The remainder property has slopes exceeding 15% slope mainly isolated to the existing drainage channels. There is a new wetland CEF identified in June 2023 located on the Southeast portion of the property most likely resulting from wastewater line construction allowing ground water to surface. Critical Water Quality Zones exist within the site. Ordinance No. 030605-24 permits a roadway and driveway crossing of the Critical Water Quality Zone. Fully developed 25-year and 100-year floodplains exist within the site. The topography of the site is unique in that the unnamed tributary divides the property into an East side and West side. There are multiple constraints that limit the constructable areas such as the CWQZ, existing steep slopes, and offsite flows entering the property. City of Austin | Environmental Commission Variance Application Guide 3 April 10, 2024 Clearly indicate in what way the proposed project does not comply with current Code (include maps and exhibits) FINDINGS OF FACT Per the attached cut/fill exhibit, there are areas that require cuts/fills greater than 8’. As required in LDC Section 25-8-342, in order to grant a variance, the Land Use Commission must make the following findings of fact: Include an explanation with each applicable finding of fact. The requirement will deprive the applicant of a privilege available to owners of similarly situated property with approximately contemporaneous development subject to similar code requirements. The variance: a) Yes / No Numerous other properties along the Burleson Road corridor are developed in a similar manner and fashion as the subject property with large areas of parking and truck courts. At least one of these properties in the nearby vicinity was granted a similar variance to assist in the development of a large warehouse facility at the Park 183 project. Is not necessitated by the scale, layout, construction method, or other design decision made by the applicant, unless the design decision provides greater overall environmental protection than is achievable without the variance; City of Austin | Environmental Commission Variance Application Guide 4 April 10, 2024 The existing grades of the subject property would require extensive cut and fill for any scale or type of commercial development. The conceptual plan presented for review presents a configuration that minimizes the required cut and fill while limiting impact around the Critical Water Quality Zones. In addition, the grading of the bridge crossing over the unnamed stream that separates the western portion of the subject property from the access on Stassney Lane reduces site impacts related to grading. Efforts taken to minimize the cut and fill required for these facilities include maximizing allowable grades within the site’s roadways for WB-67 and WB-50 trucks, orienting the buildings to follow the natural contours, sloping the parking and truck loading areas in the same direction as the existing slopes, and constructing walls to meet natural grade rather than sloping 3:1. The project will provide significant environmental benefits to mitigate the impact of cut and fill and to enhance the design of the project including, without limitation: · · · · · · · · State-of-the-art, LEED-certified buildings and site-phased erosion control plans; Reduced building area to adjust grades; Reduced driveway connections to utilize retaining walls in lieu of grading; Enhanced landscaping; Approximately 0.5 mile of offsite-trail connection to regional Austin- to-Manor trail; · Wetland plantings for newly placed wetland; · Proposed rock retaining walls with natural stone look limiting impact to cut; The applicant will work with staff to review the reflective glass product to ensure it is reducing bird strikes onsite. Improved plantings within creek before and after the bypass culvert Improved plantings around bridge abutments b) Is the minimum deviation from the code requirement necessary to allow a reasonable use of the property; Yes / No The requested variance is the minimum amount necessary to achieve appropriate slopes throughout the internal drives and truck courts. The Warehouse Limited Office (W/LO) zoning district permits the warehousing and office type uses that require the large building footprints, truck courts, and City of Austin | Environmental Commission Variance Application Guide 5 April 10, 2024 parking areas. The excessive slopes on the subject property prevent the development of the facilities that serve the use. Approximately 70% of the site is within the area permitting administrative cut- and-fill variances of 8’ or less. Approximately 20% percent of the remaining site will require cut-and-fill of less than 16’, with only approximately 5% of the site to require