BRETON – ABSENT; ONE VACANCY CITY COUNCIL ACTION: ORDINANCE NUMBER: ISSUES: None at this time. 07 C14-2026-0016 - Wickersham Retail; District 31 of 27C14-2026-0016 – Wickersham Retail Page 2 CASE MANAGER COMMENTS: The subject rezoning area consists of approximately 0.11 acres on a 2.037 acre parcel located at the northern corner of the intersection of East Oltorf Street and Wickersham Lane, within 0.2 miles of Pleasant Valley Road, an Imagine Austin Corridor. The site is currently an undeveloped lot that is zoned community commercial, mixed use – conditional overlay (GR- MU-CO) combining district zoning. Both East Oltorf Street and Wickersham Lane are both ASMP Level 3 roadways at this location. All parcels immediately surrounding this location are zoned Low-density Multifamily Residential, Neighborhood combining district (MF-2- NP). These properties are the Monaco Condominiums to the North, Chamonix Condos to the Southwest, Treehouse Apartments to the South, Coppertree Apartments to the Southeast, and the High Point Village Apartments to the East. This property is mostly within the half-mile station areas of the Sheringham stop and Oltorf East stop on the Rapid 800 bus route as well as the one-mile station area of the Pleasant Valley station of CapMetro’s forthcoming Blue Line light rail route, and is also within the equitable transit-oriented development overlay (ETOD) – positioning this property as a strong possible candidate for future ETOD combining district zoning. The intent of the ETOD overlay is to encourage and enhance transit-supportive land uses and facilitate public realm activation through bicycle, pedestrian, and transit connectivity projects. When Phase 1 of the ETOD Overlay was adopted by the Austin City Council in 2024, Austin Planning staff recommended that properties within the overlay area east of Interstate 35 be deferred for rezoning into the ETOD combining district until the East Riverside Corridor (ERC) Regulating Plan had been updated to align with the ETOD initiative. The update to the ERC regulating plan was commenced in 2024 at the direction of the Austin City Council and is anticipated to be brought to Council for adoption in the spring of 2027. Along with being situated in the ETOD overlay area, this property is also within the study area of the ERC regulating plan update. The goals of the ERC update initiative are to focus on equitable, transit-oriented, and walkable development by laying out strategies for housing affordability, urban design, and mobility in the area, and define development standards and guidelines for connectivity, safety, and infrastructure improvements. The Applicant is requesting that an amendment be made to the conditional overlay for this property, established by ordinance no. 20130214-066, to remove service station from the list of uses that are prohibited to take place on this property. The applicant’s original request was to amend the conditional overlay for the entire 2.037 acre area of the property, but the applicant has since amended their rezoning application to only amend the conditional overlay for an area of 0.11 acres located approximately in the center of the property. Please Refer to Exhibit A (Zoning Map). Staff is recommending denial of the proposed amendment to the conditional overlay. The proposed zoning should be consistent with the purpose statement of the district sought. The Community Commercial (GR) designation is intended for office and commercial uses serving neighborhood and community needs, including both unified shopping centers and individually developed commercial sites, and typically requiring locations accessible from major traffic ways. The Mixed Use (MU) combining district is intended for combination with selected base districts, in order to permit any combination of office, retail, commercial, and residential uses within a single development. The Conditional Overlay (CO) combining district may be applied in combination with any base district. The district is intended to provide flexible and adaptable use or site development regulations by requiring standards tailored to individual properties. 2. The rezoning should be consistent with the policies and principles adopted by the City Council. The amendment of this property’s conditional overlay to allow for the development of a service station on this property would be inconsistent with the policies and principles adopted by the City Council because this property largely sits within the Equitable Transit-oriented Development overlay – a land use overlay category intended to facilitate transit-supportive uses; a service station is not typically regarded as a transit-supportive use and would therefore be inconsistent with the City Council’s objective of encouraging the creation of walkable neighborhoods near major transit stations (Pleasant Valley light rail station). Furthermore, the Austin City Council passed Resolution No. 20240201-054 to direct Austin Planning staff to update the East Riverside Corridor Master Plan and Regulating Plan to better align with the