Building and Fire Board of Appeals April 28, 2021 Building and Fire Board to be held April 28, 2021 at 1:30 PM with Social Distancing Modifications Public comment will be allowed via telephone; no in-person input will be allowed. All speakers must register in advance (April 27 by noon). All public comment will occur at the beginning of the meeting. To speak remotely at the Building and Fire Board Meeting, residents must: •Call or email the board liaison at 512-550-5836 or at rick.arzola@austintexas.gov no later than noon, (the day before the meeting). The information required is the speaker name, item number(s) they wish to speak on, whether they are for/against/neutral, and a telephone number or email address. •Once a request to speak has been called in or emailed to the board liaison, residents will receive either an email or phone call providing the telephone number to call on the day of the scheduled meeting. •Speakers must call in at least 15 minutes prior to meeting start in order to speak, late callers will not be accepted and will not be able to speak. •Speakers will be placed in a queue until their time to speak. •Handouts or other information may be emailed to rick.arzola@austintexas.gov by Noon the day before the scheduled meeting. City Code Chapter 25-12 (Technical Codes) is amended to add a new Article 3 (Flood Hazard Areas) to read as follows: ARTICLE 3. FLOOD HAZARD AREAS § 25-12-51 APPLICABILITY. (A) This article applies to the design, construction of buildings and structures, and additions and alterations to buildings and structures located in flood hazard areas. (B) This article is administered, implemented, and enforced in conjunction with each article of Chapter 25-12 (Technical Codes). (C) This article is amended in the same manner as the Building and Residential Codes. § 25-12-52 DEFINITIONS. in this chapter: (A) Except as otherwise provided, the definitions in this subsection apply to all articles (1) BASE FLOOD A flood that has the following characteristics: (a) (b) For areas amended to incorporate Atlas 14 data, a flood that has a one percent chance of being equaled or exceeded in any given year (100- year flood) calculated under fully developed conditions as prescribed by the Drainage Criteria Manual as amended to incorporate Atlas 14 data; For areas not yet amended to incorporate Atlas 14 data, a flood that has a 0.2 percent chance of being equaled or exceeded in any given year (500-year flood) calculated under the conditions underlying the FEMA Flood Insurance Rate Map as of January 6, 2016, as subsequently revised, or as calculated under existing conditions as prescribed by the Drainage Criteria Manual using data predating Atlas 14; or (c) For the Colorado River, a flood that has a one percent chance of being equaled or exceeded in any given year (100-year flood) calculated under the conditions underlying the FEMA Flood Insurance Rate Map dated January 6, 2016, or as subsequently revised. SECTION 1612 FLOOD LOADS Combined Flood Plain Regulations 1612.1 General. Within flood hazard areas as established in Section 1612.3 (Establishment of flood hazard areas), all new construction and alterations of buildings, structures and portions of buildings and structures, including substantial improvement and restoration of substantial damage to buildings and structures, shall be designed and constructed to resist the effects of flood hazards and flood loads. When new construction constitutes a substantial improvement or restoration of substantial damage, all aspects of the existing structure shall be brought into compliance with the requirements for new construction for flood design. All elevation requirements noted in this ordinance shall be documented using the Elevation Certificate, FEMA 81-31, and shall be certified by a registered professional engineer, surveyor, or architect, and shall be submitted to the Floodplain Administrator.
