MUNICIPAL CIVIL SERVICE COMMISSION MEETING MINUTES Monday, October 26, 2020 REGULAR MEETING Monday, October 26, 2020 MUNICIPAL CIVIL SERVICE COMMISSION MINUTES The Municipal Civil Service Commission convened in a regularly scheduled meeting on Monday, October 26, 2020 via videoconferencing. Chair Lancaster called the Commission meeting to order at 9:09 a.m. Commissioners in Attendance: Pamela Lancaster, Chair Melissa Rogers, Vice-Chair Erika Kane Teresa Peréz-Wiseley Commissioners Absent: Rebecca Eisenbrey Staff in Attendance: Matthew Chustz, Municipal Civil Service Administrator April Shaw, Municipal Civil Service Coordinator Mecia Griffin, Civil Service Coordinator 1. APPROVAL OF MINUTES a. Approve the minutes of the Municipal Civil Service Commission regular meeting of August 10, 2020. The minutes of the August 10, 2020 regular meeting were approved on Commissioner Peréz-Wiseley’s motion, Vice-Chair Rogers’ second, on a vote of 4-0. 3. OLD BUSINESS a. Discussion and possible action regarding nomination and recommendation of Chair of the MCS Commission. The recommendation of Commissioner Teresa Peréz-Wiseley as Chair of the MCS Commission was approved on Chair Lancaster’s motion, Commissioner Kane’s second, on a vote of 4-0. 1 MUNICIPAL CIVIL SERVICE COMMISSION MEETING MINUTES Monday, October 26, 2020 b. Discussion and possible action regarding election of a Vice-Chair of the MCS Commission. The election of Commissioner Melissa Rogers as Vice-Chair of the MCS was approved on Commissioner Peréz-Wiseley’s motion, Chair Lancaster’s second, on a vote of 4-0. c. Discussion and possible action on the MCS Recommendation to City Council (Recommendation 20191108-04B) regarding the review of granted denial of promotion and discharge appeals. This item was postponed. d. Discussion and review of the Municipal Civil Service Rules to provide input to the Municipal Civil Service Director. This item was postponed. e. Discussion and possible action on future meeting dates, times and locations. Discussion was held on future meeting dates, times, and locations. The motion to approve the 2021 meeting calendar as amended was made on Chair Lancaster’s motion, Vice-Chair Rogers’ second, on vote of 4-0. The following 2021 meeting dates were added to the Municipal Civil Service Commission’s calendar: Monday, January 11, 2021 Monday, January 25, 2021 Monday, February 8, 2021 Monday, February 22, 2021 Monday, March 8, 2021 Monday, March 22, 2021 Monday, April 12, 2021 Monday, April 26, 2021 Monday, May 10, 2021 Monday, May 24, 2021 Monday, June 14, 2021 Monday, June 28, 2021 Monday, July 12, 2021 Monday, July 26, 2021 Monday, August 9, 2021 Monday, August 23, 2021 Monday, September 13, 2021 Monday, September 27, 2021 Monday, October 11, 2021 Monday, October 25, 2021 Monday, November 8, 2021 Monday, December 13, 2021 2. HEARING a. Conduct a hearing on the appeal filed by Samuel Garcia regarding their Discharge from Austin Energy. A hearing was conducted on the appeal filed by Samuel Garcia regarding their Discharge from Austin Energy. Samuel Garcia made a request to conduct a portion of the hearing in closed session. 2 MUNICIPAL CIVIL SERVICE COMMISSION MEETING MINUTES Monday, October 26, 2020 The motion to conduct the hearing in closed session, pursuant to 551.074 of the Texas Government Code (personnel exception), was approved on Chair Lancaster’s motion, Vice-Chair Roger’s second, on a vote of 3-0, with Commissioner Kane off the dais. Chair Lancaster recessed the Municipal Civil Service Commission meeting to go into closed session at 2:29 p.m. The hearing was conducted in closed session on the appeal filed by Samuel Garcia regarding their Discharge from Austin Energy. Closed session ended and Chair Lancaster called the Municipal Civil Service Commission meeting back to order at 2:40 p.m. to resume the hearing on the appeal filed by Samuel Garcia regarding their Discharge from Austin Energy. b. Deliberate in open or closed session, pursuant to 551.074 of the Texas Government Code (personnel exception), regarding the appeal of Samuel Garcia regarding their Discharge from Austin Energy. Chair Lancaster recessed the Municipal Civil Service Commission meeting to go into closed session at 2:49 p.m. The Commission deliberated in closed session on the appeal filed by Samuel Garcia regarding their Discharge from Austin Energy. Closed session ended and Chair Lancaster called the Municipal Civil Service Commission meeting back to order at 3:17 p.m. c. Possible action and decision regarding the appeal of Samuel Garcia regarding their Discharge from Austin Energy. The motion to deny Samuel Garcia’s appeal and uphold the decision made by the City of Austin in the Discharge of Samuel Garcia was approved on Vice-Chair Rogers’ motion, Commissioner Peréz-Wiseley’s second, on a vote of 3-0, with Commissioner Kane off the dais. 4. FUTURE AGENDA ITEMS The Commission requested a future agenda item for discussion and possible action regarding the Municipal Civil Service recommendation to City Council (Recommendation 20191108-04B) regarding the review of granted denial of promotion and discharge appeals. The Commission requested a future agenda item for discussion and review of the Municipal Civil Service Rules to provide input to the Municipal Civil Service Director. ADJOURNMENT Chair Lancaster adjourned the meeting at 3:25 p.m. without objection. 3
