Lamar Beach Vision Plan and Austin Pets Alive Presented by Kimberly McNeeley, CPRP, Director, PARD Don Bland, Chief Animal Services Officer and 9/2/2020 1 History 3/11/2010: Council approved Resolution No. 20100311-021 which adopts the Implementation Plan to Reduce Animal Intake and Increase Live Animal Outcomes. The Plan includes partnering with a non-profit to operate the Davenport Building as an Adoption Center and to keep open the entire Town Lake Animal Shelter (TLAC) site for at least six months as a safety net after the opening of the new shelter on Levander Loop. 6/23/2011: Council approved Resolution No. 20110623-096 directing the City Manager to adopt the Animal Advisory Commission's recommended criteria in the selection process for a non-profit that will operate the Adoption Center at the current TLAC site. 2 History 10/20/2011: Council authorized the negotiation of a temporary license agreement and such other related documents and instruments reasonably necessary to permit Austin Pets Alive (APA) to temporarily occupy and operate the TLAC located at 1156 W Cesar Chavez, Austin, Texas, for a period of 12 months with one 6-month extension option while the City transitions its animal shelter operations to the new Austin Animal Center. 10/20/2011: Set a public hearing to be conducted in accordance with Section 26.001 et seq. of the Texas Parks and Wildlife Code to consider a resolution authorizing a temporary license agreement between the City of Austin and APA permitting APA to temporarily occupy and operate the TLAC site at 1156 West Cesar Chavez, Austin, Texas, which is located on dedicated parkland known as Lamar Beach at Town Lake Park for a period of 12 months with one 6-month extension option. 3 History 11/10/2011: Council approved Ordinance No. 20111110-022 with amendments to the temporary license agreement with APA permitting APA to temporarily occupy and operate the TLAC, located at 1156 West Cesar Chavez, Austin, Texas, for a period of 12 months with one 6-month extension option while the City transitions its animal shelter operations to the new Austin Animal Center, and waiving Chapter 14-11 (Use of Right-of-Way), Article 1, Division 3, Sections 14-11-42 and 14-11-43 for purposes of the temporary license agreement with APA. 11/10/2011: Council conducted a public hearing in accordance with Section 26.001 et seq. of the Texas Parks and Wildlife Code and approved Resolution No. 20111110-106 authorizing the use of the TLAC site at 1156 West Cesar Chavez, Austin, Texas, which is located on dedicated parkland known as Lamar Beach at Town Lake Park, for animal adoption purposes in connection with the City of Austin's No Kill Implementation Plan, for a period not to exceed 18 months. 4 History 4/5/2012: Set a public hearing to consider a resolution directing the City Manager to amend the temporary license agreement between the City of Austin and APA relating to APA's use of the TLAC site, which is located at 1156 West Cesar Chavez and is a portion of dedicated parkland known as Lamar Beach at Town Lake Park, in accordance with Sec 26.001 of the Texas Parks and Wildlife Code. 4/26/2012: The motion authorizing the negotiation of the agreement based on the Temporary Lease Agreement provided by APA but with instructions to bring the execution back for Council approval on May 24, 2012. Direction was given to staff to start work on a long-term agreement with APA including the following provisions: APA commits to saving all healthy and treatable bottle-baby kittens, parvo puppies, and small dogs on the City' s kill list during the term of the agreement. APA commits to saving an additional five behaviorally challenged large dogs per month during the term - which is more than city staff is currently reporting as the last category of animals being unnecessarily euthanized. APA commits to developing a program to rehabilitate the additional behaviorally challenged dogs that it commits to save. APA commits to refurbishing the kennels and cages to meet Texas State Animal Shelter standards. 5 History 5/24/2012: Council approved Ordinance No. 20120524-022 authorizing the City Manager to execute a license agreement with APA permitting APA to occupy and operate the TLAC, located at 1156 West Cesar Chavez, Austin, Texas, for a fixed term, waiving Chapter 14-11 (Use of Right-of-Way), Article 1, Division 3, Sections 14-11-42 and 14-11-43 for purposes of the license agreement with APA, and repealing Ordinance No 20111110-022. 6/12/2014: Council approved Resolution No. 20140612-060 to initiate and expedite the planning process for Lamar Beach Metro Park and to include public discussion regarding the Pressler Street extension and ensure that nonprofits currently operating at Lamar Beach Metro Park are provided the opportunity to continue their services at Lamar Beach Metro Park after the planning process is complete. 6 History 11/20/2014: Council approved Ordinance No. 20141120-092 with a friendly amendment on directing the City Manager to negotiate and execute a modification to the Amended and Restated Temporary License Agreement with APA to extend the term and allow for improvements at the Lamar Beach Metro Park Site and waiving City Code Sections 14-11-42 and 14-11-43 for purposes of the modification. 12/8/2016: Council approved adoption of the Lamar Beach Park Vision Plan as developed in conjunction with Design Workshop, Inc. which included (as directed) nonprofits currently operating at Lamar Beach Metro Park are provided the opportunity to continue their services. 7 History 11/9/2017: Set a public hearing to be conducted in accordance with Texas Parks and Wildlife Code Section 26.001, et seq., to consider a resolution authorizing a change in use of dedicated parkland to animal services use for operation of the TLAC at 1156 West Cesar Chavez, Austin, Texas, at Lamar Beach at Town Lake Metro Park. 12/7/2017: A motion authorizing the negotiation and execution of any and all necessary documents and instruments, including a license agreement with APA was made by Council Member Pool and seconded by Mayor Pro Tem Tovo. 12/7/2017 Conducted a public hearing and approved Resolution No. 20171207-099 for a permanent use of dedicated parkland, known as Lamar Beach at Town Lake Metro Park, for Animal Services to occupy and operate the future TLAC site at 1156 West Cesar Chavez, Austin, Texas, in accordance with Section 26.001 et seq. of the Texas Parks and Wildlife Code. 8 History 2/15/2018: Council approved Ordinance No. 20180215-016 waiving the annual license fees and appraisal required under City Code Chapter 14-11, for the duration of the initial 25-year term of the temporary license agreement with APA to provide animal services to the City. 4/28/2018: Council authorized negotiation and execution of a 25-year Parkland Improvement and Joint Access Agreement, with one 25-year renewal option, with YMCA of Austin for parking improvements located at Lamar Beach in Town Lake Metropolitan Park, in an amount not to exceed $375,000. Note: agreement was also to include the lease of approximately 0.75 acres of land owned by the YMCA for the purpose of licensing this area to APA for the development of new facilities to replace the existing facilities located at Lamar Beach at Town Lake Metropolitan Park, consistent with the Council- approved Lamar Beach Park Vision Plan. 9 History 5/21/2020 (Item 79): Council approved Ordinance No. 20200521-079 authorizing negotiation and execution of an Amendment to the License Agreement, waiver of the annual license fees and appraisal required under City Code Chapter 14-11 for a 6-month renewal, to commence on May 23,2020 and terminate November 23,2020, with one 6-month extension option with APA permitting APA's use of the TLAC located at 1156 W. Cesar Chavez, Austin, Texas, and declaring an emergency. 10 Current Negotiations with APA and Austin Animal Services Work being done to determine the property limitations as it relates to remodeling and building.
