BUILDING AND STANDARDS COMMISSION MINUTES REGULAR MEETING WEDNESDAY, March 25, 2026 The Building and Standards Commission convened in a Regular meeting on March 25, 2026, at the City of Austin Permitting and Development Center (PDC), 1610 Wilhelmina Delco Drive, Room 1405, in Austin, Texas. Presiding Commissioner Jeffrey S. Musgrove called the Building and Standards Commission Meeting to order at 6:30 p.m. Commissioners in Attendance: Presiding Commissioner Jeffrey S. Musgrove, Commissioners: Harrison Brown, Lisa Garza, Mia Ibarra, Myra Martinez, and Ex Officio Commissioner Fire Marshal Carrie Stewart. Commissioners in Attendance Remotely: Grant Gilker PUBLIC COMMUNICATION: GENERAL Alex Whiddon appeared before the commission for public communication to request a penalty relief hearing for 2100 Rosewood Avenue. APPROVAL OF MINUTES 1. Approve the minutes of the Building and Standards Commission Regular Meeting on February 25, 2026. The minutes from the meeting of February 25, 2026 were approved on Commissioner Ibarra’s motion, Commissioner Garza’s second, with no objections. Vice Chair Francis and Commissioner Tomlanovich were absent. PUBLIC HEARINGS 2. Conduct a public hearing and consider case number CL 2026-013540; Property address: 1704 Westover Road. Commissioner Garza moved to close the public hearing, Commissioner Ibarra’s second, with no objections. Commissioner Ibarra moved to adopt City staff’s proposed findings of fact, conclusions of law and to order demolition of the residential structure within 45 days, and on the 46th day, if compliance is not achieved, authorize the Code Official is to proceed with demolition, Commissioner Brown’s second. The motion failed on a 3-3 vote. 1 Commissioners Brown, Ibarra and Musgrove vote aye. Commissioners Garza, Gilker and Martinez voted Nay. Vice Chair Francis and Commissioner Tomlanovich were absent. Commissioner Garza moved to adopt City staff’s proposed findings of fact, conclusions of law and City staff’s recommendation for repair of the residential structure within 45 days, with the modification that the penalty be reduced from $250 per week beginning on the 46th day from the date the order is mailed and continuing until compliance is achieved, to $0 per week, with the additional requirement that the property return to be heard again by the Commission at the May 27, 2026 meeting, Commissioner Martinez’s second. Commissioner Garza withdrew her motion. Commissioner Garza moved to continue the case until the May 27, 2026 meeting, Commissioner Martinez’s second. Commissioner Ibarra moved to amend the order to request that a city social worker be present to testify at the May 27, 2026 meeting. Commissioner Garza accepted the amendment. The Commission voted 6-0 in favor of the continuance as amended. Vice Chair Francis and Commissioner Tomlanovich were absent. 3. Conduct a public hearing and consider case numbers CL 2026-013716; Property address: 2607 S IH 35 Service Road NB, aka Park West Inn. This case was pulled from the posted agenda at the request of City staff and was not heard. 4. Conduct a public hearing and consider case numbers CL 2025-137508; Property address: 1505 Mearns Meadow Boulevard. Commissioner Garza moved to close the public hearing, Commissioner Ibarra’s second, with no objections. Commissioner Garza moved to adopt the findings of fact, conclusions of law and City staff’s recommendation for repair of the residential structure within 45 days, with a civil penalty of $250 per week beginning on the 46th day from the date the order is mailed and continuing until compliance is achieved, Commissioner Ibarra’s second. The Motion passed on a 6-0 vote. Vice Chair Francis and Commissioner Tomlanovich were absent. 5. Conduct a public hearing and consider case number CL 2026-022122; Property address: 2112 E Cesar Chavez Street. Commissioner Garza moved to close the public hearing, Commissioner Ibarra’s second, with no objections. Commissioner Ibarra moved to adopt the findings of fact, conclusions of law and City staff’s recommendation for repair of the commercial structure within 45 days, with a civil penalty of $1,000 per week beginning on the 46th day from the date the order is mailed and continuing until compliance is achieved, Commissioner Martinez’s second. The motion passed on a 6-0 vote. Vice Chair Francis and Commissioner Tomlanovich were absent. 6. Conduct a public hearing and consider case numbers CL 2025-082106; Property address: 4313 S 1st Street, aka 4315 S. 1st Street, aka iConic at S.1st Apartments. Commissioner Ibarra moved to close the public hearing, Commissioner Martinez’s second, with no objections. Commissioner Martinez moved to adopt the findings of fact, conclusions of law and adopt City staff’s recommendation for demolition of the 2 commercial multifamily structure within 45 days, and on the 46th day, if compliance is not achieved, authorize the Code Official is to proceed with demolition, with the added requirement that the owner(s) provide for on-site security personnel at the property during the hours from 6 p.m. to 6 a.m., Commissioner Ibarra’s second. Commissioner Ibarra moved to amend the motion to require that on-site security be provided within 14 days, and on the 15th day, if security is not provided a civil penalty of $500 per week will begin to accrue. Commissioner Ibarra withdrew her amendment. Commissioner Martinez withdrew her motion. Commissioner Ibarra moved to adopt the findings of fact, conclusions of law and uphold the previous Order issued at the Commission’s October 8, 2025 meeting, with the recommendations that the owner(s) obtain a new criminal trespass notice and secure the property with onsite personnel from 6 p.m. to 6 a.m., Commissioner Garza’s second. The motion passed on a 6-0 vote. Vice Chair Francis and Commissioner Tomlanovich were absent. FUTURE AGENDA ITEMS 7620 Parkview Circle was continued at the February 2026 regular meeting will return to be heard at the April 2026 regular meeting. 2607 S IH 35 Service Road NB, which was pulled from this March 25 agenda, will return at the April 2026 regular meeting. Election of the Commission’s officers will take place at the April 2026 regular meeting. A discussion will be held to determine the exact date and time of the Commission’s June 2026 retreat. Commissioner Garza moved to adjourn the meeting, Commissioner Ibarra’s second, without objection. Vice Chair Francis and Commissioner Tomlanovich were absent. The meeting was adjourned at 8:55 p.m. The minutes from the March 25, 2026 regular meeting were approved at the April 22, 2026 regular meeting on Commissioner Musgrove’ motion, Commissioner Ibarra’s second on a 8-0 vote. 3
