corporation (AEDC) Consultants- Consultants Matthew Kwatinetz, of Q Partners and Thomas Jansen of HR&A gave a presentation and update on the activities of the Austin Economic Development Corporation. The Board discussed this but no action was taken. 3. ITEMS FOR DISCUSSION AND POSSIBLE ACTION a. 2021 SCWAB Administration – Staff Liaison Jodi Lane gave an update on Expiring Terms and 2021 Schedule. No action was taken. 4. WORKING GROUP UPDATES & ASSIGNMENTS FROM CHAIR a. Community Benefits, Infrastructure, and Regulating Plan – This working group may work in the future with Cliff Kaplan on dark skies regulations for the district. No other update. b. Finance and Governance- No update c. Active Projects- No update 5. Customer Energy Solutions FY21 – Quarter 1 Report As of 12/31/2020 Quarterly Rebates by District and Outside of COA Solar PBI not included. Rebates paid may not align with AE Finance eCombs system as of 12/31/20. Dollars are unaudited. Energy Efficiency Services Residential Programs AE Weatherization (WAP) – Direct Install • Weatherization continues to receive applications from customers interested in participating. The program currently has 209 jobs either completed or in the pipeline, with another 105 to be assigned out. Appliance Efficiency Program (AEP) • Effective October 15, 2020, website enrollment application submissions for HVAC and Variable Speed Pool Pumps was removed. Applications are required to be submitted via the backend of EECP. • The program has extended the eligibility period from 60 to 90 days, removing the need for a 60-day waiver request. • A 10% increase in new participating contractors in FY21-Q1 • The program has completed a total of 847 enrollments for FY21-Q1 • Total rebate amount of $262,950.00 paid in FY21-Q1 1 Home Performance w/Energy Star (HPwES) • We launched the Limited Time Offer for FY21 that will run from 10/15/20 through 4/15/21. The Limited Time Offer includes a $600 rebate for qualifying Rebate projects and 0% financing for qualifying Rebate & Loan projects. • We permanently increased the Velocity Credit Union loan cap from $15,000 to $20,000 on10/15/2020. • From 10/1/2020 to 12/31/2020 the program achieved 148 projects. SPUR – Instant Savings • During the holidays, we highlighted Energy Star air purifiers to support customers during the allergy/flu season and LED lighting due to the shorter days of sunlight. • Our SPUR field representative visited over 250 sites this quarter to verify signage was up and prices were correct during the holiday season. To promote Power Partner Thermostats, he also updated all instore signage related to the Seasonal Savings offer. Instant Savings was included in Marketing Communication’s Energy Conservation Campaign and was advertised through web, print, digital, radio and direct emails to the customer. All-Stars • • Many schools in Austin Energy’s territory were not sure what to expect with students toggling between in-building and remote learning for Fall 2020 and therefor were hesitant to commit to any “extracurricular” programs during this time. • Despite the challenges due to Covid-19, All-Stars was able to achieve almost 25% of the goal this quarter with 1,209 participants. • We are in the process of creating videos to …

The report is based on financial information reported in the City’s accounting system, ADV3, and in AMANDA, one of the City’s accounts receivable systems. Water fees collected during this six-month reporting period were $1,698,723 lower than the amount collected during the April through September reporting period a year prior; wastewater fees collected were $126,918 higher than those collected during the same period one year ago. Interest earnings for the six-month period equaled $90,159. The combined utility impact fees collected, plus interest, during the six-month period totaled $18,810,834. Of this total, $13,223,252 was for water and $5,587,582 was for wastewater. Total combined utility impact fees collected, plus interest, since the adoption of the current ordinance on June 20, 1990, through September 30, 2020, equal $364,289,239. Of this total, $244,965,939 was collected for water and $119,323,300 was collected for wastewater. Overall, combined collections were nearly $2 million more in FY2020 when compared to FY2019. As of September 30, 2020, the cash balances in the water and wastewater impact fee funds were $23,797,958 and $9,019,534 respectively, for a combined total of $32,817,492. ORDINANCE NO. 20201210-062 AN ORDINANCE AMENDING CITY CODE CHAPTER 25- 6 ESTABLISHING A STREET IMPACT FEE PROGRAM. