To: From: Zero Waste Advisory Commission Ken Snipes Director Austin Resource Recovery Date: June 12, 2020 Subject: Director’s Monthly Report to the Zero Waste Advisory Commission Landfill Criteria Matrix In March 2017, Council approved Resolution No. 20170323-055 to form a Waste Management Policy Working Group (“Working Group”) to examine waste management and biosolids policy issues, and contracts. The Working Group recommended the development of criteria in the form of a matrix to help identify Landfill Operators eligible for City contracts involving City-controlled waste. From March through May of 2018, ARR hosted five public meetings for stakeholders led by an independent facilitator, and an additional technical meeting focused on landfill gas emissions. In November 2018 the City Manager informed Council that Staff would proceed with issuing request for information (RFI) using a matrix developed by Staff and Stakeholders. Staff issued an RFI in January 2019, inviting submissions from landfill operators to evaluate their facilities for future inclusion in City solicitations. At the conclusion of this first application of the Matrix, staff determined that three (3) landfills were eligible to receive City-controlled waste. On February 20, 2020, staff brought Item no. 37, to Council to authorize a short-term contract for waste collection at City facilities. Because this item dealt with the collection of waste, staff applied the Matrix requirement to the recommended contract. When considering this item, Council clarified that the Matrix was not consistent with their policy direction, stating specifically that the Austin Community Landfill (ACL), one of the eligible landfills according to the Matrix, was not to be used. As a result, staff excluded any reference to the Matrix or the use of the Austin Community Landfill from the subsequent short-term contracts, as well as the eventual solicitation seeking a longer-term contract for waste collection at City facilities. Staff will not apply the Landfill Criteria Matrix to future contracts involving City-controlled waste without further direction from City Council. Recycle Reuse Drop Off Center Re-Opening As the Recycling and Reuse Drop Off Center (RRDOC) moves towards full operations, there are some concerns about employee and customer exposure to CoVid-19. In preparation for this, the RRDOC has started scheduling no contact home pickups and appointments for dropping off material. As customers call the facility to inquire about the re-opening date, we offer a “no contact” home pick up option if they have Household Hazardous Waste. NEW BUSINESS 2a. Master Plan Update Burns and McDonnell—Scott Pasternak begins the presentation with opening remarks. With these unprecedented times, as an Austin resident for going on more than 30 years now, thank you to all of the operators, for the City of Austin, within ARR as well as on the private sector. I appreciate your services. The presentation starts with an overview and a progress update. We started with extensive research, analysis, and recommendations, ultimately we will develop a master plan with goals and objectives. We’ve already developed an outline of the update for the master plan and later we will provide multiple drafts to the city. The first key finding communicates that of these 13 cities, Austin’s Diversion Rate only trails the west coast cities like Los Angeles, Portland, San Diego, and Seattle in terms of where they are with their Diversion rate. These cities have with higher rates have been doing this longer. These other cities also mandate and have enforcement efforts. One of the more interesting findings is that cities that consider multiple generator types have a generally higher diversion rate. Regardless of whether you’re at home, out at a restaurant, or at a business you have the zero waste opportunities for diversion. A number of these cities that have higher diversion rates we’ll require a recycling mandate and or enforcements and also material bands. One challenge for Austin is the lack of detail on commercial waste …

In late March, an audit of trash volume was performed in the CBD and found that a majority of the containers within the CBD were empty. By removing containers in the CBD, ARR would be able to reduce CBD customer volume charge which will help customers in that area save money during this crisis; ARR would pay less to the vendor, with a near break-even fiscal impact. ARR Fleet Purchases FY 20 Under the current Fleet Master Agreement, ARR is scheduled to purchase the following types of equipment for FY 20. Item approved Unanimous 2b. Discussion and Action-Collections in the Central Business District RCA Victoria Rieger, ARR, presented the item. We are seeking the favorable recommendation of a multi-term contract with Texas Disposal System Incorporated to provide trash and recycling and organics collection services for the Central Business District, as well as provide services for daily cleanup and maintenance of alleys in the service area for up to five years for a total contract amount not to exceed 8.3 million. Adam Gregory, TDS discussed the same request as the Residential Dumpster Contract back in February, for the Commission to recommend approval of the CBD Contract while recommending the Council reaffirm their rejection of the Landfill Criteria Matrix as you unanimously voted to do for the Residential Dumpster Contract. Previously staff requested to seek council approval of the LCM through the solicitation process. The CBD contract is the last remaining solicitation that incorporates the LCM. It’s …

Discussion and Action – Impact of Ordinance Change Pursuant to City of Austin Extraterritorial Boundary Revision Jon White, Travis County, talked about the recently amended Solid Waste Siting Ordinance. Mr. White explained that the recent amendment fixed some contradictions that had been in the original 2003 ordinance. Mr. White said that as the ordinance was being re-worked, Travis County and the City of Austin had agreed to release extraterritorial jurisdiction over lands around the Waste Management site. Mr. White said that although the [Waste Management site] were going to continue operations, future activities would not be permitted because it’s the longstanding position that the City and County both have a longstanding position for waste disposal activities at [the Waste Management] location to end. Chair Acuna asked how this affects us in meeting the needs and goals of our city master plan, expanding household hazardous waste opportunities and diversion. Mr. White said that it does allow for potential sites to be developed elsewhere in the county, but the ordinance is more adapted to add transfer stations than landfills. Commissioner Masino asked what the boundaries were of the siting ordinance. Mr. White said it was North of 290 (Blue Goose Road), and the limits were to west where railroad and creek are; within half a mile. Chair Acuna asked for clarification, if it would impede the city’s ability to identify a household hazardous …

Under this contract, most collection containers will be serviced on a weekly basis, with some sites utilizing roll-off containers, compactors, and balers that will be serviced as-needed. Additionally, the contract will provide services for the management and disposal of industrial Class 2 and non-hazardous special wastes for Austin Energy (AE), as well as for other departments as needed. AE manages several facilities and work sites that generate non-hazardous liquid and solid wastes, generally through routine maintenance activities. In order to comply with federal, state, and local regulations, AE requires the turn-key services of a waste disposal contractor to transport and dispose of the industrial Class 2 and non-hazardous special waste generated. The current contract for these services expires on February 28, 2020. A solicitation for a new citywide contract for these services is currently under way and this temporary contract will prevent a lapse of these services until this new contract is in place. The term “gently used” applies to “household goods” other than textiles, as the contract allows for donations of other materials as well. The description has been modified to read: The proposed program is an on‐ call collection program that accepts textiles and other household goods. For clarity, section 3.1 of the contract states: All marketing shall state that Textiles are acceptable in any condition (except wet or infested materials) for collection and shall encourage residents to use the program to recycle damaged, torn, or stained Textiles. Regarding the process for recycling textiles, once material is collected through the curbside collection program, it is sent to one of the retail thrift stores throughout Central Texas.
