The requested waiver has been scheduled for hearing at the Planning Commission on Tuesday, July 14, 2026. 3 13 SP-2025-0251C - 815 W 11th Street Office Building; District 93 of 20 As I’ve been preparing the Planning Commission Staff report, I’ve been looking very closely at the parking and I’ve found some inconsistencies. I’d also like to request a review of some of the language in the staff report to confirm that I am accurately representing your request. Can you review and respond to the following? 1. Sheet 14: Garage Level Grading Plan. Am I correct that this is a projection of the main entrance from the level above and can/should be turned off on this sheet? 2. Sheet 12: Floor Plan – Parking Level and Level 1. Shows 10 Parking Spaces on the Parking Level including 1 HC Space. Sheet 14: Garage Level Grading Plan. Shows 15 Parking Spaces including 1 HC Space. Shows 3 parking spaces accessed from the alley entrance ramp and 2 tandem spaces along the east side of the drive aisle. Sheets 10, 12 and 15 consistently show 11 parking spaces on the street level, but they are numbered 11-20 on Sheet 12 and they are numbered 16-26 on Sheet 10 and Sheet 15. Am I correct that the proposed parking layout and space numbering is the version shown on Sheet 12? 3. Sheet 10: Site and Dimensional Control Plan. Parking table shows 20 Standard Parking Spaces and 2 HC Spaces. Also shows 2 HC Spaces as minimum required. Sheet 12: Floor Plan – Parking Level and Level 1 shows a total of 20 spaces including 1 HC Space, 6 Compact Spaces and 13 Standard Spaces. Please clarify whether 1 or 2 HC spaces are required and provided. Consider amending the parking table to show Compact, Standard, HC and Total Spaces. 4. Is this an accurate summary of your request? (Disregard the uncertainty regarding parking counts) The applicant is requesting a waiver based on the size and configuration of the lot and the proposed access and parking layout. The subject site is a mid-block parcel, approximately 50 feet wide with frontage on 11th Street to the north and to the alley on the south. The proposed building extends to the east and west property lines. A below-ground parking level with 10 spaces would be accessed from the alley. Eleven enclosed parking spaces would be accessed at street level from 11th Street. The two-way driveway access to the first floor parking is 18 feet wide. As designed, the driveway is generally central to the building, with a 20 foot wide stairwell and elevator lobby to the west, and an 11 foot wide riser room and bicycle parking enclosure to the east. Parking is screened from the street by the lobby, riser room and bicycle parking, but no pedestrian-oriented use is proposed. The applicant has indicated that it would be infeasible to insert a pedestrian oriented use in either of the narrow spaces to the east or west of the driveway. Further, a pedestrian oriented use in the northwest section of the building would move the stairwell and elevator lobby farther from the street, making pedestrian access to the building’s primary office use less convenient. 5. Do you have anything you’d like to add to the following that might support the case that the building façade and streetscape is engaging and attractive to pedestrians, even in the absence of the Pedestrian-Oriented Commercial use. Maybe a sentence or two about frontage façade and landscape features? Land Use: The applicant requests a waiver from the requirement to place a pedestrian oriented use between a parking garage and the street. As proposed, the façade facing 11th street would consist of 4 13 SP-2025-0251C - 815 W 11th Street Office Building; District 94 of 20 the garage entrance and a pedestrian entrance leading to a stairway and elevator lobby. While this approach offers a less engaging façade for passing pedestrians than a pedestrian oriented use, the narrow lot limits the potential uses which could be placed along the street. Existing development on the south side of 11th Street consists primarily of converted residences on similarly narrow streets. Architectural variety and street trees enhance the pedestrian engagement, attractiveness and interest for pedestrians. 6. Also, please let me know if you have anything you would like to add to the packet going to the Commission. I’m not anticipating significant concern or controversy, but if you would like to add a request letter, architectural renderings, neighborhood photographs or any other exhibits in support of your case, I’d be happy to add them. Sorry for the confusion and difficulty in finding the code reference. I’ve copied the entire section below with the relevant sections highlighted. To find the code section in context, here is a link: § 25-6-591 - PARKING PROVISIONS FOR DEVELOPMENT IN THE CENTRAL BUSINESS DISTRICT (CBD), THE DOWNTOWN MIXED USE (DMU) DISTRICT, THE PUBLIC (P) ZONING DISTRICTS, AND THE UNIVERSITY NEIGHBORHOOD OVERLAY (UNO) DISTRICT. | Code of Ordinances | Austin, TX | Municode Library Note that there are two minor cross referencing typos in the code, which I have identified in RED text below. Also note that the Code section includes a cross-reference to the Waterfront Overlay Code just for the purpose of identifying a list of allowed pedestrian uses. I’ve also copied