There will be no increase in impervious cover for post-development conditions. The existing Walnut Creek outfall will be modified by adding foundation or wingwall thickness for stability and energy dissipators to minimize the flooding of downstream properties. The applicant is requesting a variance from LDC 25-8-281 to allow construction within a Seep/Spring Complex Critical Environmental Feature buffer for the drainage outfall. The variance was approved with the following conditions by the Environmental Commission on May 15, 2024: 1. Repair erosion throughout area. 2. Place Grow Zone Signs at 100 ft intervals, 30 ft from curb. 3. Expand native planting and seeding throughout the Grow Zone and the curb (no plantings outside of the Grow Zone; sod area for stabilization can remain.) 4. Ensure that placement of topsoil, temp irrigation and weed management are included with the restoration. 5. Remove remaining driveway aprons and replace with curb and gutter. SUMMARY STAFF RECOMMENDATION: Staff recommends approval of these requests with the Environmental Commission conditions. Background Information Situated in the Walnut Creek Watershed, a portion of the site falls within FEMA and City of Austin fully developed 100-year floodplain near the intersection of January Dr and February Dr. Previous single-family lots (11601 to 11605 February Dr) were demolished due to flooding are now within City of Austin publicly-owned land. There are approximately 14 heritage trees inside the 2.72-acre limits of construction (LOC). The largest heritage tree, 34.5” live oak, is located behind February Dr at the intersection with January Dr (refer to Attachment A On-site Pre- development Consultation at 11605 February Dr on March 18, 2022 and Attachment B Dead Diseased Imminent Hazard Report). The pre-developed impervious cover within the LOC is 1.29 acres. Preliminary site investigations with Watershed Protection Department (WPD) identified Critical Environmental Features (CEFs), including a seep horizon and Canyon rimrocks, located within 50 feet from an existing outfall at Walnut Creek (see January Dr Rimrock/Seep Horizon and Limits of Construction Map in the end of this Report Attachment –Section 01010 Summary of Work as part of the bidding and construction documents). Proposed Stormwater Improvements The project proposes to install approximately 1,700 linear feet storm lines (ranging from 18” to 48” RCP) to replace approximately 2,000 linear feet of aging storm lines within residential drainage easements (see an exhibit January Dr Existing Storm Drain Pipe/SSMH to be Abandoned in the end of this report). There will be no increase in impervious cover for post- development conditions with this utility construction project via trench method. The existing Walnut Creek outfall will be modified by adding foundation or wingwall thickness for stability and energy dissipators to minimize environmental effects to the downstream of Walnut Creek properties. WPD Project Design and Delivery provided hydrologic and hydraulic studies for the entire contributing drainage basins from an upstream detention pond to the downstream existing outfall at Walnut Creek (see attached 20230728_January_model to ESD.zip). 5789.122 January Dr Flood Risk Reduction Page 2 Balancing Cut and Fill within Floodplain In response to early community input, a wildflower meadow is proposed for the demolished single-family houses behind February Drive. Minor grading will be required for topsoil management and landscaping elements to enhance erosion hazard protection. The net cut or fill quantity will be maintained at zero, aligning with the floodplain reviewer’s request to prevent negative impacts on the floodplain. In summer 2023, curbing on February Dr driveway was restored by an IDIQ contract, which redirected stormwater to existing curb inlets rather than sheet flow from February Dr to Walnut Creek. Environmental Variance and Drainage/Utility Criteria Manual Waivers As commented by WPD hydrogeologist, finding of facts listed in LDC 25-8-41(A) for Land Use Commission variance must be submitted to allow construction within the 50’ CEF setback (see Attachment F for a draft Variance Application Form). WPD granted an Environmental Resources Inventory (ERI) waiver request (ECM 1.3.2) on September 2, 2022 (see Attachment G for January Dr ERI Waiver Approval), and a stormwater vertical clearance waiver approval (DCM 5.7.1.G) for storm lateral “F” on August 9, 2023 (see Attachment H email date 08/16/2023). Austin Water has agreed to sign or stamp an equivalent vertical clearance waiver request (UCM 2.9.1.B.3) once the plans are approved in AB+C portal (see Attachment H email dated 01/30/2024). Furthermore, the existing paved area to be disturbed will be restored and paved in accordance with City of Ausitn paving standards. The project is located in the vicinity of January Drive (from August Drive to February Drive). Other work includes but is not limited to: Walnut Creek streambank erosion protection, existing outfall modifications, abandonment in place of approximately 2,000 LF existing storm pipes with controlled low strength material (CLSM), removal of 60 LF of Asbestos Cement existing water pipe segments, soil management and grading, wildflower meadow and landscaping, etc. In addition, the existing paved area to be disturbed within the limits of construction will be repaved in accordance with City of Austin paving standards. The Work of this Contract includes sustainability requirements as shown in the Division 1 Section 01352 and/or 01505 and all other applicable specification sections. It is the intent of the Owner to work with the Contractor to implement sustainable construction practices to the greatest extent possible. 