The subdivision proposed for Lot 1D to not front a dedicated public street and for Lot 1D to have access for municipal services or maintenance through a Joint Use Access Easement. Lot 1D is dedicated as Parkland to connect to a parkland area to the north of this property for future Parkland uses. Refer to Exhibit C for the location of Lot 1D and connection to the neighboring parkland area. The request is for the approval of a variance to 25-4-171(A) to allow the Lot 1D in the subdivision to not front a public street. We are proposing Lot 1D of our development as a 0.9-acre lot to be dedicated as Parkland Easement without frontage. See the Driveway & Utility Plan, Sheet 6 of the Project Assessment set. Lot 1D being dedicated as parkland will share a lot line with previously dedicated parkland from the Fort Branch Creek Subdivision (C8- 2023-0022.0B). Typical access to this parkland will come from E Martin Luther King Jr Blvd. See Parkland Dedication, Sheet 11 of the Project Assessment set. Additionally, we are proposing a Joint Use Access Easement over a paved road to extend across Lot 1C with a paved road to access Lot 1D whenever necessary. After a pre-development meeting, City of Austin Parks Reviewers approve of the size and location of the lot without a flagpole access as it meets their desires and needs for parkland. Box 1088 Austin, TX 78767-1088 Reference: Davis Lawns Section 1 Resubdivision 5004 Heflin Ln Austin, TX 78721 Dear Mr Cesar Zavala, City of Austin PARD has requested 0.09 acres of land for Parkland Dedication for a trail along Fort Branch Creek. To fulfill this requirement, we have created a 0.09-acre lot (Lot 4) in the rear of the site adjacent to a City of Austin Parkland easement previously dedicated as part of the adjacent Fort Branch Creek Subdivision (C8-2023-0022.0B). We are seeking a variance to LDC 25-4-171, Lot 4 does not have street access. PARD planning department approves of this lot as is shares a lot line with an already established City of Austin dedicated parkland easement. Their vision of a trail following Fort Branch Creek can be accomplished without a flag accessing Heflin Ln. See attached plans for details on our resubdivision at Davis Lawns Section 1 Resubdivision and Parkland Exhibit. Meeting the requirements of LDC 25-4-171 presents a hardship for us to comply with. The existing lot is approximately 80-ft wide. The proposed resubdivision contains 2 flag lots (Lot 2 and Lot 3) each with a 15-ft flat accessing Heflin Ln. Lot 1 in the current configuration is at the minimum lot width of 50-ft. Adding an addition flag would reduce Lot 1 to less than minimum width thus not a legal lot to develop on. A joint use access easement is proposed on the flag portions of Lot 2 and Lot 3, continuing across Lot 3 enabling access to Lot 4. Thank you for your consideration.
