STAFF DRAFT PRE-LAW DEPT REVIEW ORDINANCE NO. 20170608-056 AN ORDINANCE REPEALING ARTICLE 8 OF THE CITY CODE; AMENDING CHAPTER 2-1 RELATING TO THE MECHANICAL, PLUMBING, AND SOLAR BOARD AND ELECTRIC BOARD; AN ORDINANCE REPEALING AND REPLACING ARTICLE 5 OF CITY CODE CHAPTER 25-12 TO ADOPT THE 2021 UNIFORM MECHANICAL CODE AND LOCAL AMENDMENTS; AND CREATING OFFENSES. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: PART 1. City Code Chapter 25-12 is amended to repeal Article 8 (Solar Energy Code). PART 2. City Code Section 2-1-161 (Mechanical, Plumbing, and Solar Board) is repealed and replaced with a new Section 2-1-161 to read as follows: § 2-1-161 MECHANICAL AND PLUMBING BOARD. A. The Mechanical and Plumbing Board should include members who are qualified by experience and training to consider matters pertaining to the installation and design of mechanical and plumbing systems, including the following individuals: a. licensed air conditioning contractor; b. licensed master plumber; c. representative of a natural gas utility; d. professional engineer; or e. citizen of the City. B. A City employee may not be a member of the board. C. The board shall hear and decide appeals of orders, decisions, or determinations made by the building official relating to the application and interpretation of Chapter 25-12, Article 5 (Mechanical Code) and Article 6 (Plumbing Code). D. The board may not waive a requirement of the Mechanical Code or the Plumbing Code. E. The board shall render all decisions and findings in writing to the appellant. F. The building official shall retain a copy of each written decision and findings. G. An interested party aggrieved by the board's decision may appeal the decision to the city council consistent with the appeal procedures set forth in Chapter 25-1 (General Requirements and Procedures). H. In addition to the information required to file an appeal under Chapter 25-1 (General Requirements and Procedures), a notice of appeal filed under this subsection must include a statement containing facts which show that the decision that forms the basis of the appeal was incorrect because it was inconsistent with a City ordinance or state law or because a finding of fact by the board was clearly contrary to the evidence before the board. ISO rating Amendment 1 104.1.1 Special Inspections Program for Timed Inspections Commercial Mechanical Change-Out Program. For buildings not covered under the Residential Code, the building official may establish, by rule, an inspection program for commercial mechanical components identified in this section for buildings not covered under the Residential Code or a Special Inspections Program change-out program authorized in other technical or building codes. The buildings must be located within the zoning jurisdiction of the City, outside of the zoning jurisdiction under agreement with a municipal utility district, or where the City provides electrical service. The program applies to replacing roof top equipment; refrigeration equipment; and heating, ventilation, and air conditioning (HVAC) equipment. Note: Renamed to remove confusion with the special inspection process in the IBC, and made a clarification about buildings not covered under the IRC. Amendment 2 CHAPTER 2: DEFINITIONS 202.1.1 Supplemental Definitions. The definitions in this subsection apply throughout this code and amend or supplement the definitions in Chapter 2 Section 202 (General Definitions) of in the 2021 Uniform Mechanical Code, as published: Alternate Water Source. Non-potable source of water that includes but is not limited to recycled manufacturing process water, air conditioner condensate, rainwater, storm water, gray water, black water, cooling tower blow down, and foundation drain water. Bleed-off (Blowdown). Means The circulating water in a cooling tower which is discharged to help keep the dissolved solids in the water below a maximum allowable concentration limit. Blow-Down Meter. Means A meter that tracks the amount of water discharged from a cooling tower system. Concentration. Means Re-circulated water in a cooling tower that has elevated levels of total dissolved solids as compared to the original make up water. Conductivity Controller. Means A device used to measure the conductivity of total dissolved solids in the water of a cooling system to and control the discharge of water in order to maintain efficiency. Cooling Tower. 