Construction has completed or begun on all phases of development except for what is indicated in blue on Exhibit B – Built and Unbuilt Exhibit. Future phases to be constructed include parking, one driveway, an education building, a chapel expansion, a plaza and related features (sidewalks, landscaping, etc.) All other utilities, driveways, drainage and water quality features have been constructed. PROJECT BACKGROUND: This site plan was originally approved on April 16, 2002, and included a 10-year project life for the master planned project, until April 16, 2012. In December 2012, City Council approved a Managed Growth Agreement that extended the site plan expiration date from April 16, 2012 until December 6, 2027 (City File # SPC-01-0456C(XT2).MGA). Please see Exhibits D – Applicant’s Summary Letter and E – Managed Growth Agreement Ordinance. SUMMARY STAFF RECOMMENDATION: Staff recommends approval to extend this site plan permit by ten years, from December 6, 2027, to December 6, 2037, based on the case meeting criteria from LDC Section 25-5-62(C)(1)(a). 25-5-63(C) Extension of released site plan by the Land Use Commission: “the Land Use Commission may extend the expiration date of a released site plan beyond the date established by this chapter if the Land Use Commission determines that the request complies with the requirements for extension by the director under 25-5-62 (Extension of Released Site Plan by Director).” 25-5-62(C) The director may extend the expiration date of a released administrative site plan one time for a period of one year if the director determines that there is good cause for the requested extension; and: 05 SPC-01-0456C(XT3) - St. Michael's Episcopal Church - Extension III; District 101 of 16 (1) the director determines that: a) the site plan substantially complies with the requirements that apply to a new application for site plan approval; b) the applicant filed the original application for site plan approval with the good faith expectation that the site plan would be constructed; c) the applicant constructed at least one structure shown on the original site plan that is suitable for permanent occupancy; or d) the applicant has constructed a significant portion of the infrastructure required for development of the original site plan; SUMMARY OF SITE PLAN: LAND USE: The site is zoned PUD (Davenport West PUD, Ordinance # 010719-28). Dear Mr. Mars: The project is titled St. Michael’s Episcopal Church – Extension III and consists of an approximately 11.325-acre piece of property located west of Loop 360, north of Pascal Lane. This project is located within the City of Austin’s Limited Purpose Jurisdiction and is currently zoned Planned Unit Development (PUD). As representatives of The Protestant Episcopal Church Council of the Diocese of Texas, a Texas non-profit corporation, dba St. Michael’s Episcopal Church (the “Church”), the owner of the Property, we have submitted a Site Plan Extension request to a Consolidated Site Plan Application, requesting a ten (10) year extension to the approved Site Plan, as allowed under City of Austin Code Section 25-5-63. The Site Plan SPC-01-0456C was originally approved on April 16, 2002, for this master planned project and included a ten- year prolonged expiration until April 16, 2012. Pursuant to Ordinance No. 20121206-039, approved on December 6, 2012, City Council authorized the negotiation and execution of a Managed Growth Agreement (Doc. No. 2013049966), which extended the Site Plan expiration date from April 16, 2012 until December 6, 2027, permit Case No. SPC-01-0456C(XT2).MGA. The Church is a Section 501(c)(3) non-profit organization in the midst of an ongoing, long-term master planned project, which consists of a four-phase religious assembly campus, including a sanctuary, day school, parish hall, education and administrative building, chapel, courtyard, playground, surface parking, and detention and water quality EXHIBIT D05 SPC-01-0456C(XT3) - St. Michael's Episcopal Church - Extension III; District 107 of 16 June 2, 2026 Page 2 pond for the purpose of providing outreach programs and spiritual and educational development for the benefit of the Austin community. The phasing of the project has been vital to ensure the Church’s fiscally responsible growth. Currently, the constructed improvements onsite consist of the main sanctuary, parish hall, children’s education building (which hosts the day school), playground, detention and water quality pond, utilities, parking, and access drive to Loop 360. The Church is preparing a capital campaign to raise funds for the next phase of development. The next phase of development is anticipated to include creation of the plaza, slab for the chapel expansion, education building, and expansion of the parking area. The education building will include administrative offices for Church staff, space for Sunday school classrooms, Bible study areas, and dedicated spaces for both the Girl Scouts of Central Texas and the Boy Scouts of America. The development of the next phase will constitute completion of approximately 70% of the overall master