ETHICS REVIEW COMMISSION SPECIAL CALLED MEETING MINUTES FEBRUARY 6, 2025 The Ethics Review Commission convened in a Special Called Commission meeting on February 6, 2025, at Austin City Hall, B&C Room #1101, at 301 W 2nd Street in Austin, Texas and via Videoconference. Chair Lovins called the Ethics Review Commission meeting to order at 6:06 p.m. Commissioners in Attendance In-Person: Chair Lovins, Vice-Chair Haksoon Andrea Low and Commissioners Edward Espinoza, Luis Figueroa, Adam Materne, Brian McGiverin and Brittany Sharkey were present at Austin City Hall. Commissioners in Attendance Remotely: None. Commissioners Absent: Secretary Nguyen Stanton-Adams and Commissioners Amy Casto, Mary Kahle and Ross Pumfrey. City Staff in Attendance in Person: Caroline Webster, Commission Executive Liaison & Assistant City Attorney; and Meredith Rusin, Staff Liaison. PUBLIC COMMUNICATION: GENERAL No one signed up to speak during general communication. EXECUTIVE SESSION 1. 2. The Ethics Review Commission may announce it will go into Executive Session pursuant to Chapter 551.071 of the Texas Government Code to receive advice from legal counsel to discuss: A complaint filed by Adam Haynes against Mike Siegel raising claimed violations of City Code Chapter 2-2 (Campaign Finance), Section 2-2-13 (Candidates’ Contribution Limits), Section 2-2-21 (Additional Information Required On All Campaign Finance Reports Filed With The City), and City Charter, Article III, Section 8 (Limits On Campaign Contributions and Expenditures). The Ethics Review Commission may announce it will go into Executive Session pursuant to Chapter 551.071 of the Texas Government Code to receive advice from legal counsel to discuss: A complaint filed by Adam Haynes against Zachary Jon Scott Faddis raising claimed violations of City Code Chapter 2-2 (Campaign Finance), Section 2-2-3 (Conformity With Texas Election Code), Section 2-2-21 (Additional Information Required On All Campaign Finance Reports Filed With The City), Section 2-2-23 (Political Committees), 1 Section 2-2-26 (Filing Of Campaign Finance Report Data), Section 2-2-31 (Definitions), Section 2-2-32 (Reporting of Direct Campaign Expenditures), and Section 2-2-33 (Disclosure Statement Required). The Commission went into Executive Session at 6:08 p.m. to discuss Items 1 and 2. Outside Counsel, Alan Bojorquez, advised the Commission during Executive Session. The open meeting resumed at 7:44 p.m. PRELIMINARY HEARING 3. A complaint filed by Adam Haynes against Mike Siegel raising claimed violations of City Code Chapter 2-2 (Campaign Finance), Section 2-2-13 (Candidates’ Contribution Limits), Section 2-2-21 (Additional Information Required On All Campaign Finance Reports Filed With The City), and City Charter, Article III, Section 8 (Limits On Campaign Contributions and Expenditures). Chair Lovins recessed the meeting at 7:48 p.m. to give complainant time to appear before the Commission. Chair Lovins called the meeting back from recess at 8:00 p.m. Vice-Chair Low’s motion to dismiss the complaint without prejudice against Mike Siegal due to Complainant Adam Haynes not being present, as was required by Austin City Code Chapter 2-7-44, was approved on a 7-0 vote of all members present. Commissioner Espinoza seconded the motion. Voting in favor: Chair Lovins, Vice-Chair Low and Commissioners Espinoza, Figueroa, Materne, McGiverin, and Sharkey. Secretary Stanton-Adams and Commissioners Casto, Kahle and Pumfrey were absent. 4. Commissioner Figueroa seconded the motion. Voting in favor: Chair Lovins, Vice-Chair Low and Commissioners Espinoza, Figueroa, Materne, McGiverin, and Sharkey. Secretary Stanton- Adams and Commissioners Casto, Kahle and Pumfrey were absent. ADJOURNMENT Chair Lovins adjourned the meeting at 8:05 p.m. 2 The preceding minutes were approved on an 8-0 vote of all members present at the March 26, 2025 Regular Commission meeting on Commissioner Keel’s motion and Commissioner Preddy’s second.
