Public comment will be allowed via telephone; no in-person input will be allowed. All speakers must register in advance (April 20, 2021 by noon). All public comment will occur at the beginning of the meeting. To speak remotely at the April 21, 2021 Environmental Commission Regular Meeting, members of the public must: •Call or email the board liaison Kaela Champlin, (512) 974-3443, Kaela.Champlin@austintexas.gov, no later than noon, (the day before the meeting). Committee Chair Responsibilities Ensure compliance with City Code  Ensure compliance with Texas Open Meetings Act  Coordinate with staff liaison to post agendas 72 hours in advance  A quorum must be present to conduct committee meetings o A quorum of the committee is at least three committee members. o No more than five commission members may attend a meeting.  The EC Bylaws include all established committees and their duties. These duties must be approved by the Council Audit and Finance Committee.  The Committee Chair is responsible for completing and presenting annual reports to the full Commission and filing the report with the Office of Chief Clerk and the Watershed Protection Department on or before January 31st each year. o It is the full responsibility of the Committee Chair to complete this report. The report must include the following: (1) a statement of the board’s mission and a description of the board’s actions in furtherance of that mission during the previous calendar year; and (2) the board’s goals and objectives for the new calendar year.  After a meeting has been held, it is the responsibility of the committee chair to provide a report on the issues the committee is working on during the Environmental Commission Committee Reports each meeting. Meeting requirements  Per City Code, committees must meet on a regularly scheduled basis at least quarterly.  It is the responsibility of the Committee Chair to request these meetings to be scheduled. In order to provide adequate scheduling time and posting requirements, please comply with the following deadlines:  o 3 weeks in advance, contact the liaison to schedule the meeting & notify liaison o At least 10 days before the meeting, review and approve the final agenda with of draft agenda items. the staff liaison. Watershed Protection Department staff have completed the review for FM 620 and Anderson Mill Road Wastewater SER #4652 and do not recommend approval of the request. Site Overview The site consists of a tract of approximately 34.40 acres, located at 11213 FM 620 Road. The site consists of 4 parcels; the northern three parcels consisting of 9.4 acres are located in the City of Austin’s full purpose jurisdiction and the Birden tract, a 25-acre parcel, is located in the City’s 2- Mile ETJ and is adjacent to Council District 6. The site is in the Bull Creek Watershed, Water Supply Suburban, and the Drinking Water Protection Zone, and the Northern Edwards Aquifer Recharge Zone. Service Extension Requests have been made on this site previously and were not recommended by Watershed Protection Department Staff. In 2016, a wastewater service extension request (SER #3880) was made for Broadstone 620/Birden Multi-family, a proposed multifamily development with 336 units on the southern 25-acre portion of the site. The SER was considered by the Environmental Commission on November 16, 2016, and the commission recommended against approval. Subsequently, the Water and Wastewater Commission did not make a recommendation on the SER and the applicant withdrew the service extension request. THEREFORE, the Environmental Commission recommends denial of the proposed wastewater service extension request. CODY HARRIS • H.B. 3813 will preempt the City of Austin’s current amplified sound ordinance. • The bill as currently written will allow amplified sound up to 85 decibels (the equivalent of a large motorcycle) until 2 a.m., citywide. • The bill is authored by Representative Cody Harris, a lawmaker from Palestine, TX. • This bill impacts Austin, and only Austin. No other city in Texas would be required to lobby the legislature to redress grievances related to their local sound ordinance. 2 WHAT IS OUR CURRENT ORDINANCE? Citywide • Amplified Sound is allowed: •Sunday – Wednesday until 10:30 p.m. •Thursday until 11 p.m. •Friday/Saturday – 12 a.m. •A permit is may be sought for the districts below, or if the establishment falls within 600’ of a property zoned and used for residential use. Sixth Street and Warehouse District • Amplified Sound is Allowed •Everyday until 2 a.m. Red River District • Amplified Sound is Allowed: •Thursday until 12 a.m. •Friday/Saturday until 1 a.m. •Must follow Citywide Ordinance Sunday – Wednesday. 3 TIMELINE OF EVENTS • 2003 – Austin’s baseline ordinance was revised, and the permit requirement was created. • 2003 – Sixth Street District and Warehouse District created – allowing amplified sound until 2 a.m. in those designated areas. • 2011 – Limits established for outdoor sound permits for bars within 600’ of property zoned and used as residential. They were restricted past 10 p.m. on amplified sound. • 2012 – Limits loosened on outdoor sound permits for bars within 600’ of property zoned and used as residential; allowing more time for amplified sound. MEMORANDUM TO: Members of the Planning Commission FROM: Jerry Rusthoven, Assistant Director/Interim Lead Planning and Zoning Department DATE: May 22, 2020 SUBJECT: UNO Sign Regulations The Planning and Zoning Department is requesting the Commission initiate an amendment to the UNO ordinance to correct an inadvertent change made to the sign regulations in the ordinance. In November 2019 the City Council approved changes to the UNO ordinance. One of those changes was intended to address signs above the second story of a building. Those signs were required to be cut in or engraved into the structure of the building. If the name of a building were placed on the facade this made it physically difficult to change the name in the future. It was agreed by the stakeholders to remove this requirement. In making this change to the ordinance a mistake was made and the result is all illuminated signs were prohibited in the UNO area. This is not what was intended or agreed to by the stakeholders. Also, because the UNO sign regulations are also used in TODs and the North Burnet/Gateway Plan this mistake carries over to other areas. Staff is asking for the opportunity to correct the ordinance. The Limited Time Offer includes a $600 rebate for qualifying Rebate projects and 0% financing for qualifying Rebate & Loan projects. • Created an educational sheet covering the Velocity Credit Union loans that will be uploaded to the Home Performance website and provided to our contractors to help educate customers. • Revised and improved our remote contractor orientation slides and process and successfully oriented three new contractors into the program. AMOUNT AND SOURCE OF FUNDING Funding is available in the Fiscal Year 2020-2021 approved Operating Budget of Austin Water. Purchasing Language: N/A Prior Council Action: Boards and Commission Action: MBE/WBE: November 29, 2018 – City Council approved the Water Forward Plan on a 10-0 vote. December 11, 2019 – City Council voted to approve the Land Development Code Revision directing Austin Water to establish a regulatory program and an incentive program for onsite Water Reuse Systems on first reading on a 7-4 vote. February 13, 2020 – City Council voted to approve the Land Development Code Revision directing Austin Water to establish a regulatory program and an incentive program for Onsite Water Reuse Systems on second reading on a 7-4 vote. December 10, 2020 – City Council voted to approve an ordinance establishing City Code Chapter 15-13 relating to treatment, monitoring, and reporting regulations for Onsite Water Reuse Systems on a 10-0 vote. April 7, 2021 – Approved by the Water and Wastewater Commission on a 9-0 vote April 20, 2021 - To be reviewed by Resource Management Commission N/A A recommendation in the 2018 Water Forward Plan (Plan) approved by city council included the development and adoption of an ordinance requiring the use of alternative onsite water for large, new commercial and multi-family development. The Plan included making this mandatory in Fiscal Year 2023 after development of regulatory guidance for such systems had been adopted and tested through a voluntary incentive program. The regulatory guidance was adopted by city council on December 10, 2020 and became effective December 21, 2020. Approval of the ordinance making mandatory the installation of these systems beginning on December 1, 2023 is pending final council approval of the previously proposed revisions to the City’s Land Development Code.
