Follow-up 1 to URGENT CARLOS LEÓN June 1, 2021 Office of the Governor State Insurance Building 1100 San Jacinto Austin, Texas 78701 Dear Governor Abbott, This 4-page, June 1, 2021 follow-up 1 letter communicates how CAP METRO’s continuing NON-compliance with your Executive Order 36 (EO-36) is increasing their criminality against me and their hostility against you. Since your office received my May 26, 2021 urgent letter, 23 CAP METRO bus drivers have ILLEGALLY REFUSED me service for me legally NOT wearing a facial covering when boarding. In addition, CAP METRO Supervisor T-54 has ILLEGALLY stalked, targeted, and harassed me on public transportation for legally NOT wearing a facial covering on board a CAP METRO RAPID bus. Following CAP METRO policy and procedure, I documented each and every “failure to comply with” EO-36 violation by CAP METRO with CAP METRO (https://app.capmetro.org/ServiceOneWebCCR ) to communicate their continuing crimes to them and receive from them official Customer Comment Report (CCR) case IDs for my records to give to you to identify and fine each guilty bus driver up to $1000 to rightly punish and correct their criminal behavior. T – 54 unnecessarily arrived at Republic Square Station for the sole purpose of targeting me because I was silently and lawfully riding that 803-Southbound bus WITHOUT any facial covering. T-54 boarded, walked straight up to me, and pointed what appeared to be a camera at me to film me WITHOUT my consent. So I used a paper copy of EO-36 to block T-54’s “filming.” T-54 then repeatedly lied to me about having to wear a mask to ride a CAP METRO bus, saying CAP METRO is “federal” and following what the feds are saying, though CAP METRO is NOT federal and the CDC order to which he was referring does NOT apply to CAP METRO because it does NOT apply to intrastate travel (See my May 26, 2021 urgent letter to you for explication). Though I defeated T-54’s LIES by telling him the truth about CAP METRO’s legal status and authority and how EO-36 legally supersedes CAP METRO’s outdated, unnecessary mask mandate, T-54 kept telling me I had to wear a mask or get off the bus. Though I could have legally REFUSED to exit the bus, I didn’t because T-54 almost certainly would have called for one or more of CAP METRO’s own security officers (APD officers who work for CAP METRO) to back his ILLEGAL, UPSIDE-DOWN, ASS-BACKWARDS, ANTI-REALITY, like he did last time I rightly refused to exit (5/11/21 - CaseID : CCR-79851-F8B2Q2 and CaseID : CCR-79852- B1B2H4). Though T-54 allegedly wants APD to issue me a Criminal Trespass Notification (CTN) without just cause to ILLEGALLY ban me from CAP METRO, T-54 is the criminal who should be IMMEDIATELY and PERMANENTLY FIRED, not just for NOT complying with EO-36 (inviting a $1000 fine), but for intentionally trying to confuse and control me to effeminate and emasculate me to gaslight and dominate me to mistreat me like an abused bitch. Though T-54 would then wrongly direct APD to arrest me for any future “violation” of such an unwarranted CTN, public servant T-54 should be CRIMINALLY PROSECUTED for abusing his official capacity and committing official oppression, violating Texas Penal Codes 39.02 and 39.03. T- 54 is targeting me because he said NOTHING to a younger Adult White Male Passenger on that same bus also NOT wearing a facial covering, who T-54 walked by to go straight at me. Therefore, because T-54 rightly allowed that Adult White Male Passenger to continue riding the same bus WITHOUT a facial covering but wrongly did NOT allow me that same right under the law, T-54 blatantly and intentionally denied me equal protection under the law, violating the 14th Amendment of the Constitution for the United States of America. Because CAP METRO’s website (https://www.capmetro.org/COVID19) still says, “Per the latest federal orders, customers are required to wear face masks while on transit vehicles and when at our facilities, effective until September 2021…”, their ongoing public non-compliance with your EO-36 continues making CAP METRO a PUBLIC SAFETY THREAT to Texans, your executive power, and the rule of law. In fact, CAP METRO’s continuing REJECTION of the “general, great and essential principles of liberty,” which the Texas Bill of Rights recognizes and establishes, is attacking the Constitutional foundation of Texas. Because you, the head of the executive branch, took an oath of office to preserve, protect, and defend the Constitution and laws of the United States and of this State to the best of your ability, so help you God (Texas Constitution - Article 1, Sec. 16), make CAP METRO immediately comply with your EO-36 to defeat their mask tyranny and make them serve us maskless Passengers. Based on your May 31, 2021 tweet, “I will veto Article 10 of the budget passed by the legislature. Article 10 funds the legislative branch. No pay for those who abandon their responsibilities…”, you know how to deal with state-funded CAP METRO NOT complying with your EO-36.
