§ 3. REDISTRICTING. (A) For purposes of this section, the following terms are defined: (1) COMMISSION means the Independent Citizens Redistricting Commission. (2) CONTROLLING PERSON means an officer, director, manager, principal, or shareholder or member owning at least 10% ownership of a legal entity. (3) DAY means a calendar day, except that if the final day of a period within which an act is to be performed is a Saturday, Sunday, or holiday in which the City of Austin's offices are closed, the period is extended to the next day that is not a Saturday, Sunday, or holiday in which the City of Austin's offices are closed. (4) PANEL means the Applicant Review Panel of three qualified, independent auditors that screens applicants for the commission. (5) QUALIFIED INDEPENDENT AUDITOR means an auditor who is currently licensed by the Texas Board of Public Accountancy and has been a practicing independent auditor for at least five years prior to appointment to the Applicant Review Panel. (6) SPOUSE means one's licensed marriage spouse, common law spouse, or recognized domestic partner. (7) SUBSTANTIAL NEGLECT OF DUTY means that an individual has disregarded a manifest duty, prescribed by this section, intentionally, knowingly, or negligently. Missing half or more of the meetings in a three month period constitutes a substantial neglect of duty. (B) In 2013 and thereafter in each year following the year in which the national census is taken under the direction of Congress at the beginning of each decade, the commission shall adjust the boundary lines of the 10 single-member districts in conformance with the standards and process set forth in this article. The commission shall be fully established no later than July 1, 2013, and thereafter no later than March 1 in each year ending in the number (1). The commission shall not draw district lines at any other time, except if the districts must be redrawn because of a judicial decision invalidating the then existing district plan, in whole or in part, or the date of the city election is moved. If the date of the city election is moved, then the dates in this article shall be adjusted to ensure the commission has sufficient time to draw the lines prior to the election date. (C) The commission shall: (1) conduct an open and transparent process enabling full public consideration of and comment on the drawing of district lines; (2) draw …

However, the northern portions of the site contain the most elevation drop from west to east. All slopes are less than 15%. High Point NTS North 4 VARIANCE REQUEST • To allow cut in excess of four feet and up to 14.3 feet within the Desired Development Zone. (LDC 25-8-341) • To allow fill in excess of four feet and up to 16.5 feet within the Desired Development Zone. (LDC 25-8-342) 5 PROPOSED SITE PLAN & GRADING NTS North 6 FINDINGS • • This site offers a reasonable location for large industrial manufacturing warehouses as it is located in the Desired Development Zone along a growing manufacturing corridor, in line with sites such as Tesla and Amazon. In order to facilitate this type of development the truck courts / loading dock areas must have grades of less than 4% for maneuverability and must be fairly level so that when the trucks are parked at the loading docks the trailer elevations sit level with the finish floor elevations of the buildings and can be loaded and unloaded with ease. 7 FINDINGS (CONTINUED) • • Due to the topography of the site and the size of the proposed buildings (each approximately 4 acres in size), in order to accomplish the operational criteria, cut up to 14.3 feet and fill up to 16.5 feet are necessary. It can be challenging to find property flat enough to prevent the required amount of grading. Therefore, staff is requiring retaining walls to structurally contain the cut and fill and minimize the amount of grading. 8 FINDINGS (CONTINUED) • • This variance request is the minimum deviation from the code requirement necessary to allow a reasonable use of the property. (LDC 25-8-342) 5 PROPOSED SITE PLAN & GRADING NTS North 6 FINDINGS • • This site offers a reasonable location for large industrial manufacturing warehouses as it is located in the Desired Development Zone along a growing manufacturing corridor, in line with sites such as Tesla and Amazon. In order to facilitate this type of development the truck courts / loading dock areas must have grades of less than 4% for maneuverability and must be fairly level so that when the trucks are parked at the loading docks the trailer elevations sit level with the finish floor elevations of the buildings and can be loaded and unloaded with ease. 7 FINDINGS (CONTINUED) • • Due to the topography of the site and the size of the proposed buildings (each approximately 4 acres in size), in order to accomplish the operational criteria, cut up to 14.3 feet and fill up to 16.5 feet are necessary. It can be challenging to find property flat enough to prevent the required amount of grading. Therefore, staff is requiring retaining walls to structurally contain the cut and fill and minimize the amount of grading. 