As a co-founder of the East Cesar Chavez Neighborhood Planning Team, I am very familiar with the dilemma suffered by owners of substandard lots. Unfortunately, because of some self-proclaimed leaders in the Holly Planning Area who do not believe in the value of diversity being an asset, the City Council never accepted a formal Neighborhood Plan nor recognized a legitimate Planning Team despite heroic efforts by city staff, local businesses, diverse residents, congregations or civic groups within the planning boundary. I attended many Holly Planning meetings and helped with outreach efforts to ensure that all voices in the neighborhood had a seat at the table. In fact, city staff tried to mediate the conflicts between members of El Concilio and the East Town Lake Citizens and the rest of the honest folks who wanted to have a Neighborhood Plan and adopt land use regulations like small lot amnesty and prevailing setbacks like we did in the East Cesar Chavez Neighborhood Plan. I knew the Dominguez family that lived at 54 Anthony for decades through my work with Summer Youth Employment and Community Education programs at Martin Middle School as an AISD project specialist up until 2000. Their tiny home, which I visited several times, was always at risk of being declared uninhabitable and my drive-by last week confirmed the condition of the tiny home has deteriorated even more. And there s a heritage tree that further restricts building a new home. I believe that unless these variances are granted, we ll all suffer from another vacant lot in the Holly Neighborhood because it s just not financially feasible to build a home with the current setbacks and required lot size. Or worse yet, the land will flip several times and future owners will expend their time, talent and treasure coming before your Board. Please allow the new owner to create a new home in Holly. I only wish there to be consideration to insure there is not a parking issue on this narrow street and this steep curve. If there is no off-street parking made available at this lot, there will be issues. Currently when a car is parked on the asphalt at this lot, it blocks over ½ of the street making it dangerous for a car coming down the hill by needing to be on the wrong side of the street during this steep blind curve. COMMENTS: Regarding the proposed variances for case C15-2022-0021 I have one concern. The requested 15’ front yard setback should be reviewed as per my comments below. There is a unique issue with this project. Robbins Road is a narrow, non-standard road only 18 feet wide. This is barely enough for two cars to pass plus this property is on a steep curve that causes additional issues for parked cars. Most of us living on this street have either provided for extra parking off the street on our property, or the ROW, to add gravel so guests have room to park off the road. While I do not know where the front/street property line starts, I would suggest you review it to insure there is enough room to add such a parking area. It is quite possible this can be achieved and allow the 15’ setback variance but should be reviewed and be part of your consideration. In addition to owning a home on the street, I was the builder of a neighboring home at 3605 Robbins Road where a variance was granted allowing a similar front yard variance. In the case of the 3605 Robbins granted variance, it was to allow a below street grade garage with parking on top that allows for off street parking for guests. The resolution contemplates the creation of a BAAP fund to support fee waivers or reductions for applicants who meet the eligibility criteria; as well as pro bono assistance with navigating the application process and subsequent proceedings. To meet the requirements outlined in this resolution, staff is working with the Financial Services Department to identify a funding source. In addition, staff is working with the procurement office to develop a process to procure pro-bono legal services. Staff does not anticipate completing all the components of the Council direction until May 2022 at which time a full response will be provided. The Target parking lot is escalated above grade by 4’ so we were allowed an over all height of 31’ for this new pylon. • Location Issues: We had a location for the pylon however, when we went to dig the hole, there was an underground pipe that was not detected as it was on Targets property and not part of the underground utilities that is marked by the underground utility locator. • Variance Request: I would like to see if we can get an additional 10’ – 12’ of height approved. The location that would require this are within the tree line and would therefore need the height increase for the sign to be seen.
