Vice Chair Barrera-Ramirez called the meeting to order at 6:15 pm. Elect a chair and vice-chair of the Codes and Ordinances Joint A motion was made to elect Commissioner Barrera-Ramirez as Chair and Commissioner Hempel as Vice-Chair, by Commissioner Azhar, seconded by Commissioner Shaw. Vote: 6-0. (Commissioner Connolly absent). 3. POTENTIAL CODE AMENDMENTS: Proposed for Discussion and/or Initiation Potential amendments to the code are offered for discussion and/or possible recommendation for initiation. REGULAR AGENDA: Previously Initiated Previously initiated amendments to the code are offered for discussion and possible recommendation to the full Planning Commission. a. Urban Trail Code Amendments. Discuss and consider amendments to City Code Title 25 related to cut and fill requirements and critical water quality zone development regulations as applied to Urban Trails. City Staff: Katie Wettick, Public Works Department (512) 974-3529, katie.wettick@austintexas.gov (Discussion and/or possible action). Katie Wettick gave an overview of proposed amendments related to urban trails, that will modify cut and fill requirements and allow wider trails within critical water quality zones. A motion was made to recommend the item by Commissioner Azhar, seconded by Commissioner Hempel. Vote: 6-0 (Commissioner Connolly absent). 5. OTHER BUSINESS a. Update on Potential Upcoming and Current Code Amendments – City Staff: Greg Dutton, Planning and Zoning Department, 974-3509, Greg.Dutton@austintexas.gov; (Discussion and/or Possible Action). MEMORANDUM TO: Members of the Planning Commission FROM: Jerry Rusthoven, Assistant Director/Interim Lead Planning and Zoning Department DATE: May 22, 2020 SUBJECT: UNO Sign Regulations The Planning and Zoning Department is requesting the Commission initiate an amendment to the UNO ordinance to correct an inadvertent change made to the sign regulations in the ordinance. In November 2019 the City Council approved changes to the UNO ordinance. One of those changes was intended to address signs above the second story of a building. Those signs were required to be cut in or engraved into the structure of the building. If the name of a building were placed on the facade this made it physically difficult to change the name in the future. It was agreed by the stakeholders to remove this requirement. In making this change to the ordinance a mistake was made and the result is all illuminated signs were prohibited in the UNO area. This is not what was intended or agreed to by the stakeholders. Also, because the UNO sign regulations are also used in TODs and the North Burnet/Gateway Plan this mistake carries over to other areas. Staff is asking for the opportunity to correct the ordinance. AN ORDINANCE AMENDING CITY CODE CHAPTER 25- 6 (TRANSPORTATION) ADDING A NEW ARTICLE 9 ESTABLISHING A STREET IMPACT FEE PROGRAM BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: PART 1. City Code Chapter 25-6 (Transportation) is amended to add a new Article 9 establishing a street impact fee program and to read as follows ARTICLE 9. STREET IMPACT FEES Division 1. - General Provisions. § 25-6-657 - APPLICABILITY. § 25-6-658 – DEFINITION. (A) In this Article: This Article applies to development within the corporate boundaries of the City. (1) ASSESSMENT means the amount of the maximum street impact fee per service unit imposed on new development. (2) CAPITAL IMPROVEMENT means a roadway facility with a life expectancy of at least three years, to be owned and operated by or on behalf of the City including a newly constructed roadway facility or the expansion of an existing roadway facility necessary to new development. (3) DEVELOPMENT UNIT is a measure of each land use used to determine number of service units. The development unit is identified in the Land-Use, Vehicle-Mile Equivalency Table. (4) (5) FINAL PLAT APPROVAL means when the plat has been released by the City for filing with the County. This term applies to both original plats and replats. IMPACT FEE, also known as “Street Impact Fee”, means a fee, charge, or assessment for roadway facilities imposed on new development by the City to recoup all or part of the costs of capital improvements or facility expansion necessitated by and attributable to such new development. (6) LAND USE ASSUMPTIONS mean a description of the service areas and the projections of population and employment growth and associated changes in land uses, densities and intensities adopted by the City.