1.21 Scope of Work A. This section describes the Project in general and provides an overview of the extent of the Work to be performed by the CONTRACTOR. Detailed requirements and extent of Work is stated in the applicable Specification Sections and shown on the Drawings. CONTRACTOR shall, except as otherwise specifically stated herein or in any applicable part of these Contract Documents, provide and pay for all lablor, materials, equipment, tools, construction equipment, and other facilities and services necessary for proper execution, testing, and completion of the Work. B. Any part or item of the Work which is reasonably implied or normally required to make the installation satisfactorily operable shall be perfomed by the CONTRACTOR and the expense thereof shall be included in the applicable unit prices or lump sum prices bid for the Work. It is the intent of these Specifications to provide the OWNER with the complete system. All miscellaneous appurtenances and other items of Work that are incidental to meeting the prices or lump sum prices bid for the Work even though these appurtenances and items may not be specifically called for in the Bid Documents. Rev. Date 08/28/2020 Summary of Work / 01010 Page 1 of 5 Division 1 General Requirements 1.22 Location of Project A. Street Locations: 11502-11614 January Drive 1.23 Contractor's Responsibilities A. Execute all Work, including excavation, installing pipe, backfill, miscellaneous concrete and testing. The Work of this Contract is specified in the City of Austin Standard Specifications, Special Provisions and Special Specifications listed in the Table of Contents. B. Secure all construction-related permits, other than those provided by OWNER as described in paragraph 6.6 of Section 00810, Supplemental General Conditions, and pay for the same. C. Arrange for the necessary temporary water and electric service and pay for these services and all water and electricity consumed during the construction Work. D. Provide adequate temporary sanitary facilities. 1.24 Easements and Rights-Of-Way CONTRACTOR shall confine his construction operations within the limits indicated on the Drawings, and shall use due care in placing construction tools, equipment, excavated materials, and pipeline materials and supplies so as to cause the least possible damage to property and interference with traffic. If the CONTRACTOR requires additional easement for his operations, the CONTRACTOR is solely responsible for acquisition and maintenance of the easement. No additional compensation will be provided by the OWNER. A. Easements - Easements across private property are indicated on the Drawings. CONTRACTOR shall set stakes to mark the boundaries of construction easement across private property. The stakes shall be protected and maintained until completion of construction and cleanup. B. Rights-of-Way - Permits for Work in rights-of-way shall be obtained by the CONTRACTOR. All Work performed and all operations of CONTRACTOR, his employees, or subcontractors, within the limits of railroad and highway rights-of-way, shall be in conformity with the requirements and be under the control (through OWNER) of the railroad or highway authority owning, or having jurisdiction over and control of, the right-of-way in each case. 1.25 Operation of Existing Facilities Existing water and wastewater facilities shall be kept in continuous operation throughout the construction period. No interruption will be permitted which adversely affects the degree of service provided. Provided permission is obtained from OWNER in advance, portions of the existing facilities may be taken out of service for short periods corresponding with periods of minimum service demands. CONTRACTOR shall provide temporary facilities and make temporary modifications as necessary to keep the existing facilities in operation during the construction period. 1.26 Connections to Existing Facilities Unless otherwise specified or indicated, CONTRACTOR shall make all necessary connections to existing facilities including structures, drain lines, and utilities. In each case, CONTRACTOR Rev. CONTRACTOR shall protect facilities against deleterious substances and damage. Connections to existing facilities which are in service shall be thoroughly planned in advance, and all required equipment, materials and labor shall be on hand at the time of undertaking the connection. Work shall proceed continuously (around the clock) if necessary to complete connections in the minimum time. Operation of valves or other appurtenances on existing utilities, when required, shall be by or under the direct supervision of the owning utility. 1.27 Unfavorable Construction Conditions No portion of the Work shall be constructed under conditions which adversely affect the quality or efficiency thereof, unless special means or precautions are taken by CONTRACTOR to perform the Work in a proper and satisfactory manner. 