greater cut and fill. The project has undergone multiple redesigns and reconfigurations in order to reduce the amount of cut and fill to the minimum reasonably necessary. For example, the volume of required cut has been reduced 89% from the original proposal, building footprints have been reduced, and internal drives have been removed, all to reduce the amount of cut and fill. c) Does not create a significant probability of harmful environmental consequences. The proposed slopes on site meet the 3:1 maximum requirement. Where this requirement cannot be met, retaining walls have been placed. The retaining walls and bridge minimize grading encroachment to the CWQZ, additional property, and bisecting creek. Two water quality and detention ponds have been designed to fully capture the runoff created by the proposed improvements and release stormwater to pre-developed conditions flows. One culvert runs through the site to bypass offsite flows and prevent upstream disturbance. 3. Development with the variance will result in water quality that is at least equal to the water quality achievable without the variance. Multiple areas with “U-” or “V-shaped” contours were present on the hillslopes, suggesting the presence of confined flow. The elevation of the property was between approximately 530 feet and 630 feet above mean sea level (amsl). The Northern Blackland Prairie is distinguished from surrounding regions by the gently rolling hills and fine-textured, black, clay soils that primarily support prairie vegetation (Griffith et al. 2007). Vertisols dominate the Blackland Prairie ecoregion and consist of high clay content soils with significant shrink-swell potential. Soils in this area are underlain by the Ozan Formation (Ko) and high gravel deposits (Qhg; Proctor et al 1979; USGS 2021; see Geology Map). The Ozan Formation is characterized by gray calcareous clay, silt, and sand (USGS 2021). High gravel deposits within the Austin Sheet feature minor quartzite, milky quartz, sandstone, and mudstone underlying silty clays (Proctor et al. 1979). THE VEGETATION REPORT – Provide the information requested below: Brief description of site plant communities (Attach additional sheets if needed): The survey area was an undeveloped, vacant property with sporadic cleared areas dominated by woody encroachment throughout previous agricultural pastures. Three vegetation communities were identified: live oak/ Ashe juniper stand, forested upland, and forested riparian corridor. The live oak / Ashe juniper stand was recently cleared, leaving sporadic residual overstory trees and a relatively open midstory/understory. The live oak / Ashe juniper stand was dominated by an overstory of live oak (Quercus virginiana) and Ashe juniper (Juniperus ashei) with sporadic cedar elm (Ulmus crassifolia) trees and an understory of Japanese privet (Ligustrum japonicum), Chinese privet (Ligustrum sinense), saw greenbrier (Smilax bona-nox), and silver bluestem (Bothriochloa saccharoides). The forested upland community was dominated by an overstory of Ashe juniper, sugarberry (Celtis laevigata), cedar elm, honey mesquite (Prosopis glandulosa), and Osage-orange (Maclura pomifera) trees, with a midstory/understory comprised of Japanese privet, Chinese privet, King Ranch bluestem (Bothriochloa ischaemum), silver bluestem, Bermudagrass (Cynodon dactylon), Johnsongrass (Sorghum halepense), saw greenbrier, and southern dewberry (Rubus trivialis). The forested riparian corridor community was dominated overstory of American elm (Ulmus americana), green ash (Fraxinus pennsylvanica), cedar elm, and sugarberry with sporadic Ashe juniper trees. The midstory/understory was relatively open, comprised of sporadic Japanese privet, Chinese privet, and saw greenbrier. In addition, the grading of the bridge crossing over the unnamed stream that separates the western portion of the subject property from the access on Stassney Lane reduces site impacts related to grading. Efforts taken to minimize the cut and fill required for these facilities include maximizing allowable grades within the site’s roadways for WB-67 and WB-50 trucks, orienting the buildings to follow the natural contours, sloping the parking and truck loading areas in the same direction as the existing slopes, and constructing walls to meet natural grade rather than sloping 3:1. The project has undergone multiple redesigns and reconfigurations in order to reduce the amount of cut and fill to the minimum reasonably necessary. For example, the volume of required cut has been reduced 89% from the original proposal, building footprints have been reduced, and internal drives have been removed, all to reduce the amount of cut and fill. c) Does not create a significant probability of harmful