Staff added the following prohibited uses to the staff recommendation: Alternative Financial Services, Hotel/Motel, Medical Offices - exceeding 5000 sq. ft. gross floor area, Pedicab storage and Dispatch. Staff added the following conditional uses to the staff recommendation: Club or Lodge, Drive In Services (accessory use), Electronic Testing, Hospital Services – General and Theatre. Please refer to Exhibit D (Applicant Summary Letter as amended). CASE MANAGER COMMENTS: The property in question is approximately 0.45 acres, developed with three one story bungalows and one three story structure attached with a covered walkway to the middle bungalow. The property has access to West 6th (ASMP Level 3) street for one bungalow and access for the other two bungalows exists only through the alley at the rear of the property from Oakland Avenue (ASMP level 1). The site is currently zoned limited office – neighborhood plan (LO-NP) combining district zoning and neighborhood commercial- mixed use – conditional overlay- neighborhood plan (LR-MU-CO-NP) combining district zoning. There are two bus stops near this property; one is approximately 0.05 miles to the east and the other is approximately 0.9 miles to the west. West 6th street is an imagine Austin Corridor and near the 5th/6th & Lamar Station Area. The surrounding zoning patterns consist of mixed uses with multifamily, commercial, office and automotive base zoning districts as well as some single family (SF-3-NP, SF-3-HD-NP; MF-4-NP; MF-4-HD-NP; LO-NP; GO-NP; GO-CO-NP; LR-NP; GR-V-CO-NP; CS-MU-CO-NP; CS-MU-V-CO-NP) Please refer to Exhibits A (Zoning Map) and B (Aerial View). The applicant originally requested general commercial services – conditional overlay – neighborhood plan (CS-CO-NP) combined district zoning to allow for a broader range of commercial, retail, and service uses that better align with the existing development and commercial activity along this segment of West 6th street. Please refer to Exhibit C (Applicant’s Summary Letter). The applicant amended their request to add more uses to the conditional overlay as agreed to with the Old West Austin Neighborhood Association 06 C14-2026-0038 - CV Oakland Bungalows; District 92 of 20 C14-2026-0038 3 (OWANA) on August 4, 2026. Please refer to Exhibit D (Applicant’s Summary Letter – as amended). Staff is recommending the requested general commercial services – conditional overlay – neighborhood plan (CS-CO-NP) combined district zoning for the property. Staff reviewed the initial request for prohibited and conditional uses proposed by the applicant; these uses were in line with staff’s previous recommendations in the surrounding area. The conditional overlay prohibits the more intense uses on the property. There is no demolition proposed for the property and the applicant is intending to keep the current building but add more commercial uses on the property. The Old West Austin Neighborhood Plan identifies "neighborhood-friendly" commercial areas where office, retail, and residences can be mixed vertically and horizontally. These areas include West 5th and 6th Streets between Lamar and Mopac. The applicant and neighbors have come to an agreement on a conditional overlay that ensures this rezoning will comply with those objectives. BASIS OF RECOMMENDATION: 1. The proposed zoning should be consistent with the purpose statement of the district sought. The general commercial services district is intended predominately for commercial and industrial activities of a service nature having operating characteristics or traffic service requirements generally incompatible with residential environments. The conditional overlay combining district may be applied in combination with any base district. The district is intended to provide flexible and adaptable use or site development regulations by requiring standards tailored to individual properties. The neighborhood plan district denotes a tract located within the boundaries of an adopted Neighborhood Plan. 2. Zoning should allow for reasonable use of the property. The staff recommends the applicant’s amended request because the lot meets the intent of the general commercial services (CS) base zoning district, as this would be operating commercial uses serving the neighborhood and community. The Old West Austin Neighborhood Plan Objective 2.1 is to encourage commercial uses that support the neighborhood.
