City and ATP Commitments ▪ Outlines roles and responsibilities for design phase of Austin Light Rail ▪ Parties are responsible for applicable mitigations per NEPA ▪ City will provide support services during design and permitting ▪ Outlines permitting process, as developed with Austin Development Services ▪ All City infrastructure shall meet City standards ▪ ATP is responsible for coordinating with private utilities Use of Public Right-Of-Way ▪ Enables temporary use of right-of-way by ATP for Austin Light Rail for pre-construction activities. Funding Commitments ▪ ATP to City: Staffing, Fees, and Mitigations ▪ City to ATP: Betterments 7 City of Austin Betterments Previous Coordination: ▪ Early 2025 – City Departments submitted betterment requests to ATP for conceptual design and feasibility study. ▪ Summer and Fall 2025 – Departments reviewed designs and reports completed by ATP consultants as well as Rough Order of Magnitude (ROM) costs. ▪ Oct 2025 – Departments submitted final list of betterments to ATP to be included in next design phase. Ongoing / Future Coordination: ▪ Opportunities exist to add City betterments until 60% design and to remove City betterments during design / prior to construction. ▪ City commitments for construction funding. 8 Austin Water Betterments Betterments Terms: ▪ Design ILA covers betterment design costs only ▪ City to pay actual design costs.