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: PART 1. FINDINGS. The City Council makes the following findings in support o f this ordinance: (1) (2) (3) (4) (5) (6) (7) (8) Texas Local Government Code Chapter 395 ("Chapter 395") authorizes the City to offset the impacts of new development on the City's roadway network by imposing street impact fees by service area within city limits. The City has adopted land use assumptions by service area that project anticipated residential and employment growth from new development within each delineated service area over a ten-year period, in accordance with the methodology prescribed by Chapter 395. The City has prepared and adopted a roadway capacity plan that identifies improvements necessary to serve new development within each capital service area over a ten-year period, in accordance with the methodology prescribed by Chapter 395. The City has prepared and adopted a Transportation Plan that addresses all transportation needs within the City and that contains strategies for reducing the need for new capital improvements for the roadway system in the future by shifting demand to other modes of transportation. The Transportation Plan contains strategies for funding transportation needs. Street impact fees for a new development are calculated according to the trip generation rate and trip length for the new development. Street impact fees for a new development are calculated according to the standardized trip generation rate and trip length within the service area for the new development. Overall vehicular demand for roadway improvements generated by a new development can be reduced from that projected in the roadway capacity plan Page 1 of 14 by employing transportation demand management strategies recognized by the professional transportation engineering and planning fields. (9) It is appropriate to reduce street impact fees for applied measures that result in reduction in overall vehicular demand for a new development. COMMISSION RECOMMENDATION Asian American Quality of Life Resource Advisory Commission Recommendation Number: (20210119-04c): In Support of the City of Austin 2020’s State Legislative agenda WHEREAS, the City of Austin’s greatest asset is its people who are passionate about their city, committed to its improvement, and determined to see its vision become a reality; and WHEREAS, the percent of registered voters who voted in the past 4 years of city elections exceeded 60 percent; and WHEREAS, an overwhelming majority of registered voters who live in Austin voted for the current Austin City Council representation; and WHEREAS, over 700 Austinites participate and serve on over 60 Boards and Commissions to help shape, and continually improve upon the policies of the City and the lives of its Residents; and WHEREAS, the input provided to the Austin City Council through the City’s Boards and Commissions reflects the will of the community; and WHEREAS, it is the intent of the City of Austin that the legislative agenda guide City staff, in coordination with the City’s strategic partners, in their efforts to advocate on behalf of the City of Austin and its residents; and WHEREAS, each year, the Texas Legislature increasingly attempts to pass legislation that negatively impacts the City through preemption or limiting the ability to advocate; and WHEREAS, the 2019 Legislature strongly considered and almost passed S.B. 29 which would have limited the ability of the City to utilize community advocates to effectively advocate on behalf of the policies created and supported by its residents; and WHEREAS, taxpayers and City residents benefit from and need community advocates as a tool that amplifies their voices before the Legislature, Congress, and regulatory bodies; and WHEREAS, a prohibition on community advocacy equates to censorship of Residents’ voices and is detrimental to a representative democracy where all Austinites and Texans have equal opportunities to voice their opinions. Also, Highland Park reservoir and pump station have reached the end of their useful life and are undersized for the area. Highland Park reservoir hasn't been in use for years and the pump station is being used as an inline booster station which is not an approved pumping scenario per Texas Commission on Environmental Quality (TCEQ) standards. Construction of the proposed 16-in water main will allow Austin Water to take the Highland Park pump station and reservoir offline. The lack of a redundant transmission main is an