that section below so you have it all in one place. I think it is pretty clear that the requirement was not written with such a constrained site in mind and that it would be very difficult to insert one of the identified uses. Unfortunately, this is not a section that staff has the flexibility to amend or reinterpret. I am confident that Staff would support a request for a Planning Commission waiver as described in Section 25-6-591(D). Planning Commission also has the authority to add other uses as “pedestrian oriented uses” as described in Section 25-2-691(C)(12). While I am not recommending this, we did see a fairly creative approach in a project several years ago. The developer noted that the code does not establish a minimum size for the pedestrian oriented use, so they inserted an “Art Gallery” along the street which consists of public facing art displays with contact information to discuss purchase. We did insist on staff access to the gallery space to distinguish the area as a “use” rather than just a window display, but my recollection is that they managed comply with a space that is only 5 or 6 feet deep. That said, in this case, I expect that the Planning Commission Waiver is your best approach. With your direction, I can schedule a hearing on the topic immediately. We do not need to wait until the project is ready for final approval. Please let me know how you would like to proceed. (A)The requirements of this section apply to the: (1) central business district (CBD); (2) downtown mixed use (DMU) zoning district; (3) public (P) zoning district within the area bounded by Martin Luther King, Jr., Boulevard; IH-35; Lady Bird Lake; and Lamar Boulevard; and (4) university neighborhood overlay (UNO) district. (B) Off-street motor vehicle parking is not required within the central business district (CBD) or downtown mixed use (DMU) zoning districts except as provided by this subsection. For purposes of this subsection, off-street parking includes any parking that is designated to serve a use and is not located in a public right-of-way, regardless of whether the parking is onsite or offsite. Editor's note—Amendments to division (B) of this section made by Ord. 20130523-104 did not take into account amendments previously made by Ord. 20130411-061. The amendments enacted by Ord. 20130523-104 have therefore been made only to other parts of the section that do not conflict with Ord. 20130411-061. Future legislation will correct the text if needed. 11 13 SP-2025-0251C - 815 W 11th Street Office Building; District 911 of 20 (1) If off-street parking is provided, it must include parking for persons with disabilities as required by the Building Code and may not include fewer accessible spaces than would be required under Paragraph (2)(a) of this subsection. (2) Except for a use occupying a designated historic landmark or an existing building in a designated historic district, off-street motor vehicle parking for persons with disabilities must be provided for a use that occupies 6,000 square feet or more of floor space under the requirements of this paragraph. (a) The following requirements apply if no parking is provided for a use, other than parking for persons with disabilities: (i) the minimum number of accessible parking spaces is calculated by taking 100 percent of the parking previously required for the use under Appendix A (Tables of Off-Street Loading Requirements and Former Off-Street Parking Requirements) and using that result to determine the number of accessible spaces required under the Building Code. The accessible spaces may be provided on- or off- site, within 250 feet of the use and must be on an accessible route. (ii) The director may waive or reduce the number of accessible spaces required under Paragraph (2)(a)(i) if the applicant pays a fee in-lieu to be used by the city to construct and maintain accessible parking in the vicinity of the use. The availability of this option is contingent on the establishment of a fee by separate ordinance and the adoption of a program by the director to administer the fee and establish eligibility criteria. A decision by the director that a use is ineligible for a fee in-lieu is final. (iii) The director may waive or reduce the number of accessible spaces required if no accessible spaces can be provided consistent with the requirements of Paragraph (2)(a)(i) and the use is ineligible for participation in the fee in-lieu program under Paragraph (2)(a)(ii). (iv) An off-site or on-street parking space designated for persons with disabilities that is located within 250 feet of a use may be counted towards the number of parking spaces the use is required to provide under Paragraph (2)(a)(i). (b) If any off-street parking is provided for a use, other than parking for persons with disabilities, then the use is subject to the requirements in Paragraph (1). (3) Except as provided in Subsections (C) and (F), the maximum motor vehicle parking facility allowed is 60 percent of the number of motor vehicle parking spaces previously required by Appendix A (Tables of Off-Street Loading Requirements and Former Off-Street Parking Requirements). (4) Except as provided in Subsections (C) and (D) of this section, a parking garage must be separated from an adjacent street by a pedestrian-oriented use described in Section 25-2-691 (Waterfront Overlay (WO) District Uses) that fronts on the street at the ground level. (ROUDA NOTE: This should only reference the exception in Subsection D. Subsection C does not apply) (5) A curb cut for a garage access must have a width of 30 feet or less. (6) At the intersection of sidewalk and parking access lane, ten degree cones of vision are required. (C) The maximum number of parking spaces allowed under Subsection (B)(3) of this section may be increased at the request of an applicant under the requirements of this subsection. 