STAFF RECOMMENDATION: STAFF CONDITIONS: Recommended with conditions. Staff recommends approval of the PUD with the environmental superiority elements as conditions. • PUD will provide for additional off-site water quality capture of currently untreated stormwater from Manlove Street of a minimum of 7,000 square feet using innovative Jellyfish filter • A 54-inch live oak heritage tree will be relocated to rear of property per approved SP-2021-0451C • PUD will achieve a 3-star Austin Energy Green Building (AEGB) rating, at a minimum • The project shall collect condensate from air conditioning units to support 100% of ground level irrigationThe project will be compliant with the LEED pilot Bird Collision Deterrence credit, ST7 Light Pollution Reduction and comply with Dark Sky regulations • All required tree plantings shall utilize native tree species selected from Appendix F of the Environmental Criteria Manual • Project shall utilize methods to support local Austin biodiversity through innovative native plant landscaping and/or rooftop installations • 100% of required stormwater will be treated using on-site water quality methods • This project will include several landscape solutions that will be achieved with the installation of raised terrace green roof media to be planted with a focus on pollinator-friendly species. 100% of rooftop plantings shall be native to the Edwards Plateau and Blackland Prairie ecoregions. A minimum of 10% of the roof terrace shall be dedicated to landscape installations • The Critical Water Quality Zone will remain free from all development except approved storm drain outfalls and restoration • 100% of all non-turf plant materials will be native or adapted • Shade trees that are not influenced by utility constraints shall be upsized to 4” caliper within the PUD • 1.17 acres of the property is dedicated to the City of Austin as parkland which constitutes approximately 44% of the property. As otherwise specifically modified by the PUD ordinance, the development will comply with current code. 1404 East Riverside PUD C814-2025-0111 Austin Watershed Protection | April 1, 2026 1404 East Riverside PUD C814-2025-0111 2 Site Information  2.62 acres  Critical Water Quality Zone (CWQZ) as well as wetland, rimrock and seep Critical Environmental Features (CEFs) along north side of site  Imagine Austin Activity Corridor, Aligns with Imagine Austin Comprehensive Plan  Zoned East Riverside Corridor (ERC), Corridor Mixed Use (“CMU”) subdistrict  Property is located in the East Riverside District of the Waterfront Overlay  Approved Acton School Redevelopment Site Plan, case number SP-2021-0451C  Approved site plan permits 222 multifamily units Lady Bird Lake Lakeshore Blvd 3 Existing Conditions 4 Proposed PUD  Will include an amendment to the approved Acton School Redevelopment Site Plan: 381 multifamily residential units, inclusive of the 15 on-site affordable housing units Lady Bird Lake  Approximately 44% of the site area, or 1.17 acres, was dedicated as parkland to the City of Austin per the approved site plan, as well as a fiscal payment of $108,983.43 for park improvements as well as $504,373.99 paid for additional fee-in-lieu  Applicant requests building height of 180’, max impervious cover of 70% outside of the waterfront overlay, 45% impervious cover for overall site  Administrative Variance for removal of heritage trees. An administrative variance was granted with the approved site plan for the removal of a 26-inch American elm to be mitigated at a rate of 150%. Asking for administative approval of removal of a 37-inch live oak (classified as dead, diseased or imminent hazard – no mitigation required) and a 32-inch live oak (mitigation payment required at 400% of total inches)  Allow for the reduction of required setbacks from the rimrock, seep and wetland critical environmental features on the property to the minimum extent practicable  Will comply with approved Wetland Mitigation Plan (SP-2021-0451C) 5 Code Modifications  §25-2-492 - Site Development Regulations: Original CS base district limited to 60 feet max height. PUD asking for 180 feet max height  §25-2-734(D) - East Riverside Subdistrict Regulations: Maximum height is the lower of 96 feet or the maximum height allowed in the base zoning district. PUD asking for 180 feet max height  §25-2-734(C) - East Riverside Subdistrict Regulations: For an area not included in a primary setback area or a secondary setback area, the maximum impervious cover is 50%. PUD asking for max of 70%  §25-8-642(C) - Administrative Variance is amended to allow administrative approval for the removal of Tree# 15269, a 37-inch Live Oak tree (dead, diseased, imminent hazard - mitigation not required) and Tree#15268, a 32-inch Live Oak tree (400% mitigation). Removal of a 26-inch American elm was granted with the currently approved site development permit (150% mitigation)  §25-8-281(C)(1)(a) - Critical Environmental Features: Allow for the reduction of required setbacks to the minimum extent practicable 6 Wetland Mitigation and Superiority 7 Wetland Mitigation Plan  Enhanced outfalls.
