Commission Members in Attendance: Chair Andrea Freiburger; Vice Chair Pablo Avila; Commissioners: John Green, Timothy Stostad, James Briceno, Sade Ogunbode, Elizabeth Mueller, Wordy Thompson, Edgar Farrera, Natalya Sheddan and Ex Officio Commissioner Chief Thomas Vocke. Date: January 28, 2021 Staff in Attendance: Melanie Alley, Code Review Analyst/BSC Coordinator; Robert Moore, Division Manager; Marlayna Wright, Supervisor; James Candelas, Program Specialist; Farah Presley, Inspector; Willis Adams, Code Inspector; Alicia Tovar, Acting Supervisor; Brandon Carr, Assistant City Attorney CALL TO ORDER Chair Freiburger called the Commission Meeting to order at 6:35 p.m. CITIZEN COMMUNICATION Aime Polivka of the 305 Flats tenant association and Gabby Garcia of BASTA appeared before the Commission to speak about conditions at 305 Flats, located at 305 W. 35th Street. Ms. Garcia read a written statement from tenant Sam Kirsch about the conditions at 305 Flats and provided her own testimony regarding the conditions at the property and the Repeat Offender Program. APPROVAL OF MINUTES Commissioner Green moved to approve the minutes from the December 9, 2020 regular meeting, seconded by Commissioner Mueller. The December meeting minutes were approved on an 8-0-1 vote, with Commissioner Farrera abstaining. PUBLIC HEARINGS Continued Case(s) Pending Commission Action: 2. CL 2020-017823 This case was continued from the December 9, 2020 meeting. The property was represented at the hearing by Henry Gilmore, attorney for the current owner, i.e., DRK 2411 Longview Austin LLC, and Kwan Sun, Manager of current owner group, as well as Jacob Frumkin, previous owner. Vice Chair Avila admitted Exhibits 7 and 8A-8E. 2411 Longview Street Hosebark, LLLP 1 Vice Chair Avila moved to close the public hearing. The recommended order was for repair within 45 days, with a penalty of $2,000 per week to begin to accrue on the 91st day if not in compliance. Commissioner Mueller made an alternative motion for demolition within 90 days, and on the 91st day, if compliance has not been met, to authorize the code official to proceed with demolition, and file a lien for all expenses incurred. The motion was seconded by Commissioner Green. The motion passed on an 8-0-1 vote. Commissioner Green was off dais and Chair Freiburger recused herself. Returning Case(s): Stanley G. …

CL 2020--155974 An appeal of the notice of violation regarding this property was heard by the Commission. The appellant did not appear at the hearing. Suspension and Revocation Suspension - § 4-14-50 The code official may suspend rental registration for a rental property if the code official determines: (1) the property is declared substandard or dangerous by the Building and Standards Commission, the code official, or a court of competent jurisdiction; (2) the registrant fails to timely comply with a notice of violation; (3) the registrant fails to comply with a requirement of this Chapter; (4) the registrant fails to comply with other City permitting requirements; or (5) the registrant fails to pay its annual registration fee. Revocation - § 4-14-51 The code official may immediately revoke a registration that has been suspended pursuant to Section 4-14-50 (Suspension) if the code official determines that the registrant is: (1) a condition that is dangerous or impairs habitability exists at the rental property during the suspension period; and (2) the registrant fails to take remedial action to correct the condition. Even if the registration has not been suspended, the code official may immediately revoke a registration issued under this chapter if an order to vacate the rental property is issued by the Building and Standards Commission or a court of competent jurisdiction. The meeting was available for viewing at http://www.austintexas.gov/page/watch-atxn- live. Commission Members in Attendance: Chair Andrea Freiburger, Vice Chair Pablo Avila; Commissioners: Jessica Mangrum, Natalya Sheddan, Timothy Stostad, James Briceno, Wordy Thompson, Elizabeth Mueller, Sade Ogunbode, Edgar Farrera, and John Green* (Commissioner Green joined the meeting already in progress). Thomas Vocke, Fire Division Chief was absent. Staff in Attendance: Melanie Alley, Code Review Analyst/BSC Coordinator; Robert Moore, Division Manager; Marlayna Wright, Investigator; James Candelas, Program Specialist; Farah Presley, Inspector; Matthew Noriega, Interim Division Manager; Michael Dial, Field Supervisor; Khary Dumas, Inspector; and Brandon Carr, Assistant City Attorney. CALL TO ORDER Chair Freiburger called the Commission Meeting to order at 6:59 p.m. APPROVAL OF MINUTES Vice Chair Avila moved to approve the minutes from the July 22, 2020 regular meeting, seconded by Commissioner Wordy Thompson. Commissioner Mueller abstained from voting. The August meeting minutes were approved on a 9- 0-1 vote. Commissioner Green was off dais. Commissioner Green made a motion to adopt staff’s recommendation, but modify to extend timeframe to 90 days, seconded by Commissioner Thompson. The motion was withdrawn. Commissioner Green motioned to continue the case to the October meeting and require the owner to attend this meeting with permits, show progress on repairs, and provide cost estimates for the remaining repairs, seconded by Commissioner Briceno. The motion failed 5-6. Chair Freiburger and Vice Chair Avila, Commissioners Mangrum, Sheddan, Ogunbode 1 and Mueller opposed the motion. Commissioner Mangrum then made a motion to adopt the proposed findings of fact and conclusions of law and adopt Staff’s recommended order for repair within 60 days from the date the order is mailed, with penalties of $1,000 per week to begin to accrue on the 61st day if not in compliance, seconded by Commissioner Thompson. Annual Internal Review This report covers the time period of 7/1/2019 to 6/30/2020 BUILDING AND STANDARDS COMMISSION The Board/Commission mission statement is: The Building and Standards Commission (BSC) was established to hear cases concerning alleged violations of the City’s housing and dangerous building regulations. The Building and Standards Commission shall have the powers and duties and comply with the procedures established by the Texas Local Government Code, Chapter 54, Subchapter C (Quasi-Judicial Enforcement of Health and Safety Ordinances), and Chapter 25-12, Article 9 (Property Maintenance Code) of the Austin City Code. 1. Describe the board’s actions supporting their mission during the previous calendar year. Address all elements of the board’s mission statement as provided in the relevant sections of the City Code. • The Commission met on 8 occasions to hear cases involving substandard and unsafe or dangerous properties, and appeals. • The Commission heard a total of 56 new cases. • The Commission heard a total of 11 returning cases. • Of the new and returning cases heard by the Commission, 41 or 61% were registered with the Repeat Offender Program, of which 28 have now achieved compliance. • Of the new and returning cases heard by the Commission, 14 were deemed dangerous by the Code Official or the Fire Division Chief. • The Commission received updates on 19 cases. • The Commission met as a body on 8 out of 11 monthly meeting dates during this period, with one meeting cancelled due to a posting error and two meetings cancelled due to COVID-19 concerns. The Commission also held its annual retreat in November. Annual Review and Work Plan Year 2019-20 Page # 2 2.
