U Visa Process i. Krystal and Karen Crawford met with the District Attorney to discuss how their office is overhauling their U Visa Process policies. They are trying to standardize best practice. ii. Kate and Karen met with Lt. Chomout about APD’s role in the U Visa process. They confirmed that they will not certify Class C’s because they do not investigate them. They will refer them to help. Also discussed the U Visa Review Panel. There was a change in policy within APD which created this Committee and made it impossible to review or re-consider decisions made in U Visa process. APD was hesitant to create review process because they lacked staff. COIA created a volunteer group to help them with these reviews for the last few years. APD confirmed in this meeting that they will be taking over this process and are currently working out details. 1. Karen will forward summary notes from the meeting. 2. Will ask APD to give a briefing at a future meeting about their updates to the U Visa process. iii. Received a request from a local attorney to talk to the Travis County Attorney’s office because they have had applications pending for over a year. There are children aging out because of the long wait times and they cannot get any response from the office. 1. Commission can ask if they will come to a future meeting for a briefing on the current process and wait times. 2. College Student Commission Recommendation 20220429- Draft: An Obligation to Reform Progressive Neoliberal “Affordable” Housing in the City of Austin Part 2 of 2 Authored By: Commissioner Edwin Bautista (UT Austin) WHEREAS, the College Student Commission recognizes the University of Texas at Austin cost of attendance for a Texas resident, which includes tuition, housing and basic living expenses, is over $30,000 a year1; and, WHEREAS, a 2019 Memorandum to City of Austin Staff written by Root Policy Research regarding college student effect on rental housing prices also stated that “student housing developments have higher average rents than conventional developments even after accounting for the larger average size of student rentals: $2.29 average rent per square foot for student rentals compared to $1.53 per square foot for conventional.”2; and, WHEREAS, the College Student Commission recognizes the University Neighborhood Overlay (UNO) was created by Ordinance No. 040826-56 and codified into city code in 20043 as a development incentive that includes an affordable housing component4 (S.M.A.R.T. Housing); and, WHEREAS, UNO and its associated guidelines intend to facilitate the development of a dense residential district adjacent to the University of Texas flagship campus, thereby reducing transient student traffic and parking near the campus; and, WHEREAS, “S.M.A.R.T. Where is the extra space coming from for future improvements? • Does this mean that our streets will become “patchy,” such as a partial bike lane that runs into parking, since development might not be uniform? • How does the ASMP affect the design of my street? • How did you identify these Street Network Amendments? Q: Are you taking my property? No, the ASMP is not taking or acquiring any land. Let’s go deeper: The ASMP is not a process to acquire land. The ASMP is the city’s Transportation Plan and the transportation element of the Imagine Austin Comprehensive Plan. Its purpose is to provide the city’s future transportation vision and is used for the long-range development of the city’s transportation network through development regulations. The ASMP identifies the amount of land that a property being developed must dedicate per the Land Development Code to promote public health, safety, and welfare, but the ASMP itself is not acquiring land. Land acquisition occurs during the project development and delivery phases of a Capital Improvement Project. The land that is dedicated through the land development process becomes public right of way to provide public infrastructure according to the standards in the TCM. Land dedication is only triggered for certain types of development: residential development that is a greater intensity than a duplex or commercial development. It does not apply to single-family homes going through the building permit process. Properties that are going through the subdivision process are subject to land dedication, but land dedication is subject to Rough Proportionality, which is a legal statute that requires any land being dedicated be proportional in value to the development’s impact on the transportation network. Because every development is unique it is impossible to definitively determine if a subdivided property would be required to dedicate land, but based on current land values, TCM standards, and the recently adopted Street Impact …

The City Charter requires posting notification in the Austin American Statesman and sending notification to the Community Registry 16 days prior to holding a Public Hearing at City Council. In addition to the Charter requirements, the ASMP amendment process included two rounds of engagement and outreach before posting the Final Draft of the proposed amendments for the Public Hearing, including targeted social media advertising and notification to the Community Registry. Further notification to individual households and properties is not a requirement of the Comprehensive Plan nor necessary at this stage of the process. This amendment process and proposed changes in Street Level are consistent with the purpose of the Comprehensive Plan. Additionally, significant outreach to properties along streets with proposed projects will occur as projects go through the project development and delivery phases. White/Caucasians and Asians received a higher percentage of warnings/field observations at 63% and 64%, respectively • Black/African Americans were three times more likely to be searched and were approximately three times more likely to be arrested than White/Caucasians • Hispanic/Latino drivers make up 34% of motor vehicle stops and 43% of arrests resulting from stops, but make up 31% of Austin’s adult population • Hispanic/Latinos received the highest percentage of citations at 44% 2018 Officer-Involved Shooting Report • Austin officer-involved shootings in 2018 showed that 7 out of 12 incidents involved Latinx individuals. • Most individuals involved in the 2018 incidents were ethnic minorities, specifically Latinx males, and most individuals involved in the 2018 incidents were between 20-28 years old. • The highest concentration of Officer-Involved Shootings occurred in City Council District 2, the borders of which closely mirror those of APD’s Frank sector. Report on Budget Recommendations to Council for FY 2022-23 Joint Inclusion Committee The Joint Inclusion Committee (JIC) made significant changes to its approach to budget recommendations for FY 2022-23 based on comments and suggestions from the past several years. The changes were intended to reflect the mission of the JIC to better "promote close cooperation between Council City management, City boards, commissions, committees, task forces, individuals, institutions, and agencies to increase and sustain equity, diversity, and inclusion in the City of Austin. This year, we began the process by preparing a list of the issues that we believed were most pressing for the marginalized communities represented by the commissions that make up the JIC. We intended to focus our recommendations and endorsements on these priority issues without limiting commissions from making individual recommendations on issues specific to their communities. Accordingly, chairs, vice-chairs, and designated JIC representatives from the member Commissions vetted these issues in a virtual meeting. The identified issues included: ● Affordability ● Resilience ● Access ● Engagement ● Public Safety ● Health The second step was a briefing from the Budget Office on what prior-year recommendations had been included in the current adopted budget, followed by an opportunity to meet with departments to discuss their current year plans. Unfortunately, this briefing did not occur until late January of this year rather than at the beginning of the fiscal year as has been done in past years. This delay put commissions at a considerable disadvantage in preparing informed budget recommendations, given the shortened time frame between the budget briefing and the deadline for submitting recommendations. The six priority issues served as the basis for organizing our three town hall sessions, which began immediately following the Budget Office briefing. Although the priority issues provided a focus for the town halls, discussions were not limited to those subjects. Overall, the town halls supported the focus on the identified issues but provided additional contexts based on how individuals had experienced the issue. For example, while we had originally defined safe and affordable housing to include the related expense of childcare, we heard from the community that family members with disabilities presented unique unmet needs in terms of access and affordability. Additional meetings with City departments were scheduled to discuss possible recommendations and get department input. Safe Fence Resolution Purpose To provide an update regarding the 2022 Safe Fence Resolution # 20211104-039 History • November 9, 2020 - Beth Culver and proponents of change presented to the board a possible code change that would impact fence design for the life and safety of children, pets, wildlife and contractors in our community. • June 4, 2021 – Building and Fire Board Working Group met to draft resolution for fence safety requirements.
