(Hancock Neighborhood Plan). BOARD’S DECISION: The public hearing was closed by Chair Jeffery Bowen, Board Member Melissa Hawthorne’s motion to approve, Board member Corry Archer-McClellan second on 10-0 votes; GRANTED. FINDING: 1. The Zoning regulations applicable to the property do not allow for reasonable use because: lot 53 platted in 1911 and was compliant B zoned property, and as code has changed over years it became MF-4 lot with 8,000 square feet minimum, was intended to be a multi-family. 2. (a) The hardship for which the variance is requested is unique to the property in that: existing property has 3 unit and existing Non-Complying and Non-Conforming, as well as commercial business parking lot next to it, fraternity on other side, new development on the other side isolated single lot with a substandard structures. (b) The hardship is not general to the area in which the property is located because: most other MF-4 properties are developed side by side and gathered and developed. 3. The variance will not alter the character of the area adjacent to the property, will not impair the use of adjacent conforming property, and will not impair the purpose of the regulations of the zoning district in which the property is located because: lot is adjacent to fraternity, parking lot and larger student housing and with mixed of student housing would fit in and parking would be contained on site, trash collection on site.