12 13 SP-2025-0251C - 815 W 11th Street Office Building; District 912 of 20 (1) The director shall approve an increase if all parking spaces are contained in a parking structure and the total number of spaces is less than 110 percent of the spaces calculated under Appendix A (Tables of Off-Street Loading Requirements and Former Off-Street Parking Requirements). (2) Only if bicycle parking is also increased proportionately. (D) The Land Use Commission may waive the requirement of Subsection (B)(5) of this section during the site plan review process after determining that: ROUDA NOTE: This should reference Subsection (B)(4). (1) present and anticipated development in the area is not amenable to access by pedestrians; (2) the requirement does not allow a reasonable use of the property; or (3) other circumstances attributable to the property make compliance impractical. (E) If a waiver is granted under Subsection (D), an area for which the requirement is waived must be screened. (F) This subsection applies to property zoned CBD and DMU. (1) Except as otherwise provided in this subsection, the maximum number of motor vehicle parking spaces allowed is 40 percent of the number of motor vehicle parking spaces formerly required by Appendix A (Tables of Off- Street Parking and Loading Requirements). (2) A development that is les than 10,000 square feet in floor area or containing 70 or fewer residential units can include up to 60 percent of motor vehicle parking spaces formerly required by Appendix A (Tables of Off-Street Parking and Loading Requirements). (3) The maximum number of motor vehicle parking spaces allowed is 80 percent of the number of motor vehicle parking spaces formerly required by Appendix A (Tables of Off-Street Loading Requirements and Former Off-Street Parking Requirements) if: (a) all parking spaces are contained in a parking structure; (b) the director finds that allowing additional parking spaces does not impact public health, safety, or welfare or undermine established planning policies for the area; and (c) one of the following: (i) the parking is a shared parking facility, and the site plan includes a note that identifies the shared parking facility as a condition of approval; (ii) the parking is rented or sold separately from the building space, and the site plan includes a note that identifies the separate rental or sale of the parking spaces as a condition of approval; ( iii) the parking is designed and constructed for conversion to usable building space in the future, and the site plan includes a note that identifies the ability to convert the parking to usable building space as a condition of approval; (iv) the parking is included in an underground parking structure; or (v) the applicant pays a mitigation fee established by separate ordinance. 13 13 SP-2025-0251C - 815 W 11th Street Office Building; District 913 of 20 (4) In addition to the number of motor vehicle parking spaces allowed under Subdivision (3), the number of motor vehicle parking spaces can be increased up to 20 percent of the number of spaces formerly required by Appendix A (Tables of Off-Street Loading requirements and Former Off-Street Parking Requirements) for a maximum of 100 percent, if the additional parking spaces are included in an underground parking structure. (5) A mitigation fee collected in Subdivision (3) is to be used for multimodal improvements within the area bounded by Martin Luther King, Jr., Boulevard; IH-35; Lady Bird Lake; and Lamar Boulevard. (C) A pedestrian-oriented use is a use that serves the public by providing goods or services and includes: (1) art gallery; (2) art workshop; (3) cocktail lounge; (4) consumer convenience services; (5) cultural services; (6) day care services (limited, general, or commercial); (7) food sales; (8) general retail sales (convenience or general); (9) park and recreation services; (10) residential uses; (11) restaurant (limited or general) without drive-in service; and (12) other uses as determined by the Land Use Commission. (D) Pedestrian oriented uses in an MF-1 or less restrictive base district: 14 13 SP-2025-0251C - 815 W 11th Street Office Building; District 914 of 20 (1) are permitted on the ground floor of a structure; and (2) may be permitted by the Land Use Commission above the ground floor of a structure. I did find LDC 25-2-591, which you may have been referring to. This section addresses properties in the DMU. However, I could not find the code section you are referring to requiring the pedestrian oriented use. Section 593 discusses site plan and construction requirements, but it does not require a pedestrian oriented use.
