SUMMARY STAFF RECOMMENDATION: Staff recommends that the Planning Commission consider the extension of this site plan permit by three years, from September 1, 2024 to September 1, 2027, based on the criteria from LDC Section 25-5-62(C)(1). 25-5-63(C) Extension of released site plan by the Land Use Commission: “the Land Use Commission may extend the expiration date of a released site plan beyond the date established by this chapter if the Land Use Commission determines that the request complies with the requirements for extension by the director under 25-5-62 (Extension of Released Site Plan by Director).” 25-5-62(C) The director may extend the expiration date of a released administrative site plan one time for a period of one year if the director determines that there is good cause for the requested extension; and (1) the director determines that: a) the site plan substantially complies with the requirements that apply to a new application for site plan approval; b) the applicant filed the original application for site plan approval with the good faith expectation that the site plan would be constructed; c) the applicant constructed at least one structure shown on the original site plan that is suitable for permanent occupancy; or d) the applicant has constructed a significant portion of the infrastructure required for development of the original site plan; and SUMMARY OF SITE PLAN: LAND USE: The site is zoned CS-MU-V-NP. Swor DATE: May 9, 2025 RE: Highland Office Extension II – SP-2018-0181CT(XT2) – Response to Site Plan Review Comment SP1 of Master Comment Report Update 1, dated April 1, 2025, for a 3-Year Site Plan Extension request for the approximately 0.863-acre piece of property located at 501 Clayton Lane in the City of Austin, Travis County, Texas (the “Property”). RESPONSE TO SITE PLAN REVIEW COMMENT 1 As representatives of the owner of the Property, we submitted this Consolidated Site Plan Application – Administrative and Land Use Commission (C Plan) SP-2018-0181CT(XT2) (this “Site Plan”) requesting a three (3) year extension to the approved site development permit, as allowed under City of Austin Code Section 25-5-63. The site development permit SP-2018-0181CT was issued on February 10, 2020. The request for a one (1) year extension was approved pursuant to SP-2018-0181CT(XT) with a current expiration date of September 1, 2024. The project is titled Highland Office and consists of an approximately 0.863-acre piece of property located west of IH-35 near the intersection of Airport Boulevard and Clayton Lane. This project is located within the City of Austin’s Full Purpose Jurisdiction and is currently zoned General Commercial Services - Mixed Use - Vertical Mixed Use Building - Neighborhood Plan (CS- MU-V-NP). There are no new or additional improvements proposed with this extension request. The owner is requesting this extension to allow additional time due to market demands before initiating construction. Pursuant to §25-5-63(C) of the Land Development Code, the Planning Commission may extend the expiration date of this Site Plan if it finds that this Site Plan complies with the requirements for administrative extension under §25-5-62. This Site Plan meets the requirements of §25-5-62 of the Land Development Code as follows: The applicant is requesting this extension to allow additional time due to market demands before initiating construction, therefore, the first criteria provided in §25-5-62(C) requiring good cause for the requested extension is satisfied. 11 SP-2018-0181CT(XT2) - Highland Office-Extension II; District 43 of 6 Pursuant §25-5-62(C)(1)(b), the original application for approval of this Site Plan was filed with the good faith expectation by the applicant that the development shown on this Site Plan would be constructed, and per this extension request, applicant continues to intend to construct the development shown on this Site Plan. Per the TIA Determination Worksheet dated 8/12/2024, this extension application did not require a TIA, and per the TIA Determination Worksheet dated May 10, 2018, the original site plan application did not require a TIA. Therefore, §25-5-62(C)(2)(b) is the applicable final criteria and is satisfied as follows. In connection with the overall mixed-use Highland project, of which this Property is a portion, the adjacent roadway, Airport Boulevard, has undergone significant improvements and a traffic light has been added in the location of the intersection adjacent to this Property.
