City of Austin - Design Commission Project Review Application The Design Commission provides advisory recommendations to the City Council to assist in developing public policy and to promote excellence in the design and development of the urban environment. The Design Commission reviews three types of projects: 1. City projects (see page ii for process) The Commission reviews all municipal buildings and associated site plans to ensure they demonstrate compliance with city design and sustainability standards (Council Resolution No. 20071129-046), including those seeking Subchapter E Design Standards Alternative Equivalent Compliance (AEC) (Council Resolution No. 20100923-086). 2. Destiny Bonus projects (see page iv for process) The Commission reviews density bonus projects for substantial compliance with the Urban Design Guidelines for Austin in accordance with the Gatekeeper requirements of LDC 25-2-586 for the Downtown Density Bonus Program. 3. Advisory Recommendations for Private projects (see page ii for process) The Commission will consider Project Review Applications from private projects during its regularly scheduled monthly public meetings and may issue an advisory recommendation in the form of a Project Review Letter to the Applicant. This Project Review Application must be submitted before your project can be presented to the Design Commission for their review. Design Commission requests project be presented in their Conceptual/Schematic Design phase. This application primarily addresses inhabited buildings and structures and their effect on the public realm; please refer to Appendix A for infrastructure type projects. The Commission's review of projects is based on the planning/design principles in the Urban Design Guidelines for Austin. All affected departments and private utility franchise holders have reviewed this request and recommend approval subject to the following conditions: AT&T (SWBT) – Only applies to F#10285-2006 • Approved contingent on the stipulation all AT&T facilities have been removed from said aerial ROW. ATD Electric • Approved contingent upon 1. A public access easement will be provided for an additional 3 feet of width on each side of the alley - 6 feet in total. 2. The aerial vacation will be 20 feet in height at the building face and will transition down to 18 feet at the lowest point. • Approved contingent upon retention of a public utility easement to cover aerial utility lines. Once the lines/poles are relocated/removed, the PUE can be vacated. Be advised that poles will not be removed until all utilities have been removed from them. If there are comms located on the poles in this area, applicant should begin conversations now with comm companies regarding relocations. Continue to work with Rudy Vela at Austin Energy regarding relocation of electric facilities. The East Tower – Downtown Austin Design Guidelines Density Bonus Application Area-Wide Guidelines Urban Design Guideline Achieved? AW.1 Create dense development YES Applicant's Comments The project is applying to exceed the density of 15:1 FAR permitted administratively through the density bonus program by 5.45:1 FAR through City Council approval. The total density requested is 21:1 FAR. The midblock project site is limited to 120' of street frontage on East Avenue, with a very limited 15,115 sf floor plate. The ground floor contains an active lobby space with access to both the primary entrance, facing east, as well as a second entrance to the ground-floor to the west where residents may access a bike storage and have a direct route to the Rainey Street District and future transit options. This project will not close any Downtown Streets. This project will be developed similarly in shape and size to other mid-rise and high-rise construction within the Rainey neighborhood. The western entry point will feature a large mural highlighting the entry access and public art gallery space that will be visible to pedestrians along Rainey Street. The Project does not obscure important public views and is not located in a Capitol View Corridor. The exterior design aesthetic for the Project will be contemporary minimalist and will not appear to be built earlier than it was. No historic properties are adjacent to the site. All equipment will be screened from views from the street. The two amenity decks on levels 12 and 41 incorporate large planting areas and pedestrian-scaled amenities that will enhance the view from adjacent properties. This project will not be a themed development. The only existing building on the site is in need of repair and will not be preserved or recycled. The proposed FAR for this project is 21:1, so an increase in FAR of 13:1 is being requested. The proposed building height is 450 feet with 41 floors. An above ground parking garage will be provided, with ten levels of parking and 350 spaces included. Six affordable housing units are proposed to fulfill Rainey Street Subdistrict requirements with the additional Community Benefit requirements being proposed as a fee-in-lieu to the Affordable Housing Trust. Per the Density Bonus Program ordinance, the applicant is required, at a minimum, to meet the three gatekeeper requirements: 1. Substantially comply with the City’s Urban Design Guidelines 2. Provide streetscape improvements that meet the Great Streets Program Standards. 3. Commit to a minimum of 2-Star rating under Austin Energy’s Green Building Program. Austin Parks and Recreation Department Centralized Programs Division FACT SHEET: Local Standards of Care Ordinance 1) The Austin Parks and Recreation Department (PARD) is exempt from Child Care Licensure by the State of Texas under Human Resources Code Chapter 42. Regulation of Certain Facilities, Homes, and Agencies that Provide Child-Care Services. Subchapter C. Regulation of Certain Families, Homes and Agencies. 2) The exemption is specific to an elementary-age (ages 5-13) recreation program operated by a municipality provided the governing body of municipality annually adopts standards of care by ordinance after a public hearing for such programs, that such standards are provided to the parents of each program participant, and that the ordinances shall include, at a minimum, staffing ratios, minimum staff qualifications, minimum facility, health, and safety standards, and mechanisms for monitoring and enforcing the adopted local standards; and further provided that parents be informed that the program is not licensed by the state and the program may not be advertised as a child-care facility. 3) Recreational Programs affected by this ordinance include but are not limited to After School Programs, Summer Day Camp Programs, Spring Break Camps, Holiday Break Camps, and Conference Day Camps. 4) PARD notifies parents that the programs listed above are not licensed by the state and are not child-care facilities by the following: a. Parks and Recreation Department Website (Parent Handbook) b. Parent Handbook – Hard Copy, Electronic 5) The ordinance is made available in print upon request and posted in the following locations: a. Recreational Facilities hosting youth programs b. ORDINANCE NO. 20200220-055 AN ORDINANCE ADOPTING LOCAL STANDARDS OF CARE FOR THE PARKS AND RECREATION DEPARTMENT'S YOUTH RECREATIONAL PROGRAMS. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: PART 1. AUTHORITY. The Council adopts these local standards of care for the Parks and Recreation Department's youth recreational programs pursuant to Texas Human Resources Code Section 42.041(b)(14) (Required License and Accreditation) and its home rule authority. PART 2. DEFINITIONS. In this ordinance: (1) ACTIVITY LEADER means a person responsible for the direct care or supervision of participants. The term excludes a person whose primary duties include administration, clerical support, food preparation, or facility maintenance. (2) DEPARTMENT means the Parks and Recreation Department. (3) DIRECTOR means the director ofthe Parks and Recreation Department. (4) DESIGNEE means a person appointed by the director to act on the director' s behal f. (5) FACILITY means a building or improvement operated or used by the department in conducting a recreational program. (6) PARTICIPANT means a child aged five to 13 years old who is enrolled in a recreational program and is under the supervision of department staff. Page 1 of 8 (7) RECREATIONAL PROGRAM or PROGRAM means a fee-based children's program or activity offered and supervised by the department that requires a participant to enroll or register to participate. (8) VOLUNTEER means a person assisting without remuneration in the care or supervision of participants. PART 3. PROGRAM ADMINISTRATION. (A) The department shall operate recreational programs in compliance with appropriate State law, this ordinance, and the department's rules adopted by this ordinance. (B) The director, or designee, shall administer the programs. PART 4. PROGRAM RULES; MONITORING. (A) The director shall adopt rules relating to the operation of the programs. A rule adopted under this ordinance may be more restrictive than the minimum standards adopted by this ordinance. (B) The director shall monitor the programs to ensure compliance with the standards adopted by this ordinance and the rules. PART 5. REQUIRED SUPERVISION FOR NON-AQUATIC RECREATIONAL PROGRAMS.