increased risk for loss of water service. These repairs incorporate the scope of work that was agreed upon by the Ullrich Operations personnel and the Engineer of Record. The benefit of this project is that adequate safety controls will be re-established at the Low Service Pump Station which will allow personnel to work in a safe environment. Purchasing Language: Prior Council Action: Boards and Commission Action: MBE/WBE: The Walnut Creek Wastewater Treatment Plant (the plant) is permitted to treat and discharge an average daily flow of 75 million gallons per day (MGD) with a peak flow of 165 MGD. The plant currently averages approximately 60 MGD with peak flows in excess of 165 MGD during large rain events. The plant thickens the sludge produced by the treatment process prior to pumping it to the Hornsby Bend Biosolids Management Plant for further treatment. The thickening process has become increasingly unreliable over time. The existing gravity sludge thickener and equipment were constructed in 1977, are in very poor condition, and are beyond their useful life. In order to maintain an effective treatment process, replacement of the existing gravity sludge thickener and the equipment is necessary. Temporary thickening units are required to allow the existing gravity sludge thickener and associated equipment to be taken offline for rehabilitation. An additional unit is required to meet increased sludge flows at the plant, which will consume the majority of the project’s contingency funds. The original Council authorization allowed for a 10% contingency to cover unknown risks associated with the project. It is anticipated that the 10% contingency limit will not be sufficient for the project based on change orders currently under consideration relating to the required temporary thickening units. The contract was authorized to provide emergency cleaning and diffuser replacement in the aeration basin and the clarifier at the Dessau Wastewater Treatment Plant (WWTP). Services for this contract included all labor, equipment, materials and appurtenances such as tools, nozzles, hoses, personal protective equipment (PPE), dewatering containers, frac tanks, and instrumentation. Dessau WWTP had significantly increased daily flow rates of ammonia loading and Biochemical Oxygen Demand loading also increased while the aeration base capacity had been reduced due to grit and rags, causing the clarifier to overturn solids. Laboratory analysis was performed, and the results concluded that the WWTP was exceeding its daily ammonia permit levels. As a result, the WWTP was shut down in order to bring it back in compliance with the Texas Commission on Environmental Quality (TCEQ) standards. In order to avoid prolonged discontinuation of services from Dessau WWTP, an emergency procurement was requested by Austin Water with this contractor to clean the aeration base, replace the diffusers and the clarifier. This request was processed as an emergency procurement to address the elevated ammonia levels. Staff is now returning to council for ratification of the needed contract. The contractor has completed cleaning and the ammonia levels have been restored to be within TCEQ permit levels.

To: From: Zero Waste Advisory Commission Ken Snipes Director Austin Resource Recovery Date: January 13th 2021 Subject: Director’s Monthly Report to the Zero Waste Advisory Commission Roosevelt Gardens Asbestos Abatement Brownfields Project Austin Brownfields Revitalization Office (ABRO) performed an asbestos survey, confirming the existing building needed abatement. Project Transitions, a nonprofit providing affordable, supportive housing and hospice care for low-income people with HIV and AIDS in Austin, applied for a $100,000 sub-grant from the Brownfields Revolving Loan Fund (RLF) to remove the asbestos, as required by state regulations. The cleanup was completed, all required materials submitted and approved, and repayment of the invoices, totaling $100,000 is requested. After abatement and demolition, Project Transitions will build a new facility, providing additional, updated affordable units to residents, helping meet the City’s affordable housing goals, and providing a healthier environment by safely removing hazardous materials. This project also supported Project Transitions’ affordable housing funding application through City of Austin Neighborhood Housing and Community ARR Budget ARR Staff scheduled the following business planning work sessions to prepare for Fiscal Year 2022 budget: •Planning Work Session, Day