No construction or site modifications are proposed with the conditional use permit. The storage, sales and consumption of alcohol will be limited to an 1,801 square-foot area on the property, as shown on the attached site plan. SUMMARY STAFF RECOMMENDATION: Staff recommends approval of the conditional use permit for sale of alcohol under current City of Austin Code description of “cocktail lounge” land use with the condition that all remaining informal administrative comments are cleared prior to site plan approval. In accordance with Section 25-2-625(E)(3) of City Code, a conditional use permit is required, and the locations for the sale of beer or wine, if any, must be identified on the site plan. Additionally, in accordance with Section 25-2-625(E)(4) of City Code, the land use commission may not consider a site plan until it receives a recommendation from the Parks and Recreation Board. On February 26, 12 SPC-2024-0236A - Waller Creek Boat House Austin Rowing Club; District 91 of 19 2024, the Parks and Recreation Board recommended approval of the conditional use permit to allow the sale of alcohol on the property. The Board’s recommendation is attached with this report. As stated above, no construction or site modifications are proposed with the conditional use permit. The storage, sales and consumption of alcohol will be limited to an 1,801 square-foot area on the property. The storage and sales of alcohol will be located inside the existing building as part of the existing food preparation area inside the building. Alcohol will be served in the existing interior café and a portion of the exterior terrace as shown on the attached site plan. Section 25-5-145 of the Land Development Code (EVALUATION OF CONDITIONAL USE SITE PLAN) states: A. The Land Use Commission shall determine whether the proposed development or use of a conditional use site plan complies with the requirements of this section. B. A conditional use site plan must: 1. Comply with the requirements of this title; Staff Response: This site plan complies with all regulations and requirements of the Land Development Code. 2. Comply with the objectives and purposes of the zoning district; Staff Response: The property is zoned Public (P) and is designated as parks and recreation services (special) use. The proposed conditional use permit complies with the objectives and purpose of the zoning district and Section 25-2-625 of City Code. 3. According to the Permitted Use Zoning Chart, the sale and/or consumption of alcoholic beverages on P-zoned property is subject to Section 25-3-625 of the Land Development Code. Per Section 25-2-625 - PUBLIC (P) DISTRICT REGULATIONS, (4) The Land Use Commission may not consider a site plan until it receives a recommendation from the Parks and Recreation Board and (3) Locations for the sale of beer or wine, if any, must be identified on the site plan. The associated application and plan set do not propose any new development but rather identify and illustrate the area surrounding and adjacent to an existing park structure defined as the parameters of the vendor’s area to be associated with this Conditional Use Permit. The proposed use of the park is for Park and Recreation Services (Special) Area shown on the plans as area ‘1’. Area 1 is the vendor area.
