PLANNING COMMISSION ACTION / RECOMMENDATION: October 13, 2026 CITY COUNCIL ACTION: ORDINANCE NUMBER: 05 C14-2206-0030 – N. Lamar Blvd. at Beaver St.; District 42 of 32 C14-2026-0030 ISSUES: 3 In December 2023, Ordinance No. 20220609-080, Ordinance No. 20221201-056 and Ordinance No. 20221201-055 were invalidated. On March 11, 2024, Ordinance No. 20240229- 073, was enacted to create the “DB90” combining district, which amended City Code Title 25 (Land Development) to create a new zoning district for a density bonus program that grants 30 feet in height above the base zoning district, to a maximum of 90 feet, and modifies site development regulations including compatibility standards. Subsequently, the applicant submitted this rezoning application to request the -DB90 combining district. CASE MANAGER COMMENTS: The property under consideration is a 2+ acre site that is made up of five lots that access North Lamar Boulevard and Beaver Street. The lots fronting N. Lamar Boulevard, referred to as Tracts 1, 2 and 3 on the Zoning Case Map, currently contain automotive repair uses. The lots to the southeast along Beaver Street are referred to as Tract 4 and consist of a single- family home and vacant lot that contains outdoor storage. To the north, there is an automotive repair business (Used Tire Sales) that is zoned CS-V-CO-NP. The lots to the south are developed with another automotive repair business zoned CS-1-V-CO-NP, restaurant uses (Antojitos Chovita and La Gordita Loca), a service station (Exxon) and an automotive sales use zoned MF-4-NP and SF-3-NP. To the east, there is a single-family residence and a religious assembly use (Iglesia Evangelica) zoned SF-3-NP and SF-6-NP respectively. The properties to the west, across N. Lamar Boulevard, contain a restaurant (Guero Carnitas) and a retail center (Lanier Village) that is zoned CS-NP. In this case, the applicant is requesting general commercial services-vertical mixed use building-conditional overlay-density bonus 90-neighborhood plan (CS-V-CO-DB90-NP) combining district zoning for Tracts 1, 2, and 3 and limited office-density bonus 90- neighborhood plan (LO-DB90-NP) combining district zoning for Tract 4 for a proposed development that would include multi-family units requiring an affordable component and a 2,750 sq. ft. retail plaza. A building constructed under density bonus 90 (DB90) standards allows for a mix of residential uses and commercial uses, and the result is typically retail, restaurants and offices on the ground floor, and residential units on upper levels. In this request, the applicant is also asking to modify the DB90 ordinance requirement for pedestrian oriented ground floor commercial spaces in LCD 25-2-652 (F) only for the portion of the site that fronts Beaver Street to allow for a transition from the higher density residential and commercial development on North Lamar into the more residential nature of Beaver Street. The overall project would consist of approximately 545 multifamily residential units and will not be seeking a partial/complete (0-100%) modification for the ground floor commercial space requirement for North Lamar Boulevard (please see Applicant’s Request Letter – Exhibit C). This site under review is within the Georgian Acres Neighborhood Planning Area which is part of the North Lamar Combined Planning Area. The Future Land Use Map (FLUM) calls for a portion of this site to be designated as “Single Family” and the applicant is requesting 05 C14-2206-0030 – N. Lamar Blvd. at Beaver St.; District 43 of 32C14-2026-0030 4 for this tract to be changed to “Mixed Use”. Therefore, there is an accompanying NPA case, NPA-2026-0026.01, that will proceed concurrently with this rezoning application review. A development utilizing the “density bonus 90” incentives is permitted with a base CS and LO districts and must include an affordability component for residential use in order to obtain incentives, including height maximum of 90 feet in the CS district (60 feet base plus 30 feet incentive) and 70 feet in the LO district (40 feet base plus 30 feet incentive) and relaxation of development and compatibility standards, such as FAR, setbacks and building coverage. There are several methods of satisfying DB90 development affordability requirements. There are two options for projects including rental units: 1) a minimum of 12% of the rental units in a building are affordable for a 40-year period for households earning 60% or less than the Austin-Round Rock Metropolitan Statistical Area MFI; or 2) a minimum of 10% of the rental units are affordable