Box 1088 Austin, TX 78767 RE: Request for Reconsideration of Austin’s Proposed Bastrop County ASR Project and MOU Dear Mayor Watson and Members of the Austin City Council; I am writing to urge the City of Austin to immediately reconsider its plan to move forward with the proposed Aquifer Storage & Recovery project in Bastrop County and the signing of the related MOU. The people of Bastrop County could not have been clearer in their opposition. Residents have packed every meeting, submitted countless comments, and raised legitimate concerns—but their voices have fallen on deaf ears at City Hall. The root issue is trust. From the day this project was announced in 2021, Austin has struggled to earn it. A lack of early communication and an approach where Austin Water dictated the terms rather than engaged as a partner created deep local skepticism. When Austin did come to the table, it only did so after I filed legislation to restrict this project. The community meetings that followed did not repair trust or provide full answers. That is why not a single elected official in Bastrop County has supported the MOU or the ASR project behind it—a fact carries real weight. Crossing county lines to inject treated water into an aquifer that serves another community is not responsible planning. It is overreach, plain and simple, and it plants a permanent flag of authority in a county that has made its objections known. The truth is: Austin has other options. The City can address the almost 30,000 acre-feet of water losses identified in its own audit, pursue smaller but viable sites within Travis County, and manage its resources responsibly without imposing on Bastrop County landowners. Signing this MOU would commit Austin taxpayers to millions of dollars in spending for a project that faces unanimous opposition from the citizens of Bastrop County. I have already passed legislation to block this overreach once and will continue to use every legislative and lawful tool available to stop it permanently. Moving forward now would only invite additional roadblocks and waste more of Austin’s taxpayer dollars on a project that will inevitably be stopped. The Legislature has already demonstrated strong interest in clarifying how cross-jurisdictional ASR projects are handled, and any attempt to advance a project with zero local support will only accelerate that scrutiny. Goal Redevelopment must offer a wide range of housing choices to create a new community of socially and economically diverse residents. MDA Requirements MDA requires 25% of all housing to be affordable For ownership requirement = affordable homes must be available at 80% MFI for at least 1 year For rental requirement = affordable apartments much be available 60% MFI for at least 5 years MDA incorporates Affordable Housing Resolution confirming Catellus (now Banbury) commitment to use good-faith efforts to provide longer and deeper affordability 3 | RMMA PIAC 11/12/25 Background: Designing the Program – 2004-2007 • Development with intermixed affordability was a very new concept; it had not been done in Texas before; 25% affordability an ambitious goal nationally. • One-year affordability was the MDA requirement for homeownership and 5- year affordability requirement for rental; the City and the surrounding community wanted Mueller to go farther. • • The land trust statute did not yet exist when the Mueller Affordable Homes Program was forming. $165,000 homes were available in the marketplace. • Central Park (formerly Stapleton): 10% affordability; fewer resale protections; less interspersed. • The team worked with City of Austin and PeopleFund/PeopleTrust to design the affordability preservation program. • Creation of a nonprofit (Mueller Foundation) to steward the housing program and other public goals. 4 | RMMA PIAC 11/12/25 Background: HomeBase Collaboration • HomeBase is a 501(c) (3) nonprofit sister organization to Austin Habitat for Humanity, providing affordable housing consulting services. • • In March 2023, the Mueller Foundation hired HomeBase to manage Mueller’s affordable resale …

Girard Kinney Park at Mueller About Girard Kinney Girard Arnold William Kinney, Jr. was born on March 4, 1943 at Walter Reed Hospital in Washington, DC to parents Girard Senior and Cleora Deitz Kinney. In 1946, Girard and his parents moved to the Zilker neighborhood near Kinney and Virginia avenues, streets named aMer his grandparents. He was soon joined by his brothers George and Eugene, and his sister Virginia. The family home was built in 1873 by his grandfather’s great uncle, Coronel Griffin. He aVended Zilker Elementary, Fulmore Middle, and Travis High schools. During his teen years, he was interested in herpetology, a branch of zoology that focuses on repXles and amphibians. He collected, sold, and even milked snakes before selling the poison to the U.S. Navy for the producXon of anX-venom. However, aMer being asked by a teacher about what careers he and his classmates would want, he consulted with his father who asked him to name his skills. When Girard listed math and arts among his talents, his father suggested architecture, and so he began to learn more about the discipline during his high school years. Consequently, to pursue his interests in building design, in 1961 he enrolled at the University of Texas at AusXn in the School of Architecture where he was taught by many disXnguished professors, including Alan Taniguchi, whose father is the namesake of Mueller’s Isamu Taniguchi Park. Girard paid his way through school by ulXmately working three jobs simultaneously that also expressed his personal interests: fishing as a license clerk at the Texas Game & Fish Commission (now Texas Parks & Wildlife), architecture as a draMsman at the Calcasieu Lumber Company, and model cars as a manager of a model car racing track. Although he was set to graduate aMer compleXng all of his required hours, Girard quit school in protest to UT’s plans to demolish a collecXon of mature live oak trees and the university’s stance on the Vietnam War; however, he returned to UT in 1978 to take a final course and graduate. Girard has been married to Leyla Cohlmia for 40 years. They have a son, and Girard has a daughter from a previous marriage. Early in his long and remarkable career, Girard and his fellow architects developed the idea of building an auditorium/amphitheater along Waller Creek that he then pitched to the AusXn Symphony Orchestra, which resulXng in Symphony Square. …
