In 1987, Congress re-authorized and amended the statutory DBE/ACDBE programs and added women to the groups presumed to be disadvantaged. Since 1987 DOT has established a single DBE/ACDBE goal, encompassing both firms owned by women and minority group members. The three major DOT Operating Administrations (OAs) in the DBE program are the Federal Highway Administration (FHWA), the Federal Aviation Administration (FAA) and the Federal Transit Administration (FTA). The DOT DBE program is administered by state and local transportation agencies under the rules and guidelines in the Code of Federal Regulations. (Title 49, Part 26). The FAA maintains a separate program for concessions in airports under (Title 49, Part 23) known as the Airport Concession Disadvantaged Business Enterprise (ACDBE) Program. HOW THE PROGRAM WORKS Regulations require recipients of DOT Federal financial assistance establish goals for the participation of disadvantaged entrepreneurs and certify the eligibility of DBE firms to participate in their DOT-assisted contracts. Recipients are state and local transportation agencies; FAA, FHWA & FTA. Each DOT-assisted State and local transportation agency are required to • Establish narrowly-tailored goals. • Evaluate DOT-assisted contracts throughout the year • Establish contract specific DBE/ACDBE subcontracting goals to ensure nondiscrimination in federally-assisted procurements. ABOUT THE ACDBE PROGRAM The U.S. DOT’s ACDBE program through the Department of Aviation provides a vehicle for increasing the participation of women and minorities in state and local procurement for airports. Federal Regulations require Departments of Aviation that receive USDOT financial assistance to establish a ACDBE Program and goals for the participation of ACDBE’s. Departments of Aviation are required to establish annual ACDBE goals and review contracts throughout the year to establish project-specific ACDBE subcontracting goals. LGBTQ QUALITY OF LIFE ADVISORY COMMISSION REGULAR MEETING MINUTES The LGBTQ Quality of Life Advisory Commission convened in a regular meeting on Monday, August 9, 2021, via video conference. Chair Gonzales called the meeting to order at 7:09 p.m. Members in Attendance: Gonzales, Curry, Curette, Dowling, Kirby, Martinez, Taylor, Wollerson Staff in Attendance: Staff Liaison Neal Falgoust PUBLIC COMMUNICATION: None 1. APPROVAL OF MINUTES – The minutes of July 12, 2021, were approved without objection. 2. NEW BUSINESS a. Charles Robbins of Health Management Associates provided an update concerning the LGBTQIA+ Quality of Life Study. All of the recommendations are aligned to the City Council’s Strategic Direction 2023. b. Chair Gonzales addressed the role of the commission in publicizing the results of the LGBTQIA+ Quality of Life Study. The commission intends to conduct town hall-style meetings with stakeholder groups. Chair Gonzales acknowledged the difficulty in communicating with the community during the pandemic. The commission appointed, without objection, Chair Gonzales and Vice Chair Taylor as spokespersons on the Quality of Life Study. c. Vice Chair Taylor discussed the organization of working groups to address topics within the Quality of Life Study. d. Chair Gonzales discussed the Special Session of the Texas Legislature and the current quorum break, and requested the commission to keep track of what is happening at the Capitol. No recommendations were presented. e. Commissioner Kirby discussed Governor Abbott’s attacks on transgender youth. Commissioner Wollerson agreed to work on drafting a recommendation to City Council. f. Commissioner Curette discussed the eviction of 85 families from Rosemont Apartments. The evictions have been halted for now with the help of BASTA. Chair Gonzales asked that commissioners work on drafting a robust recommendation on housing issues. g. Chair Gonzales discussed the need for an amendment to the Commission’s Bylaws and quorum requirements. h. Chair Gonzales noted that a final report on the Winter Storm Uri Review Task Force will soon be made public. Recommendations will be made to Council i. Regardless of species—and regardless of whether they have been depicted on this sheet or not—all trees 19" in trunk diameter and greater at a height of 4'-6" above adjacent grade are protected by municipal ordinance. No protected tree shall be removed without a permit. No impacts of any kind are permitted in the 1/4 CRZ of any protected tree. Tree protection measures per the details on sheet G006 are required for all protected trees (on subject property and adjacent properties) whose CRZs fall within the subject property, even if said CRZs will not be directly impacted by construction. Extents of tree protection fencing are shown on this sheet. Tree protection fencing shall be installed prior to the commencement of construction. 2x4 or greater size planks @ 6' minimum length shall be strapped securely around protected trees' trunks and root flares when protective fencing does not incorporate entire 1/2 CRZ. All pruning shall be conducted under the strict oversight of a licensed professional arborist. PRUNING FOR SUBJECT TREES SHALL NOT EXCEED 25% OF TREE CANOPY. Trenching for all utilities in CRZs (indicated by notes 13, 14, 15, and 16) shall be minimized to the least extent feasible and shall occur by means of air-spading by a licensed professional arborist. Care shall be taken during construction that activities requiring vertical movement (eg, drilling rigs) shall not disturb existing tree canopies. The placement and storage of materials and/or heavy equipment on CRZs is strictly prohibited without exception. C-1/69 MEMORANDUM TO: Members of the Planning Commission FROM: Jerry Rusthoven, Assistant Director/Interim Lead Planning and Zoning Department DATE: May 22, 2020 SUBJECT: UNO Sign Regulations The Planning and Zoning Department is requesting the Commission initiate an amendment to the UNO ordinance to correct an inadvertent change made to the sign regulations in the ordinance. In November 2019 the City Council approved changes to the UNO ordinance. One of those changes was intended to address signs above the second story of a building. Those signs were required to be cut in or engraved into the structure of the building. If the name of a building were placed on the facade this made it physically difficult to change the name in the future. It was agreed by the stakeholders to remove this requirement. In making this change to the ordinance a mistake was made and the result is all illuminated signs were prohibited in the UNO area. This is not what was intended or agreed to by the stakeholders. Also, because the UNO sign regulations are also used in TODs and the North Burnet/Gateway Plan this mistake carries over to other areas. Staff is asking for the opportunity to correct the ordinance. § 2-1-111 - BOARD OF ADJUSTMENT. (A) The Board of Adjustment is established as provided in Local Government Code Chapter 211 (Municipal Zoning Authority). Board of Adjustment Training & Staff Support Workgroup 2020-07-02 (Leighton-Burwell, Hawthorne, Von Ohlen & Bailey) -- UPDATED Results /Action Items Proposed by the Workgroup (for discussion and possible action by the whole Board at upcoming BOA Meeting): 1. We want to start BOA trainings ASAP (thanks to our Liaison, this is already underway). 2. We want to have knowledgeable staff available at our hearings to answer questions regarding issues outside of BOA Liaison’s expertise (residential zoning), such was Lake Austin, Signage, Waterfront Overlay, etc. 3. We want to find out status of GIS mapping efforts showing history of BOA cases (location, type, etc.). 4. We want to build new bridges with City Staff and repair relationships from past situations. In addition, we want to be able to increase staff accountability without it appearing as a personal attack. 5. We want to know what the Department Supervisors need / want from BOA to better support each other and our joint processes. 6. We want to temper our deliberations to be focused on the facts of the cases before us and be less inflammatory or confrontational towards applicants and staff. 7. We want to hold ourselves accountable and our BOA colleagues in a civil and respectful manner. 8. We want to create processes for transitions in BOA leadership and for additions of new members to our Board. 9. We want to include training on the role the legislature plays in the BOA. Specifically how we are governed by both City and State mandates and what that means in how we operate. F-4/1
