The Conditional Overlay would prohibit the following 15 uses: - Bail Bond Services - Service Station - Outdoor Entertainment - Exterminating Services - Recycling Center - Performance Venue - Kennels - Club or Lodge - Liquor Sales - Drop-Off Recycling Collection Facility - Basic Industry - Outdoor Sports & Recreation - Indoor Sports and Recreation - Resource Extraction - Scrap and Salvage The staff’s recommendation would maintain the elements of the conditional overlay from Ordinance 010614-29 and 010830-42 which include a 35-foot wide vegetative buffer north and east of the property lines, and prohibit vehicular access from the property to Northcape Drive. This recommendation does not include any vehicle trip count limitations. For a summary of the basis of Staff’s recommendation, please see the basis of recommendation section below. PLANNING COMMISSION ACTION / RECOMMENDATION: July 28, 2026: Case is scheduled to be heard by Planning Commission CITY COUNCIL ACTION: TBD ORDINANCE NUMBER: TBD 04 C14-2026-0029 - 9807 Middle Fiskville; District 41 of 14 C14-2026-0029 2 ISSUES: In certain cases, limited industrial services (LI) zoning may be used within the mixed-use future land use category, provided the most intense industrial uses are limited through a Conditional Overlay. Therefore, Staff has determined that a plan amendment application is not required for this case. CASE MANAGER COMMENTS: The property in question is currently a former Frito Lay Distribution center of approximately 50,000 square feet that was constructed in approximately 1981 and approximately 150,000 square feet of paved parking. The previous conditional overlay from 2001 included a 35-foot vegetative buffer to the north and the east of the property to buffer the single-family neighborhood to the north and the east. It also included prohibiting vehicular traffic to Northcape Drive to the south of the property. While limited industrial services zoning is close to an existing single-family neighborhood, this appears to be a reuse of an existing building that has been there since 1981. The site is 1/3 mile north of East Rundberg Lane and approximately 500 feet east of North Interstate Highway 35 Northbound. BASIS OF RECOMMENDATION: Zoning should allow for reasonable use of the property. There appears to be several distribution center/warehouses within the immediate area. This one while close to a single-family neighborhood to the north and east, was constructed in approximately 1981 and does include a conditional overlay requiring that a vegetative buffer of 35 feet be maintained to the north and east. Zoning should promote clearly-identified community goals, such as creating employment opportunities or providing for affordable housing. The building appears to currently be vacant, and this would be a reuse of an existing building providing workforce jobs to this area. Also, the proposed use of testing energy storage units supports the City’s sustainability goals by promoting green infrastructure. The proposed zoning should be consistent with the purpose statement of the district sought. Limited Industrial service (LI) district is the designation for a commercial service use or limited manufacturing use generally located on a moderately-sized site. This request is for the existing building, approximately 1 acre, and for the least intensive industrial uses. The site is located in the Little Walnut Creek Watershed of the Colorado River Basin, which is classified as an Urban Watershed by Chapter 25-8 of the City's Land Development Code. It is in the Desired Development Zone. 2. Zoning district impervious cover limits apply in the Urban Watershed classification. 3. According to floodplain maps there is no floodplain within or adjacent to the project location. 4. Standard landscaping and tree protection will be required in accordance with LDC 25-2 and 25-8 for all development and/or redevelopment. 5. At this time, site specific information is unavailable regarding vegetation, areas of steep slope, or other environmental features such as bluffs, springs, canyon rimrock, caves, sinkholes, and wetlands. 6. Will there be outdoor storage, loading docks, or regular loading/unloading activity near the side of the property that borders residential backyards? What screening, fencing, landscaping, sound buffering, and setback protections will be required between this industrial use and adjacent homes? What stormwater, drainage, erosion, and runoff protections will be required so nearby yards and homes are not affected? What conditions or restrictions will be placed on the zoning approval to protect residents whose homes directly border the property?