One (December 14th, 2020): Discussion of Executive Team direction to guide the next five years of ARR’s budget, including potential program expansion and staffing. •Planning Work Session, Day Two (January 8th, 2021): Targeted group discussion of topics to include current and potential capital projects (vehicles, equipment, facilities), high-level needs, and potential issues that hinder the Department from reaching goals and performance metrics. As a component of the Long-Range Strategic CIP Plan (LRCSP), ARR recently submitted our Rolling Needs Assessment which identified capital needs for the next 10 years. The city-wide LRCSP serves to identify and assemble ongoing needs and strategic opportunities for capital investment across the city. The city-wide budget kickoff event is scheduled for Wednesday, January 10th. Chair Acuna opened with comments, 1. APPROVAL of the December 17th Special Called Meeting Minutes Chair Acuna entertained a motion to approve the December 17th, 2020 Meeting minutes. Commissioner Ian Stewart made the first motion for approval of the minutes. A second motion was provided by Commissioner Lisa Barden Item passed Unanimously 2. OLD BUSINESS 2a Discussion and Action – Truck Rental Ratification Ron Romero Division Manager of Collections provided information seeking a favorable recommendation to approve a ratification cooperative contract with Big truck rentals to provide, collection truck rentals for 560,880.00 dollars. Ron provided additional content on this particular item. Ron explained in May of 2020 the City of Austin entered into a rental agreement for (4) four collection vehicles for up to and not to exceed (6) six months to give the manufacturer time to fix some of the truck's deficiencies. Austin Resource Recovery’s fleet department found some additional flaws in the braking system of both our 2019 and newly delivered trucks. We are seeking approval of an additional (4) four trucks to insure the Garbage, Recycling, and Organics collections are not interrupted. Commissioner Kaiba White asked the question, What type of vehicles are being rented? If the are opportunities to select more options? Any information on additional collection criteria as it relates to sustainability? Ron Romero replied: There were a lot of manufactures that shut down production due to COVID-19. We did some inquiries to other vendors to see what was available. Time became sensitive to us because of the fact we were short on resources meaning equipment. We went ahead …

ETHICS REVIEW COMMISSION MEETING MINUTES Wednesday, January 13, 2021 The Ethics Review Commission (“Commission”) convened in a regular meeting on Wednesday, January 13, 2021, Austin, Texas via Videoconference. Chair Luis Soberon called the meeting to order at 6:10 p.m. All Commissioners were in attendance: Chair Luis Soberon, Vice-Chair J. Michael Ohueri, Secretary Kenneth “Tray” Gober, and Commissioners Debra Danburg, Betsy Greenberg, Mary Kahle, Raafia Lari, Robin Lerner, Donna Beth McCormick, Nathan Ryan and Pedro A. Villalobos. City Staff in Attendance: Lynn Carter, Commission Executive Liaison & Assistant City Attorney; Ashley Glotzer, Division Chief and Assistant City Attorney; Sue Palmer, Staff Liaison, Law Department. CITIZEN COMMUNICATION Each person who signed up to speak prior to the meeting being called to order and who designated this item on which to speak, or who did not designate an agenda item on which to speak will be allowed three minutes to speak. EXECUTIVE SESSION The Ethics Review Commission may announce it will go into Executive Session pursuant to Chapter 551 of the Texas Government Code to receive advice from legal counsel on any matters specifically listed on this agenda (Private Consultation with Attorney-Section 551.071). The Commission may go into executive session to discuss legal issues related to: (a) Complaints filed by Mark Littlefield against Peck Young, Voices of Austin, which complaints allege violation of City Code Chapter 2-2 (Campaign Finance) Section 2-2-33 (Disclosure Statement Required). (b) Complaints filed by Mark Littlefield against Ellen Wood, Had Enough Austin PAC and Ellen Wood, Fight for Austin PAC, which complaints allege violations of City Code Chapter 2-2 (Campaign Finance) Sections 2-2-3 (Conformity with Texas Election Code) and 2-2-32 (Reporting of Direct Campaign Expenditures). (c) A complaint filed by Mark Littlefield against Save Austin Now, which complaint alleges violation of City Code Chapter 2-2 (Campaign Finance) Section 2-2-23 (Political Committees).
