We do not understand any reason to decide or push this through right now, especially given the legal case that’s been raised related to the development, and will need to be settled presumably in court. We heard of the AISD/OHT proposal as a compromise in that part of the old school might be kept as part of the proposed high-rise complex. However, this “compromise” had no participation by the Rosedale residents who have so much at stake in this development. I'm writing to request that you postpone the decision on the demolition permit. I feel totally bewildered by what has happened over the past few months. This was originally supposed to be an affordable housing project with duplexes for teachers. Then AISD sold the land to a multi family developer without an opportunity for comment. We've recently been sued by AISD, which was a total surprise. I've never been sued in my life, let alone by my own school district. The permitting case is progressing rapidly. I hadn't even thought about a demolition permit being filed for many years, and I expected that such a request likely wouldn't be made until the developer actually bought the land and it was clear that the project can actually be built. I don't know whether the building is historic or not, but I feel like the neighborhood should be given time to come up with a point of view on that before the commission rules. Something that did not come up in the meeting is the remembrance garden that exists on the site, which includes names and birth/passing dates for children who previously attended the school. I don't know if these fall under any criteria for being "historical", but I feel very strongly that these should be preserved. My own children often go to the garden to look at the names and think about what those children might have been like, and they are horrified by the idea it might be removed. One other thing I want to note after listening to the proceedings of the last meeting. It was mentioned that this property is located at 49th and Burnet. It is not on Burnet. It has three adjoining streets, which are all residential (48th, 49th and Ramsey). There were comments made about "being on Burnet Road, a major thoroughfare" and "if it were in the center of a neighborhood it would be one thing". I can assure you that this project is indeed in the middle of a neighborhood--it is bordered on three sides by single family homes and has no direct access to Burnet. Six stories whole within our single family neighborhood neighborhood. And I know that there were other offers but AISD chose this maximalist offer. I can't imagine it getting through all the hurdles that it will need to and therefore think that the destruction of the school at this time is premature and ill-conceived. The building could conceivably have a reuse value at that location in another proposal. And I wonder if it actually does have some historic value as an example of pre-war Industrial style School. The primary reason I would like to request a postponement is that AISD has initiated legal action against 125 neighbors of the Rosedale school site in an attempt to nullify a deed restriction that limits development to one residence per lot at the school. This matter is currently being contested in court, and I believe it is premature to grant a demolition permit while the outcome of the legal action remains unresolved. My home is located just outside the affected zone so the deed restriction lawsuit does not impact me directly, but I know that my neighbors located in the affected zone are unsettled by being sued by the school district when they have not done anything wrong. My overriding concern is that the the process to resolve the suits is being unnecessarily rushed and to ensure fairness to all I would like to see that all the necessary legal steps are followed to conclusion, and that those directly impacted by the maximum-density development have an opportunity to fully execute their legal rights before demolition or other actions are taken on the property. Rosedale is a unique, family-friendly neighborhood where kids and their families can walk, run, and play safely in the street. Traffic density is low, which is lucky as the majority of the streets do not have sidewalks, and every day we see people walking pets; parents pushing children in strollers; and kids playing basketball and learning to ride bikes across the neighborhood. The environment is conducive to a lifestyle that has been lost to many in our city. We know we are lucky to live in Rosedale, but the benefits are not limited to just the residents. Many in Austin come to our neighborhood, especially during the weekends and at Halloween, to enjoy the safe environment and take advantage of the local businesses on Burnet Rd. Allowing a maximum-density development with more than 400 units without direct vehicular access to Burnet Rd would have a serious impact on traffic density and negatively impact the community. I hope we can retain what we have in Rosedale and find an appropriate solution for the development of the Rosedale School site. I do not know if the old school building qualifies as historic, but I would argue that it would be better to make a decision once the legal process concerning AISD's lawsuits concludes. For this and the 15 other considerations I mention above, I respectfully urge the Commission to postpone any action on this case until the court proceedings are complete. This email is to request that the City of Austin HIstoric Landmark Commission postpone its decision to act on the developer OHT's request to demolish the old Rosedale Elementary School. It is very distressing to be sued, as a number of our friends and neighbors have, by our Austin school district. We've all paid our school taxes for many years and still support the district's interests and efforts in many ways. But to have been left out of the conversation, as the district accepted a contract to sell the site to the developer of a high-density, multi-story complex that will add approximately 1,000 resident vehicles, visitors and delivery trucks to a small neighborhood with few sidewalks is not only irresponsible but dangerous. Many Austin citizens walk, bicycle and travel on the Rosedale streets. The additional traffic cutting through to Burnet Road and 45th would be untenable. As do most of our neighbors, WE DO NOT OPPOSE REDEVELOPMENT OF THE SCHOOL SITE. We understand that the property is for sale and will be developed. We would just hope that the development would be more in line with the current deed restrictions and not add a proposed 6 or 7 story building that doesn't even exist on Burnet Road's commercial district. It may also signal to others including a court that the request to nullify deed restrictions are all but a formality. You may be aware that AISD has also applied for a zoning change for the site to highest density possible to proceed with this sale. So, this fact added to the very good chance the courts will uphold the Rosedale homeowners’ deed restrictions, amount to an argument that this process has many more steps to go. Then they came back with the Oct 20th meeting announcing the decision to sell the site to OHT and rezone the property to the maximal MF-6 permit to allow for a 435 unit apartment complex that goes well beyond other designs shown and has no equal in Austin for a site not directly connected to an arterial road. This site is surrounded by single family homes on three sides and requires all traffic to use side streets through the neighborhood for egress. I can only assume they are trying to push this unpopular design through the system quickly without getting input from the Rosedale neighborhood that is directly impacted. A delay in making this decision would allow time to either confirm or contradict my assumption in the paragraph above.