planned project. Following the completion of the next phase, the Church will immediately begin campaigning to financially support the remaining phases. This is not a truly phased site plan; however it is being built out in many stages. The ponds associated with full buildout of the project have been constructed and this infrastructure is being maintained in accordance with the approved plans. The criteria for an Extension for a Site Plan is satisfied in the following manner outlined below: § 25-5-62, C, 1 Determination that there is good cause. There is good cause for the requested extension. St. Michael’s is a non-profit entity in need of raising funds in order to pay for the remaining site improvements, while continuing existing commitments to essential community programs and activities. § 25-5-62, C, 1 (a) Determination that (a) the Site Plan substantially complies with the requirements that apply to a new application for site plan approval. Confirmed: The Site Plan substantially complies with the requirements of a new application, thereby complying with Subsection (a). § 25-5-62, C, 1 (b) Determination that…(b) the applicant filed the original application that faith expectation the good for site plan approval with the site plan would be constructed. The purpose of the request for a 10-year extension is to allow additional time to raise funds to allow the Church to conduct a campaign for capital, while continuing existing commitments to meet financial obligations and maintain essential community programs and activities. MICHAEL'S EPISCOPAL CHURCH SITE PLAN. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: PART 1. The Council finds that the St. Michael's Episcopal Church Site Plan described in SPC-01-0456C(XT2).MGA is a large, long-term project under Section 25-1-540 (Managed Growth Agreements). PART 2. The Council authorizes the City Manager to negotiate and execute a Managed Growth Agreement ("MGA") between the City of Austin and The Protestant Episcopal Church Council of the Diocese of Texas, St. Michael's Episcopal Church, in substantially the same form as the agreement attached and incorporated into this ordinance as Exhibit A. The MGA is limited to the St. Michael's Episcopal Church Site Plan as approved in SPC-01-0456C(XT2).MGA, subject to any minor revisions approved in accordance with the MGA. The Church and. the City may be referred to jointly as Parties or singly as Party in this Agreement. is made and entered the City, a home into by RECITALS 1. 2. On October 29, 2001, The Church filed an application for a consolidated site plan for the construction of a religious assembly campus on the property described in Exhibit A, which is attached hereto and incorporated herein ("the Property"). On April 16, 2002, the Planning Commission approved Site Plan No. SPC-01- 0456C, authorizing the construction of a 4 phased religious assembly campus, which includes a sanctuary, children's education building, parish hall, education and administration building, chapel, courtyard, playground, surface parking, a detention and water quality pond and infrastructure on 11.32 acres, ("the Project"). The approval by the Planning Commission included a 10 year extended permit life. including detention and water quality pond and Portions of the Project, infrastructure have been completed. 3. The Church requests an extended amount of time to conduct a capital campaign realizing the process for the campaign takes extensive planning and implementation, and could take 27 years to complete the financing and construction for the remaining buildings and improvements. for and in consideration of the mutual covenants, and NOW, THEREFORE, conditions contained in this Agreement, and other good and valuable consideration, the City and The Church agree as follows: A R T I C LE I PURPOSE & LEGAL AUTHORITY Section 1.01 Purpose. Section 25-1-540 of the City Code authorizes the execution of managed growth agreements for planning and developing large projects, long term projects, or any project having special benefits that are in the public interest. The Project is a long term project situated on 11.32 acres. Section 1.03 Expiration Date Section 25-1-540 provides that a managed growth agreement may specify the time period during which a project may comply with the regulations in effect when the first application for the project is filed and establish an expiration date for each application necessary to complete the project. By Resolution No. , the City Council directed that the expiration date is to be December 6. 2027. A R T I C LE II TERMS Section 2.01 Original Regulations; Expiration Date Subject to Section 2.03 below, The Church may construct the Project to comply with City regulations in effect on October 29, 2001, per Ordinance No. 890202-B, and Ordinance No. 010719-28 which allows development under the Davenport West PUD ("Original Regulations"). The expiration date of Site Plan No. SPC-01- 0456C(XT2).MGA for purposes of Chapter 25-5 of the City Code and the expiration date of the Project for purposes of Article 12 of Chapter 25-1 of the City Code shall be December 6, 2027. Section 2.02 Revisions to the Site Plan; Change in Ownership Minor revisions to the Project shall be permitted in accordance with the City Code and City regulations. However, The Church may not construct any improvements on the Property that the City Manager determines to vary substantially from the Project as defined by Site Plan No. SPC-01-0456C(XT2).MGA without forfeiting the rights granted under this Agreement to develop the Project under Original Regulations. This Agreement does not abridge the rights of The Church or its successors. 