The area being requested for vacation will be used for Mixed use high-rise with ground floor pedestrian oriented uses (retail) outdoor seating and multi-family housing. Buildings to span over the alley above 18'. All affected departments and private utility franchise holders have reviewed this request and recommend approval subject to the following conditions: AT&T (SWBT) – Only applies to F#10285-2006 • Approved contingent on the stipulation all AT&T facilities have been removed from said aerial ROW. ATD Electric • Approved contingent upon 1. A public access easement will be provided for an additional 3 feet of width on each side of the alley - 6 feet in total. 2. The aerial vacation will be 20 feet in height at the building face and will transition down to 18 feet at the lowest point. • Approved contingent upon retention of a public utility easement to cover aerial utility lines. Once the lines/poles are relocated/removed, the PUE can be vacated. Be advised that poles will not be removed until all utilities have been removed from them. If there are comms located on the poles in this area, applicant should begin conversations now with comm companies regarding relocations. Continue to work with Rudy Vela at Austin Energy regarding relocation of electric facilities. Google Fiber – Only applies to F#10285-2006 • Approved contingent upon any relocations and with the understanding that an alternate underground pathway will be provided for the relocation of our existing aerial fiber optics cables. The East Tower – Downtown Austin Design Guidelines Density Bonus Application Area-Wide Guidelines Urban Design Guideline Achieved? AW.1 Create dense development YES Applicant's Comments The project is applying to exceed the density of 15:1 FAR permitted administratively through the density bonus program by 5.45:1 FAR through City Council approval. The total density requested is 21:1 FAR. The midblock project site is limited to 120' of street frontage on East Avenue, with a very limited 15,115 sf floor plate. The ground floor contains an active lobby space with access to both the primary entrance, facing east, as well as a second entrance to the ground-floor to the west where residents may access a bike storage and have a direct route to the Rainey Street District and future transit options. This project will not close any Downtown Streets. This project will be developed similarly in shape and size to other mid-rise and high-rise construction within the Rainey neighborhood. The western entry point will feature a large mural highlighting the entry access and public art gallery space that will be visible to pedestrians along Rainey Street. The Project does not obscure important public views and is not located in a Capitol View Corridor. The exterior design aesthetic for the Project will be contemporary minimalist and will not appear to be built earlier than it was. No historic properties are adjacent to the site. All equipment will be screened from views from the street. The two amenity decks on levels 12 and 41 incorporate large planting areas and pedestrian-scaled amenities that will enhance the view from adjacent properties. This project will not be a themed development. The only existing building on the site is in need of repair and will not be preserved or recycled. Existing zoning is CBD and is in the Rainey Street Subdistrict. It is not within the Capitol View Corridor. The lot area is 17,642 square feet and the total proposed project area is 272,939 square feet with Residential Apartment use providing 284 units. The base FAR allow is 8:1. The proposed FAR for this project is 21:1, so an increase in FAR of 13:1 is being requested. Additionally, this is more than the 15:1 FAR allowed by the Downtown Density Bonus Program and therefore additional Community Benefits should be provided. The proposed building height is 450 feet with 41 floors. An above ground parking garage will be provided, with ten levels of parking and 350 spaces included. Six affordable housing units are proposed to fulfill Rainey Street Subdistrict requirements with the additional Community Benefit requirements being proposed as a fee-in-lieu to the Affordable Housing Trust. Per the Density Bonus Program ordinance, the applicant is required, at a minimum, to meet the three gatekeeper requirements: 1. Substantially comply with the City’s Urban Design Guidelines 2. Provide streetscape improvements that meet the Great Streets Program Standards. 3. Commit to a minimum of 2-Star rating under Austin Energy’s Green Building Program. DOWNTOWN DENSITY BONUS PROGRAM (DDBP) SUBMITTAL APPLICATION INSTRUCTIONS A property owner (Owner) or his/her representative (Applicant) acting on behalf of the Owner can initiate an administrative request to the Director of Planning (Director) seeking additional Floor-to-Area (FAR) entitlements as outlined in the Downtown Density Bonus Program as approved by Ordinance No. 20140227-054. In order for the Director to conduct an administrative review, the requirements listed below must be submitted. Once an application is deemed complete, the Director will inform the Applicant of review commencement. The following submittals are required in a complete PDF package of no more than 10 Mb in size with sheets no larger than 11x17 inches: 1. Completed DDBP Application; 2. Vicinity plan locating the