Pretty shocking to be sued by my own school district and feels like a breach of the social contract between citizens and their own government who is supposed to be for them, not against them. I support the postponement request by the Play Fair with Rosedale and the Rosedale Neighborhood Association (DA 25-142965). I am utterly gobsmacked that AISD has sued 125 of my neighbors, including my husband and me, to try to nullify a deed restriction that allows only one residence per lot. Having never been sued before, I feel steamrolled, having had no prior notification that this was happening. As neighbors, we are fighting this in court, and believe it’s premature to consider a permit to demolish a building until the court case is resolved. I don’t know whether the school is historic, but there is absolutely no reason to decide on this now. Last time I was there with my dog (who has since passed), there was an area in the back corner where families had made a tribute to their deceased children. Walking through the area with special markers, painted rocks, and light catchers with the children’s names felt sacred - it’s clearly a meaningful place for those families. I’m not sure why AISD and OHT are in such a hurry to get a demo permit when there is a very good chance the courts will uphold the deed restrictions. For what it's worth, the neighbors are not opposed to having the building used, perhaps like Carpenters Hall, or as it has been most recently, for active shooter training. What we don’t want is for the Rosedale School to be bulldozed and replaced with a high-density apartment building when the streets and neighborhood aren't equipped to handle the cars that come with the (proposed) 435+-unit development. Our neighborhood is filled with young children being pushed in strollers, families walking their dogs, and older, white-haired ones hobbling along. There are no sidewalks, and because it’s so walkable and neighborly, cars drive slowly. If you agree to demolish Rosedale School without regard for what it will be replaced with, it is a mistake. Moreover, to make this decision without considering the voices of those who will be affected is wrong; Rosedale should not be excluded from the decision. Thank you for considering my plea. While I attended this school in the 1960s, I am not prepared to argue whether the old school is historic or not. I would argue that there is no good reason to make a decision on that issue right now. I object to this permit. I am asking the Historic Landmark Commission to turn down this request at this time. I own my house at 4701 Ramsey Avenue, which is 150 feet from the Rosedale School property. As a homeowner near the school, I also own certain deed restrictions on the use of the property. Those restrictions forbid the use of the property for anything but a school. The deed restrictions are subject of a lawsuit filed by the Austin Independent School District against me and 124 other nearby landowners. The lawsuit will have a direct impact on the fate of the property, and the density of its development. (Case D-1-GN-25-009749, filed Oct. 31, 2025, in Travis County District Court) This demolition action is premature. The property has not changed hands. While there exists a $26 million contract to sell the property, that deal is contingent upon the outcome of the lawsuit. The neighbors, myself included, have 11 banded together to fight against the overdevelopment that has been proposed. That lawsuit could last for years. Meanwhile, the property continues to be used as an informal community gathering spot - an asset to the community. City staff has presented what it describes as a "compromise" among the parties. It's easy to make compromises when you don't include all the interested parties - and that is what has happened here. It is still owned by AISD, but this permit is sought on behalf of a prospective owner. To grant a demolition permit at the behest of a developer, before it owns the property, is premature. It has the potential to lead to a worst-case scenario - demolition proceeds, but then the AISD loses the suit, or the developer pulls out (as they do). I fear we could be left with a moonscape of fenced-off rubble and uprooted trees. In addition, the site is home to a large number of protected trees, and to a memorial garden that honors the special education students who were educated there over the decades. There has been no effort by either AISD or the developer to reach out to the neighbors, or to the families of the students honored in the memorial garden. I'm sure the relatives, who have placed unique carved memorials, would like the opportunity to reclaim or move the items before they are bulldozed. 12 The solution here is simple: Do not grant this permit until the lawsuit over the property is settled. It’s alarming to be sued by our own school district. It seems odd to consider the historic value of building at this (cid:415)me. After reviewing the historical landmark commission report related to the demolition application, it seems that the scope of this demolition permit application is not just demolition but also includes historical preservation by reconstructing an original portion of the facade nearer to the street and with a 5-story apartment building constructed atop the reclaimed fascia. AISD has sued 125 of my neighbors who are also within a 500 foot radius of the site to nullify a deed restriction that only allows one residence per lot, this litigation is ongoing, and should the neighborhood prevail in keeping the deed restriction in place, the plan to build a 5-story apartment building that is part of this application would not be able to move forward. Further, the setback of any future redevelopment may also change, impacting how close the facade can be placed near the street. Given the likelihood of the neighborhood prevailing in enforcing the existing deed restriction, it is premature and a waste of taxpayer resources for the historical planning commission to be considering a plan that has a high probability of being infeasible. Further, it is shocking that while AISD claims to be cash strapped with a significant budget deficit, they would speculatively risk scarce funds on reconstructing the original portion of the facade nearer to the street and for a 5-story apartment building to be built on top, prior to the conclusion of the ongoing litigation. If for historical preservation reasons moving and reconstructing a portion of the former school building, and setting it up for a 5-story apartment building to be built on top, is part of AISD's demolition application, then AISD and the Historical Landmark Commission should wait until the conclusion of the ongoing litigation on the deed restriction to take any further actions on this application. That is the only 25 way to ensure the proposed historical preservation matches the redevelopment plan for the site that ultimately comes to fruition. It would be tragic for AISD to spend taxpayer dollars on the demolition and construction related to the historical preservations outlined in this application, only to find out that the work was based on an impermissible site plan under the later upheld deed restrictions, and then for AISD to have to do construction rework to accommodate a different redevelopment plan that respects the deed restriction (or even worse, for AISD to have demolished parts of the building that ideally would have been incorporated into a future site plan). AISD and Giant Development Partner OHT are pushing demolition permit requests thru with haste, demolition should not even be considered until our Rosedale Neighborhood court case is resolved. We are NOT NIMBY, we know AISD is in financial trouble but their hardship should not been solved on the back of one tiny neighborhood. The original land that Rosedale school was built on was a promise made by the neighborhood to support AISD and their desire to educate Austin children. It was land that could have been developed into more single family homes, but instead the community supported AISD’s mission. AISD has broken this historic promise by not only closing the neighborhood school but now trying to sell the land to the highest bidder, an earlier development plan that the neighborhood supported never got off the ground. Now AISD is crushing its former neighbors with a plan for a gigantic curb to curb, 6 story apartment complex with 435 market rate apartments which will mean at least 600 cars with no direct access to a major traffic artery. We have 3 small streets that cannot possibly absorb this. It is mean spirited and a bitter slap in the face to the neighborhood that has supported AISD all these years. Michael and I live at 4805 Sinclair. AISD has sued us, just for living within 200 ft of Rosedale school. We have never been sued before in our long careers. We have worked in the construction industry for over 40 years. We take great pride in working to resolve conflict and coming to a solution that is good for everyone 29 This IS NOT GOOD FOR ANYONE.
