Discussion of the Office of the City Auditor’s audit and report of automated license plate reader program. Presentation by the Office of the City Auditor and Austin Police Department. Please provide list of the charges filed for the 228 arrests made based on ALPR hits. Charges have been filed for both misdemeanors and felonies. Please provide list of the cases prosecuted based on arrests/investigations using ALPR technology. APD doesn’t have a complete list of cases the Travis County District Attorney has prosecuted based on arrests/investigations because this is constantly changing. However, many of the crime types listed above have been prosecuted or are being evaluated for prosecution. Please remember ALPR is one building block in the establishment of probable cause and TCDA will make the unilateral decision to prosecute a case that may or may not have ALPR evidence. Based on public information requests made following each of the four audit periods of the pilot program, our analysis of data sets provided by the Travis County District Attorney's Office and the Travis County County Attorney's Office reveals a total of 28 prosecutions or plea agreements directly linked to ALPR-assisted arrests or investigations. Furthermore, there are currently 80 cases pending prosecution where ALPR technology played a role. It's important to note that these figures represent a snapshot based on data available at the close of each quarter and are best obtained through direct, ongoing communication with the County and District Attorney's offices after an arrest has been made. While these numbers provide a quantifiable measure, it's essential to understand that many factors outside the police department's control influence prosecution outcomes after an arrest, meaning these figures represent only one piece of the puzzle and have limited bearing on the overall success or utility of the ALPR program as an investigative tool. Additionally, these numbers only encompass direct-file cases and do not reflect the other follow- up investigations conducted by detectives where ALPR may have provided crucial initial leads or supporting evidence. Please list examples of data sharing and the justification for data sharing. During the trial period APD shared data as noted below. Please contact vendors involved in ALPR program and get a full explanation of what categories of data were/are being shared with FLOCK for their use and what APD data went into use for development of their internal products. The only data being shared with FLOCK is fully anonymized aggregated data. This data is a picture of a license plate and nothing else. The location, time, and date are removed. FLOCK used the data, to teach their systems the difference between letters and numbers to avoid issues in identifying number and letter charters. Portion 4.4 of the contract is the current verbiage inside the contract on this topic. 4.4 Aggregated Data. Agency acknowledges that Flock will be compiling anonymized and/or aggregated data based on Agency Data input into the Services (the “Aggregated Data”). Flock shall have the right to collect and analyze Aggregated Data as described in this paragraph. Aggregated Data does not refer to or identify Agency or any individuals, or it de- identifies Agency Data and other information relating to the provision. For the sake of clarity, Aggregated Data is compiled anonymous data which has been stripped of any personal identifying information. Aggregated Data has also been stripped of data reflecting the location and the date and time at which the Agency captured the data. Aggregated Data may include photographs of license plates without any accompanying meta-data that identifies, or could reasonably be used to identify, the agency which collected the photo, where the photo was captured, and when the photo was captured. Agency hereby grants Flock a non- exclusive, worldwide, perpetual, royalty-free right and license (during and after the Service Term hereof) to (i) use and distribute such Aggregated Data to improve and enhance the Services and for other development, diagnostic and corrective purposes, other Flock offerings, and crime prevention efforts. No rights or licenses are granted except as set forth herein. Flock shall not sell Agency Data or Aggregated Data. Notwithstanding any provision to the contrary, the Agency may request to opt out of Flock's use of its Aggregated Data by submitting written notice. Public Safety Commission - Questions & Answers 5. Commissioner Smith requested that she and her appointing Council Member (Qadri) be provided a response to the geographical distribution of the cameras and the demographic data of those detained and what checks and balances are in place to ensure they are distributed equitably. The APD has 40 fixed ALPR cameras. If you divide the city into four parts using IH35 as a dividing line for east and west, and the river as the north and south boundary the APD has the following cameras in each area: Northwest: 20 Northeast: 9 Southwest: 6 Southeast: 5 For the one-year trial period those stopped using ALPR were made up by the following races: 6. Commissioner Bernhardt requested the contract’s definition of aggregated data and to verify if personally identifying information has been removed from the model. See answer to #4 above. Commissioner Duran asked if the contract will be revised to address the audit and the concerns brought during the meeting.
