The proposed development includes the construction of an office building with associated improvements. SUMMARY STAFF RECOMMENDATION: Staff recommends that the Planning Commission consider the extension of this site plan permit by three years, from May 16, 2025 to May 16, 2028, based on the criteria from LDC Section 25-5-62(C)(1). 25-5-63(C) Extension of released site plan by the Land Use Commission: “the Land Use Commission may extend the expiration date of a released site plan beyond the date established by this chapter if the Land Use Commission determines that the request complies with the requirements for extension by the director under 25-5-62 (Extension of Released Site Plan by Director).” 25-5-62(C) The director may extend the expiration date of a released administrative site plan one time for a period of one year if the director determines that there is good cause for the requested extension; and (1) the director determines that: a) the site plan substantially complies with the requirements that apply to a new application for site plan approval; b) the applicant filed the original application for site plan approval with the good faith expectation that the site plan would be constructed; c) the applicant constructed at least one structure shown on the original site plan that is suitable for permanent occupancy; or d) the applicant has constructed a significant portion of the infrastructure required for development of the original site plan; SUMMARY OF SITE PLAN: LAND USE: The site is zoned NBG-NP. Roig, Director Development Services Department City of Austin VIA Electronic Mail jose.roig@austintexas.gov Re: Planning Commission Site Plan Extension for Domain Tower II – Approximately 2.197 Acres located at 10723 Domain Drive, in the City of Austin (“City”), Travis County, Texas (“Property”) Dear Mr. Roig: As representatives of the owner and developer of the above-stated Property, SL Domain LP (“Applicant”), we respectfully request a three-year extension from the current expiration date, May 16, 2025, for the approved site plan for the Domain Tower II project referenced by City of Austin Case No. SP-2018-0495C (“Project”). A one-year administrative site plan extension was previously granted on May 16, 2024. This request is made in accordance with Section 25-5-63 of the City Code. The Project includes the construction of one office tower as part of the North Burnet Gateway – Neighborhood Plan within the Domain South End development consisting of approximately 351,000 square feet, garage parking and the associated utilities and site work. No changes to the approved plans are proposed with this extension. The horizontal infrastructure for the Domain South End development is in place and further explained below. The Applicant is the owner and developer of the Domain South End project, which consists of thirty-three (33) acres and started construction in 2017 with two projects known as the Flatiron (a five (5) story mixed-use residential building) and the Indeed Tower (an eleven (11) story office building). The planning for the redevelopment of the Domain South End property started in 2013 and continues today. After the development of the Flatiron and Indeed Tower projects, the Applicant submitted a D Site Plan to allow for the construction of the horizontal infrastructure for the remainder of the proposed redevelopment. The horizontal infrastructure included private internal drives that serve as roadways for the public, off-site regional detention, water quality, public water and wastewater utilities, landscaping, and street trees. To date, the Domain South End development includes the five (5) story mixed use project known as the Flatiron, the eleven 10 SP-2018-0495C(XT2) - Domain Tower II; District 73 of 7 (11) story office building known as the Indeed Tower, the five (5) story office building known as Domain Place, the nineteen (19) story residential tower known as The Bowen, and a twenty-four (24) story office building known as Domain Tower 2. The Applicant has shown a long-term commitment to the continued redevelopment of Domain South End. The following materials are included with this application: • Completed Site Plan Completeness Check Application • Agent Authorization Letter • Current Tax Certificates • Engineer’s Summary Letter • Project Review Form • Vested Rights Determination • Location Map • Previously Approved Set of Plans Per City Code § 25-5-63 (Extension of Released Site Plan by the Land Use Commission), the Planning Commission may extend the expiration date of a released site plan beyond the date established by the City Code if the Land Use Commission determines that the request complies with the requirements for extension by the director under Section 25-5-62 (Extension of Released Site Plan By Director). Per City Code § 25-5-62(C)(1), at least one of the following conditions must be met in order to establish good cause for the requested extension: (a) the site plan substantially complies with the requirements that apply to a new application for site plan approval; (b) the applicant filed the original application for site plan approval with the good faith expectation that the site plan would be constructed; (c) the applicant constructed at least one structure shown on the original site plan that is suitable for permanent occupancy; or, (d) the applicant has constructed a significant portion of the infrastructure required for development of the original site plan. The proposed Project substantially complies with current City Code requirements and is located within the Desired Development Zone. The original application was approved in October 2020. Due to the impact of the global pandemic on construction prices and the professional office industry, the Project has been delayed. The owner is actively pricing plans and looking for quality tenants and financing to commence as soon as possible. Architectural drawings are complete and 10 SP-2018-0495C(XT2) - Domain Tower II; District 74 of 7 a building permit (2021-010460 BP) was issued in March 2024 to position the Project for construction. As mentioned above, the Applicant has already constructed horizontal infrastructure to serve the thirty-three (33) acre Domain South End project and continues to be committed to the construction of this office building and the additional development permitted and planned for the future. As such, the Project complies with (a), (b) and (d) of City Code § 25-5-62(C)(1), and City Code § 25-5-62(C)(2).