2021 International Property Maintenance Code (IPMC) Amendment Process Presented to Fire and Building Board Presented by 2021 IPMC Committee February 24, 2021 Purpose of Presentation To provide an overview of the 2021 International Property Maintenance Code (IPMC) Amendment process. Background • The City of Austin will be adopting the ICC International Code Council’s 2021 IPMC updates from the current 2015 IPMC. • ACD established the 2021 IPMC Amendment Committee, consisting of three groups: – Group 1 (Review of IPMC Chapters 1 and 2) – Group 2 (Review of IPMC Chapters 3 and 4) – Group 3 (Review of IPMC Chapters 5, 6 and 13) • October 2020: Collaboration began with other City Departments for proposed amendments. What’s Next • • • • The committee will meet with Fire and Building Board to review draft of proposed amendments. A series of two or three Stakeholder meetings. Consult with CEO. ACD staff will present a draft of recommended changes to the BSC – Building and Standards Commission to obtain feedback and/or approval. Building Criteria Manual & Plumbing Systems Testing Requirements Meeting Purpose For discussion and action on changes in how we test PVC drain, waste and vent systems. Proposed Changes Removing all air and vacuum testing allowances with the following exceptions: 1. In multi-story structures and occupied buildings where water damage could result from water testing leakages, an air test can be utilized. The air test must be conducted in accordance with all sections of A.S.T.M. designation F1417-11a. If the system is to be tested with air, a Class 1A diaphragm test gauge that is calibrated to an accuracy of ± 1 percent of the span must be utilized. See test gauge requirements in the plumbing code. 2. Other materials approved by pipe manufacturers for air testing 3. Non-human medical gas and vacuum systems 4. Vacuum manhole testing Reason For Proposed Changes 1. Potential life safety and property damage hazards associated with air expansion 2. Systems consistently over pressurized 3. The proposed ordinances would amend Chapter 6-4 Water Conservation by imposing administrative penalties of up to $500 for failure to submit required cooling tower registration and annual inspection reports to ensure towers are meeting all water efficiency standards and equipment requirements. Assessment of administrative penalties for this program would be consistent with the current assessment of penalties under the Commercial Irrigation System Evaluation and Commercial Car Wash Certification programs. The proposed ordinances would also amend the inspection report to include whether the tower is meeting additional water efficiency standards for drift eliminators and the addition of biocides to cooling tower recirculating water to prevent algae growth, thereby increasing water efficiency as well as protecting public health by preventing airborne bacteria. These measures are consistent with 1126.1 and E 403.5.2, respectively, of the 2015 Uniform Mechanical Code, International Association of Plumbing and Mechanical Officials (IAMPO), and Standard 189.1, International Green Construction Code, of the American Society of Heating, Refrigeration and Air Conditioning Engineers (ASHRAE). 2021 UMC Update: 1. Our directive was to eliminate as much amendments as possible and go back to publish code. This required that we separate the process into two different phases. 2. Change being proposed that may be of concern. The first phase consisted of making comparisons with the 2015 UMC published code and the 2015 UMC amendments. This phase has been completed with better than 50% of the language going back to publish code. The second phase is making comparison with the 2015 UMC amendments and the 2021 UMC, the second phase of the UMC ordinance is into its second meeting with all departments involved. The cloth dryer section being deleted from the UPC and using section 504 from the IMC. For plan review and inspections this issue is a common problem and staff is attempting to work on a new approach to better help all involved. The biggest concern is with domestic cloth dryers although the entire section is being adopted to help with eliminating confusion. The 2015 amendments already had 3 section from the IMC and table 504.4.2.1.1. Section 504 basically covers four areas. a) General requirements for cloth dryers b) Domestic cloth dryers c) Commercial cloth dryers d) Common exhaust for cloth dryers We are working on bring the 2021 UMC to the stakeholders sometime in February, soon after to the Board. The adoption of the 2021 Uniform Mechanical Code is on schedule to be adopted sometime in November 2021 although the plan is to adopt all the codes at one time which could delay the 21 UMC code adoption. I will gladly discuss the overview of the adoption although as a professional courtesy the details of individual sections will be left to Charlie Ablanedo.
