08 C14-2026-0016 - Wickersham Retail; District 31 of 23James Beasley, LEED AP 4505 Elana Ct Austin, TX 78741 10/11/2026 Nancy Estrada Case Manager, Case: C14-2026-0016 – Wickersham Retail City of Austin nancy.estrada@austintexas.gov Dear Ms. Estrada, I am writing to express my position regarding rezoning and permitting of the Wickersham Retail project at 4544 E. Oltorf St. to allow a Service Station. I live within .5 miles of the proposed project, and I believe the strongest arguments against permitting this use are environmental and quality of life. There are already seven gas stations in service within a one-mile radius of the proposed Wickersham Retail project location. Significant concerns with allowing a 24X7 Service Station at the intersection of Wickersham and Oltorf include: Increased vehicle tra(cid:431)ic and associated noise pollution Environmental pollution near Country Club Creek from surface run-o(cid:431) and underground fuel tank leaks Potential for increased loitering, panhandling and crime in a residential area I encourage the City to require thorough environmental and tra(cid:431)ic-impact due diligence studies and establish requisite elements for environmental permitting before allowing this type of use in this area. Austin promotes itself as a "Green City"; allowing more gas stations in residential areas moves us in the exact opposite direction. Please feel free to contact me directly with any questions or concerns. Kind regards, James Beasley 08 C14-2026-0016 - Wickersham Retail; District 32 of 23From: To: Cc: Subject: Date: Adam Adame Estrada, Nancy Condo Neighbor Jennifer Martinez STOP PLANS FOR GAS STATION; Agenda #8 Sunday, October 11, 2026 4:48:10 PM [You don't often get email from https://aka.ms/LearnAboutSenderIdentification ] . Learn why this is important at External Email - Exercise Caution Dear Nancy Estrada, My home is directly impacted by the construction taking place up hill just a few feet away. Agenda #8 - The Wickersham Retail Case. NAME: Adan and Martha Adame ADDRESS: 4500 E. Oltorf #120 Austin, Texas 77 I strongly oppose the construction and development of a gas station located directly up the hill, just a few feet away from my home. Living downhill clearly makes me subject to exposure from any leaks or environmental issues that take place with the operations of a laundromat and or gas station. Statistics prove there is an increase in crime and loitering that takes place at and around such facilities. I wish to maintain a safe environment for my family that I have had for the past 12 years. There is no need for a gas station in this location because there is one safely located walking distance away. Again, I am strongly against this development. Thank you for your compassionate understanding. Sincerely, Adan Adame CAUTION: This is an EXTERNAL email. Please use caution when clicking links or opening attachments. I have been a resident of East Riverside for over 15 years and a homeowner at the Chamonix Condominiums at 2450 Wickersham Lane for over three years. Ms, Estrada I am expressing my opposition to rezoning this parcel of land to a gas station or any similar establishment. Within a mile radius of the Chamonix Condominiums we currently have seven gas stations and other low priced convenience stores located in our neighborhood which are perfectly sufficient to serve the community. I have no specific opposition to this land, which has a magnificent northern view of the Austin skyline to be occupied by a cafe, bar, restaurant, retail or green space which would complement the redevelopment of the East Riverside corridor and would be a welcomed addition to the city's plans of reimagining the East Riverside corridor as a upscale and vibrant shopping and entertainment area for Austin. Such a hospitality establishment would receive regular patronage from the neighboring residents who are active in the community and would have an invested interest in seeing a bar, cafe or restaurant succeeding. Thank you for your attention and considering the requests of our community. Increased vehicle traffic, noise, artificial lighting, fumes, litter, and commercial activity can negatively affect the comfort and appeal of a residential community. For homeowners, our properties represent a significant financial investment. We should not have to face the potential loss of property value or a diminished quality of life as a result of a development that may not be necessary for the surrounding area. 4. Environmental Safety and Ecological Risks One of the most concerning aspects of this proposal is the potential environmental impact of placing a gas station uphill from neighboring properties. Stormwater runoff from a fuel station can carry petroleum residues, oil, gasoline-related contaminants, and other pollutants into surrounding areas if not adequately managed. Depending on the site's grading, drainage systems, and proximity to sensitive areas, these risks could affect neighboring properties and the local environment. Additional concerns include chronic litter, fuel spills, leaks from underground storage tanks, and the long-term environmental consequences of operating a fuel station so close to homes. These are not risks that should be dismissed without thorough investigation and enforceable safeguards. I also understand that this development proposal has been declined multiple times previously due to environmental concerns. If that history is accurate, I strongly urge the City and relevant reviewing authorities to examine those prior decisions and the environmental findings that informed them before considering any new approval. Previous concerns should be fully addressed rather than overlooked. Conclusion and Request for Action I respectfully urge the City of Austin, relevant planning and environmental authorities, and all parties involved in this development proposal to reject the construction of a gas station adjacent to Monaco Condominiums. The concerns outlined above are not simply matters of personal preference. They involve the safety of residents, the protection of our environment, the preservation of residential property values, and the long-term livability of our neighborhood. The existence of another gas station just 0.2 miles away further calls into question the necessity of introducing these additional risks into our immediate residential corridor. I ask that decision-makers prioritize the interests of existing residents and conduct a thorough review of the project's environmental, drainage, traffic, and public-safety implications before any development approval is granted. Our community deserves thoughtful development that respects the people who already live here. I strongly oppose this proposal and ask that our concerns be taken seriously and reflected in the final decision. 