1.3 SUBMITTALS Provide shop drawings and other information as required by Section 01300 for coordination of the work. 1.4 CONTRACTOR'S USE OF CONSTRUCTION SITE The construction site will be in use by public throughout the duration of contract. The CONTRACTOR shall refer to Section 01040, Project Coordination for coordination required to minimize disturbance and hazards to pedestrian as well as automobile traffic. CONTRACTOR shall not unreasonably encumber the construction site with materials or equipment. CONTRACTOR shall assume reasonable responsibility for protection of construction site. 1.5 CONSTRUCTION SEQUENCING* 1. The sequence and progress of work shall minimize the length of time any excavation is left open. Construction shall take place in accordance with the traffic control phasing plan. All work within a phase must be completed prior to beginning work in another phase. Trenches left open overnight shall be properly secured with Jersey Barrier, chain link fencing, and other means necessary. Construction work time is limited to 8:00AM to 5:00PM weekdays, using daily lane closures. 2. 3. 4. 5. Any work indicated in the contract drawings or contract document without a bid item shall be completed by the contractor as incidental to the contract. Contractor shall notify the Planning and Development Review Department at 974- 6330 and -2922 at least twenty-four (24) hours prior to the installation of any drainage facility within a drainage easement or street right-of-way. Contractor is to comply with City of Austin Parks and Recreation Department's policy regarding the prevention of the spread of oak wilt. Pursuant to 15-12-131 of the Austin City Code, the contractor may not block, direct, impede, or reroute pedestrian and/or vehicular traffic, nor place a barricade or other traffic control device in a right-of-way, without first obtaining a "Temporary Use Right- of-Way Permit" from R.O.W. The contractor shall submit a detailed schedule of construction which complies with the following sequence: 6.1. Install temporary erosion and sedimentation controls. tree protection measures, and C.I.P. signs immediately prior to construction. 6.2. Hold on-site pre-construction meeting with the environmental inspector and the construction inspector. 6.3. Begin construction of project as follows; A. Place traffic control devices (See traffic control sheets) B. Material (Pipe, fittings and bedding material, etc.) C. Excavation (Comply with OSHA and codes etc. ) D. Pipe laying and testing (Comply with specifications) E. Backfill (Comply with specifications)** 6.4. Commence restoration and re-vegetation of disturbed areas as early as feasible and necessary for timely completion of the project. Re-vegetation of disturbed areas constitutes the " permanent erosion and sedimentation controls" for this project. 6.5. Remove all temporary erosion and sedimentation controls upon completion of all construction items and permanent erosion and sedimentation controls. 6.6. Dress up and restore any disturbed areas to pre construction existing condition or better. Remove traffic control. 7. 8. Notes: After construction is complete and the site is completely stabilized, filter dikes and any remaining silt shall be removed. Silt shall be disposed of in the designated spoil disposal site. * The existing site contains critical environmental features including rimrock and seep horizon/spring as shown in the ATTACHMENT of this 01010 section. **After new pipe laying, testing and backfill at January Drive and tie-in at Walnut Creek outfall, contractor shall field verify existing storm drain pipes to be abandoned as shown in the ATTACHMENT including approximately 2,000 LF existing 24”-27” storm pipes (between SSMH# 2124098 and SSMH#150009) and three storm sewer manholes (SSMH#2124098, SSMH#2124104, and SSMH#1215395). All curb inlets at existing January Drive, February Drive, March Drive or April Drive shall remain active in place. Pay item SP402S-A (Controlled Low Strength Material for Utility Crossings and Abandonment of Existing Storm Pipes and Structures) is intended for abandonment of existing storm pipes with CLSM placed at existing storm system vertical depths other than CLSM used for utility crossings. *** Caping the existing infrastructure should occur once the system is in place so that interim flows will continue to have existing storm system to drain. This model demonstrates compliance with DCM 5.3.2 and 5.7.1. We will need to discuss 5.7.1 compliance for lateral F (see below). I could not find a design alternative that will meet DCM criteria for both utility crossings pictured below. Our options forward are as follows. a.) Obtain a waivers for vertical clearances, with potentially needing to encase the utilities per AW request. b.) Propose a vertical bend in the water utility (upstream crossing in the profile below) to relocate the water below the storm pipe, and shift the entire lateral move up to allow for clearance. Please keep in mind that for crossings at a depth greater than 6', a 2' vertical clearance below is required. Please let me know your soonest availability to meet to discuss.
