OLD BUSINESS (CDC) officers. a) Discussion and possible action on the election of Community Development Commission Commissioner Young nominated Commissioner Paup as Chair, and Commisioner Acosta nominated Commissioner Motwani as Chair. Commissioner Paup declined the nomination to serve as Chair, expressing interest in serving instead as Vice Chair. On Commissioner Acosta’s nomination, Commissioner Paup’s second, Commissioner Motwani was unanimously elected Chair of the CDC. On Commissioner Young’s nomination, Commissioner Tolliver’s second, Commissioner Paup was unanimously elected Vice Chair of the CDC. b) Discussion and possible action on the appointment of commissioners and election of the Chair to the CDC Housing Committee. Community Services Block Grant Programmatic/Financial Report November 10, 2020 The Community Services Block Grant funds the delivery of services to low income Texas residents in all 254 counties. These funds support a variety of direct services in addition to helping maintain the core administrative elements of community action agencies. Description of Recommendation to Council The Commission requests that the City Council direct the appropriate City official to: 1) Identify each appeal that the Commission granted from an employee who sought to overturn a discharge or denial of promotion; 2) For each such granted appeal, identify the effect of the appeal, including but not limited to the employee's position, rate of pay and any other relevant information regarding the employee before and after the appeal was granted; 3) For each such employee who had an appeal granted, identify whether the employee is still employed with the City and if so, the employee's position; 4) For each such employee who had an appeal granted, identify whether the employee has applied for any promotions or transfers and, if so, the result of such application; 5) For each such employee who had an appeal granted, identify whether the employee has been disciplined or placed on a performance improvement plan, and, if so, the nature and outcome of such disciplinary action or performance improvement plan; and 6) Report the finding of such review back to the Commission Rationale: The MCS Commission is a five-member commission established by the City Charter that, among other things, hears appeals and makes final, binding decisions in the case of any municipal civil service employee who is discharged, suspended, demoted, denied a promotion, or put on disciplinary probation. Item 12 Electric Utility Commission Annual Internal Review This report covers the time period of 7/1/2019 to 6/30/2020 The Board/Commission mission statement (per the City Code) is: (A) The commission shall review and analyze all policies and procedures of the electric utility, including the electric rate structure, fuel costs and charges, customer services, capital investments, new generation facilities, selection of types of fuel, budget, strategic planning, regulatory compliance, billing procedures, and the transfer of electric utility revenues from the utility fund to the general fund. (B) The commission shall advise the city council, the city manager, the electric utility, city departments, and city boards, commissions, and committees on policy matters relating to the electric utility. All advisory information given shall simultaneously be forwarded to the city manager. (C) The commission may review, study, and make recommendations to the Planning Commission on proposed electric utility projects for inclusion in the Capital Improvements Program. (D) The commission may request that the city council hire an outside consultant every five years to make a comprehensive review of the policies and procedures of the electric utility. The commission may initiate an external or internal review of the policies and procedures of the electric utility. If the commission initiates a review, it shall report its findings to the city council and the city manager. (E) The commission shall interpret the role of the electric utility to the public and the role of the public to the electric utility. Minimum Restrictions on Fence Design or Materials • § 25-2-899 - FENCES AS ACCESSORY USES An ornamental fence is a fence with an open design that has a ratio of solid material to open space of not more than one to four; and a solid fence is a fence other than an ornamental fence. • Height restrictions are the most controversial • The swimming pool code is the most restrictive making it unclimbable with a minimum height requirement, self-closing and self-latching gates • Commercial properties are exempt from a building permit when the fence height is 7 feet or less; Residential is exempt when it is 8 feet or less What Started the Discussion In March 2018, one month shy of his 3rd Birthday, Kade Damian died after his neck became stuck between two bars on a wrought iron fence. His feet could not reach the bottom bar and he died almost instantly. His father, a trained first responder, could not revive him; even though Kade was found only minutes after climbing the fence. PROPOSED LANGUAGE 123.1 Fence Design. A fence design with potential climbable features shall not be designed with entrapment and/or impalement features protruding from the top of the fence. A. A non-climbable fence is as determined by the swimming pool B. An entrapment is less than 6 inches of clear space. C. A fence replacement of 50 percent or more requires compliance code. with this section. D. Voluntary compliance on existing fences that are at the maximum height will be exempted from the maximum height requirement, if the addition or modification does not extend an additional 6 inches above the original height.