ETOD initiative by putting forth strategies to enhance multi-modal transportation and establish guidelines and standards for transit-oriented development. Staff took into consideration that this property is located within the study area of the East Riverside Corridor Master Plan and Regulating Plan. 3. Zoning should promote clearly-identified community goals, such as creating employment opportunities or providing for affordable housing. Allowing for the development of a service station at this location does not reasonably relate to the goals and priorities established for this area by the residents of Pleasant Valley in the East Riverside/Oltorf Combined Neighborhood Plan. As the property immediately next door to and downhill from the proposed site, I am deeply concerned about the inevitable environmental and physical harm this project would bring to my neighborhood, my neighbors, and me. Placing a high-volume fueling station in such close proximity to residential homes creates unacceptable risks for pollution, noise, and traffic that will negatively impact our quality of life. In addition, the ongoing construction has caused significant damage and created serious safety hazards within my condominium unit, other units, and the surrounding common areas. Specific structural failures include a front door that cannot be secured, opened, or closed, and a sinking balcony that required emergency bracing to prevent further collapse. Additionally, the unit exhibits extensive cracking in the kitchen and foyer ceilings, while the floors and sliding glass door are visibly sloped. These issues have created a compromised living environment and caused substantial property damage. The neighbors and I urge the city to reject this rezoning request and immediately hold the developers accountable for the ongoing damage to our properties. Therefore I would like to provide my specific comments in email here for consideration. I strenuously object to the allowance of construction of a service station on the corner of Oltorf and Wickersham. There is already a convenient station at the corner of Oltorf and Pleasant Valley only one block away, a convenience store at the corner of Wickersham and Riverside one block in the other direction and on the fourth corner of the block is the grocery store which also provides gasoline. As I understand it it is a city of Austin priority to maintain a walkable, neighborhood environment in this area. Given my work schedule and exercise routine, I frequently walk in early mornings past this corner and already find Crossing Oltorf and Crossing Wickersham at that corner to be fairly dangerous in early light conditions even when wearing a light colored shirt and a headlamp and using crosswalk signals appropriately. Adding gas station driveway entrances where in my experience drivers are often inattentive to pedestrians adds an extra and unnecessary hazard for the many pedestrians in this area who like myself walk for exercise or who walk to bus stations at early hours for transportation to and from work as well as walking after sunset on the return during some time of year. Furthermore, as a resident of the neighboring Monaco Condominiums I was not present at any board meeting where support for this project was discussed nor were owners notified of this decision and this letter of support is not representative of all owners. It has been reported to owners through our HOA that construction has already resulted in cracks to interior walls that could be indicative of even more significant damage. Additionally the foundations of the construction which has inexplicably already begun prior to rezoning has multiple drain pipes that would lead to a short slope of grass then directly onto the sidewalk behind my building which could make it impassable after rains and potentially include gasoline residue in the runoff. Furthermore though I have the utmost Sympathy for the unhoused, the service station already present at the corner of Oltorf and Pleasant Valley attracts many panhandlers including some in need of City Mental Health Services who in one example tend to lie down in the middle of the parking lot; I Can Only Imagine that an additional station might exacerbate the problem and regenerate the population in the mostly vacant unhoused camp along Oltorf east of Wickersham by which I must frequently pass in the dark on exercise walks. If the commercial rezoning were to install a local coffee shop or restaurant I would have similar concerns about inattentive traffic leaving the driveways endangering pedestrians but at least that would add to rather than detract from the Ambiance of the neighborhood. Finally, the gas station already present on the corner of Oltorf and Pleasant Valley seems to be a franchise with a local franchisee and I fear that their business might suffer as a result of an additional unnecessary gas station. This covers the majority of my concerns but is not exhaustive. I hope that you will include my comments in your report if they cannot be conveyed to the council during the meeting.