environmental consequences. The proposed slopes on site meet the 3:1 maximum requirement. Where this requirement cannot be met, retaining walls have been placed. The retaining walls and bridge minimize grading encroachment to the CWQZ, additional property, and bisecting creek. Vertisols dominate the Blackland Prairie ecoregion and consist of high clay content soils with significant shrink-swell potential. Three vegetation communities were identified: live oak/ Ashe juniper stand, forested upland, and forested riparian corridor. The live oak / Ashe juniper stand was recently cleared, leaving sporadic residual overstory trees and a relatively open midstory/understory. The live oak / Ashe juniper stand was dominated by an overstory of live oak (Quercus virginiana) and Ashe juniper (Juniperus ashei) with sporadic cedar elm (Ulmus crassifolia) trees and an understory of Japanese privet (Ligustrum japonicum), Chinese privet (Ligustrum sinense), saw greenbrier (Smilax bona-nox), and silver bluestem (Bothriochloa saccharoides). The forested upland community was dominated by an overstory of Ashe juniper, sugarberry (Celtis laevigata), cedar elm, honey mesquite (Prosopis glandulosa), and Osage-orange (Maclura pomifera) trees, with a midstory/understory comprised of Japanese privet, Chinese privet, King Ranch bluestem (Bothriochloa ischaemum), silver bluestem, Bermudagrass (Cynodon dactylon), Johnsongrass (Sorghum halepense), saw greenbrier, and southern dewberry (Rubus trivialis). Critical Water Quality Zones exist within the site. Ordinance No. 030605-24 permits a roadway and driveway crossing of the Critical Water Quality Zone. Fully developed 25-year and 100-year floodplains exist within the site. The topography of the site is unique in that the unnamed tributary divides the property into an East side and West side. The live oak / Ashe juniper stand was recently cleared, leaving sporadic residual overstory trees and a relatively open midstory/understory. The live oak / Ashe juniper stand was dominated by an overstory of live oak (Quercus virginiana) and Ashe juniper (Juniperus ashei) with sporadic cedar elm (Ulmus crassifolia) trees and an understory of Japanese privet (Ligustrum japonicum), Chinese privet (Ligustrum sinense), saw greenbrier (Smilax bona-nox), and silver bluestem (Bothriochloa saccharoides). The forested upland community was dominated by an overstory of Ashe juniper, sugarberry (Celtis laevigata), cedar elm, honey mesquite (Prosopis glandulosa), and Osage-orange (Maclura pomifera) trees, with a midstory/understory comprised of Japanese privet, Chinese privet, King Ranch bluestem (Bothriochloa ischaemum), silver bluestem, Bermudagrass (Cynodon dactylon), Johnsongrass (Sorghum halepense), saw greenbrier, and southern dewberry (Rubus trivialis). A Environmental Variance for construction on slopes greater than 15% is being requested on this site due to site and design constraints. The Stassney Park project proposes five industrial buildings on the site located at 6200 E Stassney Ln. The site is within the Full-Purpose City Limits of the City of Austin in Travis County, Texas. This site is within the Williamson Creek Watershed, which is classified as a Suburban Watershed and a portion is located in the Federal Emergency Management Agency’s 100-year floodplain per 48453C0605K for Travis County, Texas and Incorporated Areas, dated January 22, 2020. This site is not located in the Edwards Aquifer Recharge Zone. Design constraints pertaining to industrial development include, two (2) creeks running north/south through the property. One located near the eastern side adjacent to Stassney Lane, and the other traversing the middle of the property. The one through the middle of the property has a Critical Water Quality Zone associated with it, but the eastern one does not. To mitigate impact to the slopes greater than 15% located on the middle tributary, a bridge is proposed. The bridge will span the 100-year storm water surface elevation to maintain existing drainage patterns through the tributary. In addition to the bridge, enhanced plantings are proposed around the bridge abutments. These plantings will help reduce erosion. Due to the nature of the development with large single story buildings with truck courts, we are proposing development on the 15% slopes associated with the eastern tributary. Impacts to the tributary have been reduced throughout the permitting process to limit crossings and improvements. The existing drainage will be conveyed through the property with an underground storm pipe. Vegetation enhancements to the upstream and downstream areas of the storm bypass are being proposed. These plantings and enhancements will help reduce stormwater velocity and mitigate erosion.
