The original rezoning request included 1.87 acres; however, the request has been amended to reduce the rezoning area to 0.118 acres. CASE MANAGER COMMENTS: The subject rezoning area consists of approximately 0.118 acres within a 2.037-acre parcel located at the northwest corner of East Oltorf Street and Wickersham Lane, approximately 0.2 miles from Pleasant Valley Road, an Imagine Austin Corridor. The rezoning area is currently undeveloped and is zoned community commercial – mixed use – conditional overlay (GR-MU-CO) combining district zoning. All parcels immediately surrounding the subject tract are zoned multifamily residence-low density – neighborhood plan (MF-2-NP) combining district zoning. These properties include Monaco Condominiums to the north; Chamonix Condos to the southwest; Treehouse Apartments to the south; Coppertree Apartments to the southeast; and the High Point Village Apartments to the east. Please refer to Exhibits A (Zoning Map) and B (Aerial View). The property is located primarily within the half-mile station areas of the Sheringham and Oltorf East stops on CapMetro Rapid Route 800. It is also located within the one-mile station area of the future Pleasant Valley light rail station and within the Equitable Transit-Oriented Development (ETOD) Overlay. These transit related characteristics position the property as a strong possible candidate for future ETOD combining district zoning. The intent of the ETOD overlay is to encourage and enhance transit-supportive land uses and facilitate public realm activation through bicycle, pedestrian, and transit connectivity projects. When Phase 1 of the ETOD Overlay was adopted by the Austin City Council in 2024, Austin Planning staff recommended that properties within the overlay area east of Interstate 35 be deferred from rezoning to the ETOD combining district until the East Riverside Corridor (ERC) Regulating Plan had been updated to align with the ETOD initiative. The update to the ERC Regulating Plan began in 2024 at the direction of Austin City Council and is anticipated to be brought forward for Council consideration in spring of 2027. In addition to being located within the ETOD overlay area, the property is also within the study area for the ERC Regulating Plan update. The goals of the ERC update initiative are to support equitable, transit-oriented, and walkable development by identifying strategies for housing affordability, urban design, and mobility as well as establishing development standards and guidelines related to connectivity, safety, and infrastructure improvements. The applicant is requesting to amend the Conditional Overlay established by Ordinance No. 20130214-066 by removing Service Station from the list of prohibited uses. As amended, the request would apply only to the revised rezoning area rather than the entire property. Staff is recommending denial of the proposed amendment to the Conditional Overlay. Given its location within the ETOD Overlay and its potential for future transit-supportive zoning, 08 C14-2026-0016 - Wickersham Retail; District 32 of 48 C14-2026-0016 – Wickersham Retail Page 3 auto-oriented uses, such as Service Station, are not consistent with the long-term planning vision for the area. BASIS OF RECOMMENDATION: 1. The proposed zoning should be consistent with the purpose statement of the district sought. The Community Commercial (GR) designation is intended for office and commercial uses serving neighborhood and community needs, including both unified shopping centers and individually developed commercial sites, and typically requiring locations accessible from major traffic ways. The Mixed Use (MU) combining district is intended for combination with selected base districts, in order to permit any combination of office, retail, commercial, and residential uses within a single development. The Conditional Overlay (CO) combining district may be applied in combination with any base district. The district is intended to provide flexible and adaptable use or site development regulations by requiring standards tailored to individual properties. 2. The rezoning should be consistent with the policies and principles adopted by the City Council. Amending the Conditional Overlay to allow Service Station use would be inconsistent with the policies and principles adopted by City Council. The property is located primarily within the Equitable Transit-Oriented Development (ETOD) Overlay, which is intended to support transit-supportive land uses and walkable development near major transit investments, including the future Pleasant Valley light rail station. A Service Station is an auto-oriented use and is not consistent with the City Council’s objective of encouraging walkable, transit- supportive development in this area. Furthermore, the Austin City Council passed Resolution No. 20240201-054 to direct Austin Planning staff to update the East Riverside Corridor Master Plan and Regulating Plan to better align with the ETOD initiative by putting forth strategies to enhance multi-modal transportation and establish guidelines and standards for transit-oriented development. Staff took into consideration that this property is located within the study area of the East Riverside Corridor Master Plan and Regulating Plan. At this time, no information has been provided as to whether this property has any preexisting approvals that preempt current water quality or Code requirements. PARD – Planning and Design Review Parkland dedication fees may apply to any future site or subdivision applications resulting from this rezoning. As of January 1, 2024, new commercial, non-residential uses are not subject to parkland dedication requirements at the time of site plan and subdivision. This is too close to residential areas and do not want the lights, noise, and traffic, riff-raff of an all-night gas station nearby. The history of this property: In 2013 the adjacent residential communities allowed a zoning change for this property from residential to commercial with the provision that gas stations would be prohibited. In 2025 the adjacent residential communities granted another zoning change but maintained the prohibition on a gas station. Now the owner wants to ignore the previous conditions negotiated by the neighborhoods. The two condominium complexes, Monaco and Chamonix, oppose this zoning change. First, we ask you – and the Planning Commission members, to go look at this site, maybe on your lunch hour, and see first-hand what a ridiculous proposal this is because of the site’s physical properties. Thank you in advance for at least taking a look at the slabs, the grade, and the ingress/egress. We understand there is a proposed zoning change to allow the corner of Wickersham and East Oltorf to become a convenience store, including a gas station. That's a bad idea, and here are a number of reasons why: 1. Public Safety: This is always our #1 concern. The geology of this project is our most serious concern, a SERIOUS concern, for gasoline storage and potential ruptured lines/explosions. I'm not (pardon the pun) blowing this out of proportion: a. This dirt is among the most unstable in the Austin area, expansive clay, and this property sits on a downward slope toward the Colorado river.