05 SPC-01-0456C(XT3) - St. Michael's Episcopal Church - Extension III; District 1012 of 16 Section 2.03 Exceptions from Right to Develop Under Original Regulations In this section, The Church agrees to comply with City regulations adopted after October 29, 2001, as they pertain to: a) erosion and sedimentation controls; b) uniform building, fire, electrical, plumbing, or mechanical codes adopted by recognized national code organizations or local amendments to those codes enacted to address imminent threats of destruction of property or injury to persons; c) regulations to prevent the imminent destruction of property or injury to persons that do not affect landscaping, tree preservation, open space, or park dedication, lot size or dimensions, lot coverage, building size, residential or commercial density, or timing of the project, or that change development permitted by a restrictive covenant required by the City; and A R T I C LE I II MISCELLANEOUS PROVISIONS Section 3.01 Notice. It is contemplated that the Parties will contact each other concerning the subject matter of this Agreement. However, any formal notice or communication required to be given by one Party to another by this Agreement ("Notice") shall be given at the addresses below for the Parties. Notice may be given by: (1) delivering the Notice to the Party to be notified; (2) by depositing the Notice in the United States Mail, certified or registered, return receipt requested, postage prepaid, addressed to the Party to be notified; or (3) by sending the Notice by telefax with confirming copy sent by mail to the Party to be notified. Notice deposited in the United States mail in the manner hereinabove described shall be deemed effective after the earlier of the date of actual receipt or three days after the date of the deposit. Section 3.02 Severability. The provisions of this Agreement are not severable. If any word, phrase, clause, sentence, paragraph, section, or other part of this Agreement, or the application of the word, phrase, clause, sentence, paragraph, section, or other part of this Agreement to any person or circumstance is held by a court of competent jurisdiction to be invalid or unconstitutional for any reason, the Parties agree and understand that the omission of the word, phrase, clause, sentence, paragraph, section, or other part of this Agreement would frustrate the purpose of this Agreement, and, therefore, in that event, this Agreement shall terminate. Section 3.03 Waiver. Any failure by a Party to the Agreement to insist on strict performance by the other Party of any provision of this Agreement shall not be deemed a waiver of the provision or of any other provision of the Agreement. A Party has the right at any time to insist on strict performance of any of the provisions of this Agreement. 05 SPC-01-0456C(XT3) - St. Michael's Episcopal Church - Extension III; District 1014 of 16 Section 3.04 Applicable Law and Venue. The construction and validity of this Agreement shall be governed by the laws of the State of Texas (without regard to conflict of laws principles). Venue shall be in Travis County, Texas. Section 3.05 Incorporation of Exhibits. All Exhibits attached to or referred to in this Agreement are incorporated into this Agreement by reference for the purposes set forth in this Agreement. Section 3.06 Assignability, Successors, and Assigns. This Agreement is not assignable by The Church or the City without the prior written consent of the City Council or The Church. The Agreement shall be binding on and inure to the benefit of the Parties and their respective representatives, successors, and assigns. Section 3.07 Amendment. This Agreement may only be amended in writing on the approval of the City Council and The Church. A R T I C LE IV DEFAULT AND REMEDIES FOR DEFAULT Section 4.01 Default. On the occurrence, or alleged occurrence, of an event of default, the non-defaulting Party shall send the defaulting Party notice of its default or alleged default. Except as otherwise specifically provided in this Agreement, the defaulting Party must cure its default within 30 days following the notice of the receipt of the default, or, must begin to cure the default within 14 days following receipt of the notice of default and diligently pursue the cure to completion within 50 days of receipt of the notice of default. If the defaulting Party fails to abide by these deadlines, the non- defaulting Party shall have all rights and remedies available in law and equity and all rights and remedies provided in this Agreement.