project in its context, and showing a minimum 9 block area around the project; 3. Location and nature of nearby transit facilities; 4. Drawings (submitted drawings should demonstrate compliance with Subchapter E Design Standards, as applicable): o Site plan; o Floor plans; o Exterior elevations (all sides); o Three-dimensional views; 5. As part of the gatekeeper requirements, o Urban Design Guidelines checklist; o Great Streets - ; o 2 Star Austin Energy Green Building rating - submit copy of the projects signed Austin Energy Green Building Letter of Intent and Austin Energy Green Building checklist.; 6. River Street Market & Homes – Downtown Austin Design Guidelines Density Bonus Application Area-Wide Guidelines Urban Design Guideline Achieved? AW.1 Create dense development YES Applicant's Comments This project will deliver a 522,017 square foot residential tower in Downtown Austin with a proposed FAR of up to 23:1. The development will contain 376,901 net square feet of residential space, equaling 392 dwelling units, 7,206 square feet for a ground floor market and 6,034 square feet of restaurant space on the second level. No streets will be permanently closed with this project; however, development will be designed such that the project will not have an impact if the City elects to turn Rainey Street into a festival street. The existing alley will be vacated, but will continue to function as an alley with the building constructed above. This project is located at the center of the Rainey neighborhood and will not have an impact on neighborhood edges. Public art is proposed on the northwest corner of the building, on the façade facing Rainey Street. This is envisioned to enliven the street and help celebrate the culture of the Rainey Street District. The project is not located in a Capitol View Corridor and has been designed as a point tower and to be stepped back from the street to minimize impacts. This project is not designed to replicate any historical styles. The project is situated to respect the historic nature of the Rainey District by utilizing native plantings to serve as green walls throughout the exterior of the building, including the north elevation adjacent to historic bungalows, with textural masonry, concrete, and metal with vegetation to soften the appearance of this modern tower. All mechanical equipment on the rooftop will be screened and incorporated into the project. Additionally, an elevated pool deck on the western portion of the 12th level of the tower will be designed as an outdoor amenity space, with ample native plantings and vegetation. This will not be a themed development. COMMISSION RECOMMENDATION Joint Sustainability Committee Recommendation 20200826-2A Supporting the Austin Climate Equity Plan WHEREAS, the City Council passed Resolution No. 20150604-048 adopting the Austin Community Climate Plan and creating the Joint Sustainability Committee; and WHEREAS, the Austin Community Climate Plan includes a schedule for reporting and updates, with a full plan revision in 2020; and WHEREAS, the harmful effects of climate change, including floods, droughts, heat waves and wildfires, are worsening in the Austin area and around the world; and WHEREAS, the “Global Warming of 1.5 °C” issued in 2018 by the UN Intergovernmental Panel on Climate Change illustrates that keeping the average global temperature increase to 1.5 degrees Celsius will help to avoid severe effects of climate change, including ecosystems collapsing, that will very likely occur if warming reaches 2 degrees Celsius; and WHEREAS, low-income communities and communities of color in Austin and around the world are the most impacted by extreme weather and pollution despite having contributed least to the drivers of climate change and pollution; and WHEREAS, harmful land use and the refusal to create or enforce real environmental regulations continue to disproportionately expose communities of color to environmental harms, leading to unjust quality of life outcomes both historically and today; and WHEREAS, low-income communities and communities of color must be prioritized to receive the disproportionate benefits of the transition to a pollution-free society to remedy disproportionate harm done historically and presently; and WHEREAS, if we design and implement programs to serve low-income communities and communities of color, we will positively impact all residents in the Austin area; and WHEREAS, the Paris Agreement within the United Nations Framework Convention on Climate Change set a goal of “keeping a global temperature rise this century well below 2 degrees Celsius above pre-industrial levels and to pursue efforts to limit the temperature increase even further to 1.5 degrees Celsius”; and WHEREAS, current international, federal, state and local commitments to greenhouse gas reduction fall short of what is needed to keep average global warming to either 1.5 or 2 degrees Celsius and the UN Intergovernmental Panel on Climate Change’s “Emissions Gap Report 2019” illustrates the significant magnitude in the gap between international commitments and needed emissions reductions; and WHEREAS, the City of Austin is a member of C40 Cities, a network of global cities committed to addressing climate change; and WHEREAS, C40 Cities has developed guidance for cities on setting greenhouse …
