PROPOSED DEVELOPMENT: The applicant is proposing a four story office/residential building with a single residential unit on the fourth floor. Structure parking is proposed on a below ground level and at street level. A waiver is requested from the requirement to place a pedestrian oriented use between the first floor parking and the street. EXISTING ZONING: The site is zoned DMU-CO-ETOD-DBETOD. The Conditional (CO) overlay establishes a height limit of 40 feet for commercial uses and up to 60 feet for Residential uses above 40 feet. DESCRIPTION OF WAIVER: LDC Section 25-6-591 (see appendix) establishes parking standards for projects in the downtown CBD and DMU Zones. One of those requirements is that a parking garage must be separated from an adjacent street by a pedestrian-oriented use. Allowed pedestrian-oriented uses are listed in LDC Section 25-2-691 and include residential uses as well as a variety of retail, restaurant and personal services uses. LDC Section 25-6-591D authorizes the Planning Commission to waive the requirement to provide a pedestrian oriented use if enforcing that regulation does not allow a reasonable use of the property or if other circumstances attributable to the property make compliance impractical. The applicant is requesting a waiver based on the size and configuration of the lot and the proposed access and parking layout. The subject site is a mid-block parcel, approximately 50 feet wide with frontage on 11th Street to the north and to the alley on the south. The proposed building extends to the east and west property lines. A below-ground parking level 10 spaces (including one ADA space) be accessed from the alley. Ten enclosed parking spaces (including 6 compact spaces) would be accessed at street level from 11th Street. The two-way driveway access to the first floor parking is 18 feet wide. As designed, the driveway is generally central to the building, with a 20 foot wide stairwell and elevator lobby to the west, and an 11 foot wide riser room and bicycle parking enclosure to the east. Parking is screened from the street by the lobby, riser room and bicycle parking, but no pedestrian-oriented use is proposed. The applicant has indicated that it would 13 SP-2025-0251C - 815 W 11th Street Office Building; District 91 of 21 be infeasible to insert a pedestrian oriented use in either of the narrow spaces to the east or west of the driveway. Further, a pedestrian oriented use in the northwest section of the building would move the stairwell and elevator lobby farther from the street, making pedestrian access to the building’s primary office use less convenient. SUMMARY STAFF RECOMMENDATION: Staff recommends approval to allow a parking garage of 10 spaces to be constructed at street level without the requirement to separate the parking garage from the street with a pedestrian oriented use. The site is constrained by the 50 foot lot width and the minimum width of a driveway necessary to access the parking. Pedestrian access to the primary office use is better served by allowing direct access from the sidewalk to the stairway and elevator lobby. As proposed, the façade facing 11th street would consist of the garage entrance and a pedestrian entrance leading to a stairway and elevator lobby. While this approach offers a less engaging façade for passing pedestrians than a pedestrian oriented use, the narrow lot limits the potential uses which could be placed along the street. Existing development on the south side of 11th Street consists primarily of converted residences on similarly narrow streets. Architectural variety and street trees enhance the pedestrian engagement, attractiveness and interest for pedestrians. Environmental: The site is located with the Shoal Creek Watershed, which is classified as an Urban Watershed. There are no critical environmental features. Transportation: Access to the proposed Office and Residential development will be from West 11th street and the adjacent alley. The proposed development did not require a TIA. This administrative site plan will comply with all applicable requirements of the Land Development Code prior to its release. (A) The requirements of this section apply to the: (1) central business district (CBD); (2) downtown mixed use (DMU) zoning district; (3) public (P) zoning district within the area bounded by Martin Luther King, Jr., Boulevard; IH-35; Lady Bird Lake; and Lamar Boulevard; and (4) university neighborhood overlay (UNO) district. Capitol View Corridors (CVCs) were established by the Texas Legislature and Austin City Council to preserve views of the State Capitol Building by limiting the height of structures located within the corridors. State corridors are codified under Texas Government Code, Chapter 3151. The City corridors are listed in § 25-2, Appendix A. Further, the Capitol Dominance Overlay District, as described in § 25-2-161 and § 25-2- 641, was created to keep buildings within close proximity to the Capitol from dominating the structure. The analysis area is comprised of 1 lot at 815 W 11th Street. Areas within CVCs are regulated by the maximum height permitted by the lesser of the base district maximum or the CVC corridor height (§ 25-2-642). The site is zoned LO, which has a zoning height limit of 40 feet. The analysis area is intersected by CVC 07, The MoPac Bridge Corridor. Four points on the site (Spot Elevation, PT 1-4) were identified where the CVC intersects corners or lot lines and at the boundary or furthest extent of the CVC. These points were analyzed to determine the maximum elevation at which a structure may be constructed at each respective point. This analysis was carried out by the Land Use Review Division in the Development Services Department and cross checked and sealed by the City Surveyor in the Public Works Department. The results of the analysis are as follows: Elevation values range from 599.89 to 601.19 Feet Above Mean Sea Level (AMSL). The exhibits that follow are a reference map, showing the analysis points with their elevation values; and a tabular data page with all points and their respective geographic coordinates and elevation values. Please note the information with regard to location of the view corridors and the property boundary are based upon the City of Austin’s Geographic Information System with an accuracy of approximately one foot.