for a 40-year period as described above for households earning 50% or less MFI. There are two options of satisfying DB90 development affordability requirements which include ownership units: 1) a minimum of 12% of the residential units in a building are affordable for a 40-year period for households earning 80% or less than the Austin-Round Rock Metropolitan Statistical Area MFI; or 2) an in-lieu-fee payment to the Housing Trust Fund, equivalent to the required percentage of the total residential units, including the mix of bedrooms required, at the rate set in the fee schedule at the time of final site plan submission. BASIS OF RECOMMENDATION: 1. The rezoning should be consistent with the policies and principles adopted by the City Council. City Council has provided policy and direction for having more residential density and increased affordability, as well as incentivizing vertical mixed use buildings throughout the City. This request is consistent with the “DB90” option and Ordinance No. 20240229- 073, which replaced the invalidated “VMU2” combining district. The property under consideration is located along a North Lamar Boulevard a designated Imagine Austin Activity Corridor and is to the south of the North Lamar & Runberg Regional Center. It is approximately 400 ft from both the northbound and southbound Fairfield Drive bus stop. The Cap Metro Fairfield Drive bus stops provide access to High- Frequency 801 Route, as well as access to Local Route 1, both running along the N Lamar Boulvard and South Congress corridors. Both stops are accessible by sidewalks along N Lamar Boulevard, and an ADA compliant crosswalk installed at N Lamar Boulevard at Fairfield Drive intersection (please see ZTA Memorandum – Exhibit D). 05 C14-2206-0030 – N. Lamar Blvd. at Beaver St.; District 44 of 32 C14-2026-0030 5 2. The proposed zoning should be consistent with the purpose statement of the district sought. General Commercial Services district is intended predominately for commercial and industrial activities of a service nature having operating characteristics or traffic service requirements generally incompatible with residential environments. Limited Office district is intended for offices predominately serving neighborhood or community needs, which may be located within or adjacent to residential neighborhoods. Vertical Mixed Use Building (V) combining district may be applied in combination with any commercial base zoning district and allows for a combination of office, retail, commercial and residential uses within a vertical mixed use building. Density Bonus 90 combining district, in exchange for providing affordable housing units and in combination with commercial base zoning districts, allows a mixture of office, retail, commercial, and residential uses with modifications of compatibility standards and site development regulations including increased building height. Neighborhood Plan district denotes a tract located within the boundaries of an adopted Neighborhood Plan. 3. Zoning changes should promote compatibility with adjacent and nearby uses. The proposed site fronts and will take access to North Lamar Boulevard, a Level 3, five- lane undivided arterial roadway. It is surrounded by commercial zoning district designations and uses to the north, south and west and residential zoning and uses to the east. There is CS-V-CO-NP zoning to the north, CS-1-V-CO-NP, MF-4-NP and SF-3-NP zoning to the south, SF-3-NP and SF-6-NP zoning to the east and CS-NP zoning to the west. 4. Zoning should allow for reasonable use of the property. The staff’s recommendation of CS-V-CO-DB90-NP and LO-DB90-NP zoning will permit the applicant to redevelop this site with a mixture of residential, office, civic and commercial uses that will serve the surrounding community. In addition, the applicant’s intent to approximately 545 mid-rise multifamily units at this location supports the goals stated in the Imagine Austin Comprehensive Plan and the Strategic Housing Blueprint. 