08 C14-2026-0016 - Wickersham Retail; District 312 of 2308 C14-2026-0016 - Wickersham Retail; District 313 of 2308 C14-2026-0016 - Wickersham Retail; District 314 of 2308 C14-2026-0016 - Wickersham Retail; District 315 of 2308 C14-2026-0016 - Wickersham Retail; District 316 of 2308 C14-2026-0016 - Wickersham Retail; District 317 of 23We respectfully request that the Commission evaluate the proposal under the applicable provisions of Austin’s Land Development Code and the relevant comprehensive planning policies, including the protection and compatibility of established residential neighborhoods. 2. Environmental Risks and Drainage Impacts The proposed site’s elevation relative to neighboring residential properties raises particularly important concerns. Gas stations present environmental risks associated with underground fuel storage, accidental spills, petroleum-contaminated runoff, and stormwater management. Where neighboring residential properties may lie downhill from a proposed fueling operation, these risks deserve heightened scrutiny. Before considering approval, the City should require appropriate technical documentation demonstrating that the proposed development will not create unacceptable risks to adjoining properties, including a review of drainage patterns, spill containment, stormwater controls, and compliance with applicable environmental regulations. The burden should be on the applicant to demonstrate that the proposed use can operate safely and compatibly at this particular location, rather than leaving neighboring property owners to bear the consequences of inadequate planning. We also request that the City review the history of any previous zoning applications or development proposals involving this site, including any earlier environmental or drainage objections. 3. Protection of Property Values and Reasonable Residential Expectations NSP SFH Holdings LLC owns two condominium units at Monaco, representing a meaningful investment in this established residential community. The introduction of an adjacent gas station could materially affect the desirability, marketability, and value of these properties. While commercial development is an important part of Austin’s economic growth, zoning decisions should carefully weigh potential private 08 C14-2026-0016 - Wickersham Retail; District 318 of 23commercial benefits against the adverse consequences imposed upon existing neighboring property owners. We do not believe that the potential commercial benefit of another gas station justifies exposing an established residential community to these avoidable impacts. 4. Traffic, Security, and Public Safety A gas station generates frequent vehicle movements, potentially including traffic during late-night hours, fuel delivery trucks, and vehicles entering and exiting the site throughout the day. These activities may create additional traffic conflicts and pedestrian safety concerns along an already developed residential corridor. We request a site-specific evaluation of traffic circulation, driveway access, pedestrian safety, nighttime lighting, and security considerations before any rezoning approval. These concerns should not be dismissed simply because the proposed use is commercially permitted elsewhere in the city. 5. Questionable Public Necessity and More Compatible Alternatives An existing gas station is reportedly located approximately 0.2 miles from the proposed development. Although commercial competition is not itself a reason to deny zoning, the availability of nearby fueling services is relevant when weighing the claimed public benefits of this particular proposal against its potential impacts. We are not opposed to reasonable commercial development at this location. A restaurant, neighborhood-serving retail, professional offices, or other appropriately designed commercial uses could contribute positively to the area while offering greater compatibility with the surrounding residential community. The issue is not whether the property should be developed, but whether a gas station is an appropriate land use immediately adjacent to existing residential homes. 08 C14-2026-0016 - Wickersham Retail; District 319 of 23We submit that it is not. 6. Clarification Regarding the Former HOA President’s Letter We understand that Mr. Alen Stepens, identified as a former president of Monaco Condominiums, submitted a letter supporting the proposed zoning change. We respectfully request that the Commission distinguish between an individual’s expression of support and an officially authorized position of the Monaco Condominium Owners Association. Unless the association’s governing body formally approved that position through the applicable procedures, Mr. Stepens’ letter should not be characterized or relied upon as representing the collective position of Monaco condominium owners. Regardless of his personal views or former position, NSP SFH Holdings LLC, as the owner of two condominium units, expressly opposes this zoning change. Our objection should be independently recognized and entered into the official record. 7. Formal Request for Denial For the reasons stated above, we respectfully request that the Austin Planning Commission: 1. Recommend denial of the proposed rezoning insofar as it would authorize or facilitate a gas station at this location. 2. Give substantial consideration to the impacts on existing neighboring residential properties, including environmental risks, drainage, traffic, safety, and land-use compatibility. 3. Review any prior zoning proceedings, environmental objections, or development applications involving the subject property. 4. Require adequate site-specific technical studies before considering any approval that would permit a fueling facility. 5. If approval is nevertheless contemplated, evaluate legally enforceable restrictions and conditions that would protect adjacent residential properties, including whether the proposed fuel-related use can be prohibited. 08 C14-2026-0016 - Wickersham Retail; District 320 of 236. Include this correspondence in the official zoning case record and make it available to Planning Commission members and City Council before their respective consideration of the matter. Conclusion Austin’s continued growth requires thoughtful development decisions that balance economic opportunity with the legitimate interests of existing residents and property owners. Approving a gas station immediately adjacent to Monaco Condominiums risks imposing lasting burdens on neighboring property owners for the benefit of a single commercial development. We respectfully urge the Planning Commission and City Council to reject the proposed zoning change and encourage a more appropriate, neighborhood-compatible use of the property. Please confirm receipt of this letter and its inclusion in the official case record. Thank you for your consideration.
