BUILDING AND STANDARDS COMMISSION MINUTES REGULAR MEETING WEDNESDAY, JANUARY 28, 2026 The Building and Standards Commission convened in a Regular meeting on January 28, 2026, at the City of Austin Permitting and Development Center (PDC), 1610 Wilhelmina Delco Drive, Room 1405, in Austin, Texas. Presiding Commissioner Raisch Tomlanovich called the Building and Standards Commission Meeting to order at 6:31 p.m. Commissioners in Attendance: Raisch Tomlanovich, Lisa Garza, Maria Elena O Ibarra, Kurt Lockhart, Myra Martinez, Jeffrey S. Musgrove, Ex Officio Commissioner Fire Marshal Carrie Stewart. Commissioners in Attendance Remotely: Chair Timothy Stostad PUBLIC COMMUNICATION: GENERAL Alex Whiddon appeared before the commission for public communication to request a penalty relief hearing for 2100 Rosewood Avenue. APPROVAL OF MINUTES 1. Approve the minutes of the Building and Standards Commission Regular Meeting on February 25, 2026. The minutes from the meeting of December 9, 2025 were approved on Commissioner Tomlanovich’s motion, Commissioner Lockhart’s second, with no objections. Vice Chair Francis and Commissioner Gilker were absent. PUBLIC HEARINGS 2. Conduct a public hearing and consider case numbers CL 2025-102012; Property address: 4801 Ledesma Road. Commissioner Musgrove moved to close the public hearing, Commissioner Tomlanovich’s second, with no objections. Commissioner Tomlanovich moved to adopt City staff’s proposed findings of fact, conclusions of law and City staff’s recommended order for repair, with the modification of the compliance timeframe from 45 to 90 days, and with a penalty of $250 per week beginning on the 90th day from the date the order is mailed, 1 continuing until compliance is achieved, Commissioner Garza’s second. The motion passed on a 6-1-0 vote. Vice Chair Francis abstained. Commissioner Ibarra was absent. 3. Conduct a public hearing and consider case number CL 2025-148499; Property address: 1704 Miriam Avenue. Commissioner Tomlanovich moved to close the public hearing, Commissioner Martinez’s second, with no objections. Commissioner Tomlanovich moved to adopt City staff’s proposed findings of fact, conclusions of law and City staff’s recommended order in its entirety, for demolition of the commercial structure within 45 days, and on the 46th day, if compliance is not achieved, authorize the Code Official is to proceed with demolition, Commissioner Ibarra’s second. The motion passed on a 7-0 vote. Vice Chair Francis And COMMISSIONER GILKER were absent. 4. Conduct a public hearing and consider case numbers CL 2025-105080; Property address: 4612 Turnstone Drive. Commissioner Tomlanovich moved to close the public hearing, Commissioner Musgrove’s second, with no objections. Commissioner Tomlanovich moved to adopt City staff’s proposed findings of fact, conclusions of law and City staff’s recommended order in its entirety, for demolition of the commercial structure within 45 days, and on the 46th day, if compliance is not achieved, authorize the Code Official is to proceed with demolition, Commissioner Musgrove’s second. The motion passed on a 7-0 vote. Vice Chair Francis and Commissioner Gilker were absent. 5. Conduct a public hearing and consider case number CL 2025-158554; Property address: 409 E Monroe Street. Commissioner Tomlanovich moved to close the public hearing, Commissioner Musgrove’s second, with no objections. Commissioner Tomlanovich moved to adopt the findings of fact, conclusions of law and City staff’s recommendation for repair of the residential structure within 45 days, with a civil penalty of $250 per week beginning on the 46th day from the date the order is mailed and continuing until compliance is achieved, Commissioner Lockhart’s second. The motion passed on a 7-0 vote. Vice Chair Francis and Commissioner Gilker were absent. 6. Conduct a public hearing and consider an appeal regarding case number CL 2025-145818; Property address: 2020 Goodrich Avenue. Commissioner Tomlanovich moved to close the public hearing, Commissioner Musgrove’s second, with no objections. Commissioner Tomlanovich moved to adopt City staff’s proposed findings of fact, conclusions of law and City staff’s recommended order in its entirety, for demolition of the commercial structure within 45 days, and on the 46th day, if compliance is not achieved, authorize the Code Official is to proceed with demolition, Commissioner Martinez’ second. The motion passed on a 7-0 vote. Vice Chair Francis and Commissioner Gilker were absent. 2 7. 8. Conduct a public hearing and consider an appeal regarding case number CL 2025-146168; Property address: 7077 Grand Canyon Drive, Building 5, Unit 113, also known as Azure Apartments & Townhomes. This case was not heard due to the appellant withdrawing their appeal. Conduct a public hearing and consider an appeal regarding case number CL 2025-156516; Property address: 9001 Northgate Boulevard, Unit 144, also known as Avalon Palms Apartments. This case was not heard due to the appellant withdrawing their appeal. 9. Conduct a public hearing and consider an appeal regarding case number CV 2025-150773; Property address: 5309 Martin Avenue. Commissioner Tomlanovich moved to close the public hearing, Commissioner Musgrove’s second, with no objections. Commissioner Tomlanovich moved to adopt the findings of fact, conclusions of law and City Staff’s recommendation to affirm the notice of violation thereby denying the appeal, Commissioner Lockhart’s second. The motion passed on a 7- 0 vote. Vice Chair Francis and Commissioner Gilker were absent. DISCUSSION AND ACTION ITEM 10. Staff Briefing regarding a Payment Plan Proposal to address the payment and collection of penalties imposed by an order of the Building and Standards Commission. Presentation by James Candelas, Code Review Analyst, Austin Development Services. FUTURE AGENDA ITEMS The commission granted a request for a penalty relief hearing regarding CL 2015-121990 / 2100 Rosewood Avenue, to be heard at the next available meeting. Add a discussion regarding alternate routes for compliance of cases with deceased owners at the next Commission retreat. Add a discussion regarding dates for a Commission retreat at the next meeting. PRESIDING COMMISSIONER TOMLANOVICH moved to adjourn the meeting, without objection. The meeting was adjourned at 8:31 p.m. VICE CHAIR FRANCIS and COMMISSIONER GILKER were absent. The minutes from the January 28, 2026 regular meeting were approved at the February 25, 2026 regular meeting on Commissioner Musgrove’s motion, Commissioner Garza’s second on a 7-0 vote.