5. Zoning should promote clearly-identified community goals, such as creating employment opportunities or providing for affordable housing. This rezoning authorizes a property to participate in a voluntary density bonus or incentive program that provides modifications to development regulations or other regulatory-related benefits in exchange for community benefits. The City’s Land Development Code and Drainage Criteria Manual require that the Applicant demonstrate through engineering analysis that the proposed development will have no identifiable adverse impact on surrounding properties. Environmental The site is not located over the Edwards Aquifer Recharge Zone. The site is located in the Little Walnut Creek Watershed of the Colorado River Basin, which is classified as an Urban Watershed by Chapter 25-8 of the City's Land Development Code. It is in the Desired Development Zone. Zoning district impervious cover limits apply in the Urban Watershed classification. According to floodplain maps there is no floodplain within or adjacent to the project location. Standard landscaping and tree protection will be required in accordance with LDC 25-2 and 25-8 for all development and/or redevelopment. 05 C14-2206-0030 – N. This site is required to provide on-site water quality controls (or payment in lieu of) for all development and/or redevelopment when 8,000 sq. ft. cumulative is exceeded, and on-site control for the two-year storm. At this time, no information has been provided as to whether this property has any preexisting approvals that preempt current water quality or Code requirements. Fire No comments. Parks and Recreation Parkland dedication will be required for the new applicable uses proposed by this development, multifamily and Single Family with CS-V-CO-DB90-NP and LO-DB90-NP zoning, at the time of subdivision or site plan, per City Code § 25-1-601. Compatibility Standards The site is subject to compatibility standards due to the proximity/adjacency of SF-3-NP zoned and developed properties to the east, northeast and south (i.e., the triggering property). Reference 25-2-1051, 25-2-1053 Any structure that is located: a. At least 50 feet but less than 75 feet from any part of a triggering property may not exceed 60 feet. b. Less than 50 feet from any part of a triggering property may not exceed 40 feet. No vertical structures are permitted in the compatibility buffer. The proposed development is anticipated to add 545 mid-rise multifamily units, and 2,750 SF of retail plaza. Adjacent Roadways Characteristics The proposed N Lamar and Beaver site will provide access to the surrounding roadway network via two existing driveways, both on N Lamar Blvd and Beaver St. As indicated on the site location map (Figure 1), the N Lamar and Beaver St development is located northeast corner of N Lamar Blvd and Beaver St in Austin, TX. To adequately describe the significance of the roadways within the vicinity of the site, a further characterization is provided for each. Average daily traffic estimates for these roadways were collected on July 7, 2026, for both N Lamar Blvd and Beaver St. The Austin Strategic Mobility Plan (ASMP) catalogs the classifications of these major roadways and documents proposed improvements. N Lamar Blvd: The ASMP designates N Lamar Blvd as a Level 3, five-lane undivided road. There are sidewalks currently exist on both sides of N Lamar Blvd in the vicinity of the site frontage. There are no bike lanes along N Lamar Blvd within the site vicinity. The posted speed limit on N Lamar Blvd is 40 mph. Based on 24-hour data collected along N Lamar Blvd, the average daily traffic (ADT) in the vicinity of the project location is 22,022 vehicles per day (vpd). Beaver St: The ASMP designates Beaver St as a Level 1, two-lane undivided roadway oriented in an east-west direction near the site. There is no sidewalk on site frontage along Beaver St within the site vicinity. The posted speed limit on Beaver St is 25 mph. Based on 24-hour data collected along Beaver St, the average daily traffic (ADT) in the vicinity of the project location is 1,228 vehicles per day (vpd). The site is located approximately 400 ft from both the northbound and southbound Fairfield Drive bus stop. The CapMetro Fairfield Drive bus stops provide access to High-Frequency 801 Route, as well as access to Local Route 1, both running along the N Lamar Blvd and South Congress corridors. Both stops are accessible by sidewalks along N Lamar Blvd, and an ADA compliant crosswalk installed at N Lamar Blvd at Fairfield Drive intersection. Trip Generation and Traffic Analysis Based on the Institute of Transportation Engineers (ITE) Trip Generation Manual (12th Edition), the development will generate approximately 2,580 unadjusted daily trips with 218 trips being generated during the AM peak hour and 224 trips being generated during the PM peak hour, details are shown in Table 1. The growth factor of 2% per year from 2026-2030 was assumed to estimate the projected ADT volumes for 2030 forecasted conditions. Table 2 shows both the existing volumes as well as projected volumes on the road segments in the vicinity of the site. Table 2.
