As you may know, AISD has sued 125 neighbors of the site—including myself, if applicable—in an effort to nullify a long-standing deed restriction that allows only one residence per lot. We are currently fighting this matter in court. It is premature for the Commission to consider any permit to demolish the building while this legal case is still unresolved. I cannot say for certain whether the old school building meets historic criteria, but I can say with certainty that there is absolutely no reason to make any decision at this time. Why are AISD and OHT seeking a demolition permit with such urgency when there is a very real possibility that the courts will uphold the deed restrictions, making their proposed project impossible? It is shocking and deeply unsettling to find ourselves being sued by our own school district. We should not be forced to address the historic status of the building while under active litigation. It feels as though AISD and OHT are attempting to steamroll the community. I would also note that any so-called “compromise” regarding demolition was reached without the involvement of the hundreds of Rosedale residents who will be most affected by OHT’s plans for maximum-density development. A compromise cannot be legitimate when one of the most important stakeholders—the neighborhood itself—was excluded from the discussion. I know I’m in accord with MANY neighbors in asking this. We are being run over by a developer who is using RUSH RUSH RUSH to pressure the AISD into ac(cid:415)ons that do not reflect well on our public school officials and we resent this. Because of OHT’s pressure tac(cid:415)cs, we and 123 of our neighbors out of the blue were given no(cid:415)ce we were being sued. The suit is over a deed restric(cid:415)on on the school property that we have always known about and supported. We have now joined together to hire a lawyer to fight in court to uphold the deed restric(cid:415)on. More than 100 home owners in the Rosedale neighborhood have been sued by AISD, not asked, sued, to get them to agree to disregard the deed restrictions that they agreed to when they purchased their home. These are property owners that have been supporting AISD through taxes for many, many years. Probably close to 100 years of payment into the AISD coffers from property owners in Rosedale. And now to see a historic AISD property sold to the highest bidder who is putting a false time crunch on every entity they are encountering on their way to build a six story fortress style rental apartment building to house some 450 residents. An apartment edifice that sits within 3 neighborhood streets at its borders, not a four or even three lane road, regular ol' narrow neighborhood streets. This part of Rosedale already suffers from too much road traffic with drivers using the streets as a short cut from Burnet Rd. to Shoal Creed and vise versa, and drivers leaving 45th street at speed to find a short cut through our neighborhood. Imagine up to 300 - 400 more cars daily adding to the congestion and ruination of a peaceful and walkable neighborhood. Not to mention the numerous delivery vehicles trying to get to the apartments/fortress. The brick portion of the Rosedale School is a significant example here in Austin of the art-deco style as found on and in community buildings of that era. A dignified and solid structure that could be saved and used as a community center to host events for the neighborhood and surrounded by single family homes. It feels like there’s a race to determine the historic nature of this school and quite possibly tear it down. In fact, there is no hurry. The property is currently in a lawsuit with the neighborhood association over a proposed seven story 500 unit apartment complex in the middle of the neighborhood. There are many steps to be taken before this can be proven viable. There are deed restrictions in place which would prohibit the use of the site for anything other than a single residence or the school. Why rush the demolition if it’s possible in the end that the school building could remain as the most viable use for the site? There are a number of other interested parties who would like to purchase the building to repurpose, making this whole historic review process unnecessary. I appreciate your thought and consideration to taking a reasonable amount of time to get to the end of the process before destroying this beautiful neighborhood landmark. As a taxpayer, I am particularly troubled by AISD’s approach. In September 2023, AISD publicly presented to Rosedale residents a repurposing plan featuring duplexes to support AISD employees—an idea the neighborhood supported (Rosedale Repurposing Update - September 12, 2023). Yet less than two years later, AISD entered into a contract to sell the property to OHT Partners for a six-story, 435- unit apartment complex, without any pre-contract discussion with the neighborhood. Now many of the same residents who supported AISD’s earlier, community-aligned proposal find themselves being sued 14 by their own school district. It is difficult not to feel that AISD and OHT are attempting to push this through without proper community engagement. I also want to note that any “compromise” previously discussed regarding the sell and development of this land did not include the hundreds of Rosedale residents who would be most affected by OHT’s maximum-density development plans. A meaningful compromise cannot occur when a major stakeholder—our neighborhood—is excluded from the conversation. My wife and I are included in this law suit, simply for living within 250’ of the site, and this approach is outrageous. Instead, on consequential projects such as this, our firm works with neighbors to find architectural, urban design and planning solutions that benefit the project as well as the neighboring context impacted by it. I emphatically urge the City to Postpone a Decision on the Rosedale School Demolition Permit as requested by Play Fair with Rosedale and the Rosedale Neighborhood Association. Before any steps are taken, and precious funds spent, to demolish or prepare the site for a non- permitted construction project there should be a clear path forward and an understanding of what could and should be built on the site. The lawsuit attempting to nullify the legal deed restrictions to guide the future land development is far from being resolved, and there will be plenty of time through the design, engineering, construction document, bidding and permitting phases of the project to consider the historic contributions the Rosedale School does or does not make to our community. Personally, I believe that an appropriate redevelopment concept could offer a tremendous benefit to our City, our Neighborhood, a properly motivated developer and ultimately AISD. To shape a thoughtful, well designed development through communication, negotiation, and compromise can result in a consequential project that will create generational value to the site and its neighborhood. But this aggressive, fast paced and uncompromising approach motivated by maximizing profit very seldom results in a good result. I’m certain that each of you who are motivated to serve on the Historic Landmark Commission value saving significant historic buildings and the neighborhoods in which they reside. Your Commission also has an opportunity to help shape our City to meet the future with permanence, beauty, honesty and respect - buildings that your succeeding generation of Landmark Commission members will be proud to protect. 21 Helping the developer, OHT, and ASID to leapfrog and rush the process, suing and overrunning neighbors who share the desire for quality and appropriate infill development will never lead to significant architecture worth saving. I don't know if the old school is historic or not, but I do not see how it serves the city of Austin or the residents of our neighborhood to make any decision on this right now. It is quite possible that courts will decide to uphold deed restrictions in the neighborhood which would make the proposed project impossible, before that is determined I believe that any decision would be premature. It’s shocking and disturbing that my neighbors are being sued by our own school district. We shouldn’t have to be dealing with the historic value of building at this time as well as dealing with this suit. It feels like AISD and OHT are trying to steamroll those residents that are trying to fight for our neighborhood. The hundreds of residents who will be most affected by the building of a maximum density development are left out of this discussion entirely and therefore we can not ethically call this a "compromise" when one of the most important parties are excluded from the discussion.
