SECTION 1612 FLOOD LOADS Combined Flood Plain Regulations 1612.1 General. Within flood hazard areas as established in Section 1612.3 (Establishment of flood hazard areas), all new construction and alterations of buildings, structures and portions of buildings and structures, including substantial improvement and restoration of substantial damage to buildings and structures, shall be designed and constructed to resist the effects of flood hazards and flood loads. When new construction constitutes a substantial improvement or restoration of substantial damage, all aspects of the existing structure shall be brought into compliance with the requirements for new construction for flood design. All elevation requirements noted in this ordinance shall be documented using the Elevation Certificate, FEMA 81-31, and shall be certified by a registered professional engineer, surveyor, or architect, and shall be submitted to the Floodplain Administrator. OPENING REMARKS- DSD Building Official Beth Culver opened up the meeting with remarks that DSD had completed the stakeholder meetings on March 14 that covered 2021 IBC-IEBC and IRC building codes. In those meetings, staff were hearing many complaints that there were too many amendments were making construction challenging and costly. And in hearing from City Council, they wanted permitting to be easier and affordable. Therefore eliminating many amendments as they could to provide and protect health, safety and welfare of our citizens. 3. DISCUSSION -2021 CODES A. International Property Maintenance Code- Austin Code official Kecia Lara provided code compliance overview of the International Property Maintenance Code. In the presentation, Code Compliance staff presented that they will meet with the Building and Fire Board to review the draft of the proposed amendments, continue stakeholder meetings and recommend changes to the Building Standard Commission (BSC) for their feedback and or approval before making final presentation to Council. Exception: The following shall be permitted to be constructed in accordance with this code where provided with an automatic sprinkler system complying with Section P2904. 1. Live/work units located in townhouses and complying with the requirements of Section 508.5 of the International Building Code. 2. Owner-occupied lodging houses with five or fewer guestrooms. 3. A care facility with six or fewer persons receiving custodial care within a dwelling unit. 4. A care facility with six or fewer persons receiving medical care within a dwelling unit. 5. A care facility for six or fewer persons receiving care that are within a single- family dwelling. Proposed Language to Prevent Entrapment Only All fences with a height of less than 6 feet shall not be constructed with exposed pickets or other decorative features at the top of the fence. All fences with exposed pickets or other decorative features shall comply with a design that does not create a ladder effect as per the following: 1. Solid fences that do not have openings shall not contain indentations or protrusions that form handholds and footholds, except for normal construction tolerances and tooled masonry joints. 2. Where the fence is composed of horizontal and vertical members, the distance between the top of the horizontal members shall not be less than 45 inches. Spacing between vertical members shall not exceed 4 inches. Where there are decorative cutouts or decorative features within vertical members, spacing within the cutouts or decorative features shall not exceed 13/4 inches in width. 3. The maximum opening formed by a chain link fence shall not be more than 13/4 inches. Where the fence is provided with slats fastened at the top and bottom that reduce the openings, such openings shall not be greater than 13/4 inches. 4. Where the fence is composed of diagonal members, the maximum opening formed by the diagonal members shall not be greater than 13/4 inches. The angle of diagonal members shall not be greater than 45 degrees (0.79 rad) from vertical. Exceptions: 1. Fences where exposed vertical members are spaced no less than 6 inches apart. 2.