8 FINDINGS (CONTINUED) • • This variance request is the minimum deviation from the code requirement necessary to allow a reasonable use of the property. Moreover, the design decision provides greater overall environmental protection than is achievable without the variance. Further west are undeveloped properties zoned SF-2-CO. Immediately west of the property is Ed Bluestein Boulevard; across Ed Bluestein Boulevard are properties zoned GR-V-NP, GR-NP, and GR-MU-CO-NP. These properties include retail uses (including a grocery store), undeveloped property, and civic land uses (Boys and Girls Club). Immediately to the east is a small tributary to Walnut Creek that has 100-year floodplain and a 200' wide creek buffer centered on the tributary. In 1988-1989, a restrictive covenant (RC) was placed on the property in conjunction with a rezoning from GR to LI-CO. The RC references SF-3 zoning across Johnny Morris Road, however there is no longer any SF-3 zoning across the street (now zoned MH). The RC requires that access to the subject tract be designed to minimize traffic conflicts with the SF-3 tract; current Code requires that all driveways be designed to minimize traffic conflicts. June 14, 2021 Zoning and Platting Commission City of Austin RE: Letter of Opposition to Item B-3, 11705 Research Blvd.; Rezoning Case C14-2020-0146 Dear Commissioners: We are opposed to the rezoning of 11705 Research Boulevard until there is a plan to solve the serious traffic congestion and safety issues on the adjacent portion of the US Highway 183 NB service road. The headquarters of our organization, the Texas Association of School Boards, Inc. (TASB), is located just 0.3 miles northbound from the subject property, adjacent to the same service road. Our employees, tenants, and visitors already have a difficult time safely entering and exiting the parking lot with the high traffic volumes and crossing three lanes of traffic to get onto the on-ramp for the highway, and this situation will worsen if the proposed rezoning were approved. In 1990, the City Council approved the rezoning of the property to LI-CO, with conditions that reflected traffic concerns at that time. Now, nearly 30 years later, those concerns are substantially worse, and yet the applicant is requesting to lift much of the conditional overlay even though the population of the metropolitan area has increased from 846,227 in 1990 to 2,295,303 as of 2020. To summarize our concerns: 1. The General Warehousing and Distribution, Equipment Sales, and Equipment Repair Services uses should be prohibited on the entire property, since these uses would likely increase the volume of large trucks on the frontage road. 2. The projected traffic from the redevelopment of the larger overall 3M property is 16,136 trips per day. Because the property is just one portion of the overall 3M property, a decision on the proposed rezoning should consider the impact of the redevelopment of the entire 3M property, and there should be increased protections against traffic issues—not fewer. 3. The conditional overlay setting a maximum height of 40 feet should remain in place; otherwise there could be a more intensive development, which would further exacerbate the traffic issues. 4. We have seen no plan that would actually address the traffic issues, and the rezoning should be denied until there is a proven solution that is required to be implemented. The community oriented plan will include non-armed public safety ambassadors, community intervention specialists and trained transit police officers. Gardner Tabon, executive VP and chief safety officer for CapMetro, says it's an honor and a privilege to take on the challenge of reimagining public safety in the city We will be taking a totally different approach to public safety. We want to not just gain the communities trust but we want to maintain it as well. Our public safety ambassadors will have multiple responsibilities including a touch of security as well as the ability to make a decision at the scene of a possible incident and be able to de-escalate before it even becomes something a police officer may have to report to," Tabon said In part, community intervention specialists will work as liaisons between the public and the department. Putting boots on the ground in the community to help provide needed resources to individuals facing everyday challenges, such as homelessness and mental health issues. Tabon says these keys roles will help mediate a situation before it actually becomes a serious issue. The department plans to prevent calling law enforcement for incidents that may not be police or law enforcement issues. “I am particularly, as an African American male, very sensitive as to what has been going on over the past two years. I want to really make sure that we have in place a police department that the community will appreciate,” Tabon said. CapMetro’s pilot program for policing is the first initiative of its kind in the state of Texas.
