August 10, 2026: The public hearing was closed by Chair Jeffery Bowen, Board Member Michael Von Ohlen’s motion to approve to 0 feet setback, Board member Melissa Hawthorne second on 10-0 votes; GRANTED. FINDING: 1. The Zoning regulations applicable to the property do not allow for a reasonable use because: Strict adherence to the 15-foot side setback does not allow for reasonable use of covered unenclosed parking besides the house in a manner common throughout the neighborhood. 2. (a) The hardship for which the variance is requested is unique to the property in that: the house was built in 1950 due to the orientation of the house on corner lot with curb cut for the driveway side street and location of the heritage tree pecan tree the location of the carport is limited and nowhere else to put in except location where it is on. (b) The hardship is not general to the area in which the property is located because: most properties are wider and require only 5-foot side setbacks allowing covered parking or awnings at least 12 feet deep alongside the house. 3. The variance will not alter the character of the area adjacent to the property, will not impair the use of adjacent conforming property, and will not impair the purpose of the regulations of the zoning district in which the property is located because: similar covered parking is common in the area, this awning is confined to the driveway and so does not increase impervious cover, shed water towards the adjacent lot or encroach on that setback.
