The proposed development consists of 64 detached residential/condominium units and associated improvements. SUMMARY STAFF RECOMMENDATION: Staff recommends that the Planning Commission consider the extension of this site plan permit by five years, from October 26, 2026 to October 26, 2031, based on the criteria from LDC Section 25-5-62(C)(1). 25-5-63(C) Extension of released site plan by the Land Use Commission: “the Land Use Commission may extend the expiration date of a released site plan beyond the date established by this chapter if the Land Use Commission determines that the request complies with the requirements for extension by the director under 25-5-62 (Extension of Released Site Plan by Director).” 25-5-62(C) The director may extend the expiration date of a released administrative site plan one time for a period of one year if the director determines that there is good cause for the requested extension; and (1) the director determines that: a) the site plan substantially complies with the requirements that apply to a new application for site plan approval; b) the applicant filed the original application for site plan approval with the good faith expectation that the site plan would be constructed; c) the applicant constructed at least one structure shown on the original site plan that is suitable for permanent occupancy; or d) the applicant has constructed a significant portion of the infrastructure required for development of the original site plan; and 08 SP-2017-0484C(XT3) - Sunridge Condominiums Site Plan Extension; District 11 of 6 SP-2017-0484C(XT3) Sunridge Condominiums Site Plan Extension SUMMARY OF SITE PLAN: LAND USE: The site is zoned MF-2-NP. Bojo lbojo@drennergroup.com 512-807-2918 Mr. Keith Mars Development Services Department City of Austin 6310 Wilhelmina Delco Drive Austin, TX 78752 June 2, 2026 Via Electronic Delivery Re: Sunridge Condominiums SP-2017-0484C (XT3) – Site Plan Extension (XT3) request for the 6.56-acre piece of property located at 2701 Sunridge Drive, Austin, Travis County, Texas 78741 (the “Property”) Dear Mr. Mars: As representatives of the owner of the Property, we respectfully submit the enclosed Consolidated Site Plan Application – Completeness Check Submittal along with all other required documentation. With this application, we are requesting an additional five (5) year extension to the approved site development permit, to extend the life of the site plan to October 26, 2031. The original site development permit for this project was issued on October 30, 2018, with an expiration of March 1, 2022. Subsequently, an application for a one (1) year administrative permit extension was submitted on October 28, 2022, extending the life of the site plan to March 1, 2023. Next, an application for a three (3) year extension requiring approval by the Land Use Commission was submitted on May 9, 2023, extending the life of the site plan to October 26, 2026. This project has moved unusually slowly due to a range of factors ranging from Covid-19 to construction cost variability, to market conditions. This project includes a total of 64 units made up of single-family detached residences/townhouses. Per City of Austin Land Development Code (LDC) § 25-5-63, an additional extension to this released site plan requires approval by the appropriate Land Use Commission. The 20-day period to appeal the decision to extend the site development permit expired on November 16, 2023. To our knowledge, no protests were submitted. The Property, consisting of 6.56 acres of land, is located at the southwest intersection of Sunridge Drive and E. Oltorf Street. The site is within the Country Club West Watershed and is partially located in a FEMA 100- and 500- year floodplain. The Property is within the City of Austin’s Full Purpose Jurisdiction and the East Riverside/Oltorf Combined Neighborhood Planning Area. According to LDC § 25-5-63 (Extension of Released Site Plan by the Land Use Commission), the Land Use Commission may extend the expiration date of a released site plan beyond the date established by this chapter if the Land Use Commission determines that the request complies with the requirements for extension by the director under Section 25-5-62 (Extension of Released Site Plan By Director). Per LDC § 25-5-62(C)(1), at least one of the following conditions must be met in order to establish good cause for the requested extension: (a) the site plan substantially complies with the requirements that apply to a new application for site plan approval; (b) the applicant filed the original application for site plan approval with the good faith expectation that the site plan would be constructed; 08 SP-2017-0484C(XT3) - Sunridge Condominiums Site Plan Extension; District 14 of 6 June 5, 2026 Page 2 (c) the applicant constructed at least one structure shown on the original site plan that is suitable for permanent occupancy; or, (d) the applicant has constructed a significant portion of the infrastructure required for development of the original site plan. This request satisfies conditions a, b, c, and d enumerated above. This project substantially complies with the requirements that would be applicable to a new application. The applicant filed the original site plan approval with the good faith expectation that the site plan would be constructed. Twenty-nine (29) structures suitable for permanent occupancy have been completed. All utilities and street construction requirements have been completed and accepted. The green areas on the attached site plan sheet depict the homes that have been sold and are constructed or under construction.
