BUILDING AND STANDARDS COMMISSION MINUTES REGULAR MEETING WEDNESDAY, FEBRUARY 25, 2026 The Building and Standards Commission convened in a Regular meeting on February 25, 2026, at the City of Austin Permitting and Development Center (PDC), 1610 Wilhelmina Delco Drive, Room 1405, in Austin, Texas. Vice Chair Michael Francis called the Building and Standards Commission Meeting to order at 6:30 p.m. Commissioners in Attendance: Vice Chair Michael Francis, Commissioners: Raisch Tomlanovich, Lisa Garza, Grant Gilker, Myra Martinez, Jeffrey S. Musgrove, and Ex Officio Commissioner Fire Marshal Carrie Stewart. Commissioners in Attendance Remotely: Chair Timothy Stostad PUBLIC COMMUNICATION: GENERAL Alex Whiddon appeared before the commission for public communication to request a penalty relief hearing for 2100 Rosewood Avenue. APPROVAL OF MINUTES 1. Approve the minutes of the Building and Standards Commission Regular Meeting on February 25, 2026. The minutes from the meeting of January 28, 2026 were approved on Commissioner Musgrove’s motion, Commissioner Garza’s second, with no objections. Commissioner Ibarra was absent. PUBLIC HEARINGS 1. Conduct a public hearing and consider case number CL 2025-114071; Property address: 7620 Parkview Circle. Commissioner Musgrove moved to continue the hearing for 30 days, Commissioner Tomlanovich’s second. Commissioner Garza proposed a friendly amendment to change 30 days to 90 days. Commissioner Musgrove rejected the friendly amendment. The main motion passed on a 7-0 vote. Commissioner Ibarra was absent. 1 2. Conduct a public hearing and consider case numbers CL 2025-102012; Property address: 4801 Ledesma Road. Commissioner Musgrove moved to close the public hearing, Commissioner Tomlanovich’s second, with no objections. Commissioner Tomlanovich moved to adopt City staff’s proposed findings of fact, conclusions of law and City staff’s recommended order for repair, with the modification of the compliance timeframe from 45 to 90 days, and with a penalty of $250 per week beginning on the 90th day from the date the order is mailed, continuing until compliance is achieved, Commissioner Garza’s second. The motion passed on a 6-1-0 vote. Vice Chair Francis abstained. Commissioner Ibarra was absent. 3. Conduct a public hearing and consider case numbers CL 2026-015458; CL 2026-015210; CL 2026-015441 and CL 2026-016075; Property address: 1124 Rutland Drive, Buildings 2, 3, 4 & 18. Commissioner Musgrove moved to close the public hearing, Commissioner Garza’s second, with no objections. Commissioner Musgrove moved to adopt the findings of fact, conclusions of law and City staff’s recommendation to provide on-site temporary hot water facilities available at all times to residents of Buildings 2, 3, 4, and 18 within 15 days, and for repair of the commercial multi-family structures within 45 days, with a civil penalty of $1000 per week beginning on the 46th day from the date the order is mailed and continuing until compliance is achieved, Commissioner Garza’s second. Chair Stostad proposed a friendly amendment to modify the timeframe of compliance for providing on- site temporary hot water facilities available at all times to residents of Buildings 2, 3, 4, and 18 from 15 days to 5 days, with a penalty of $1000 per day beginning on the 6th day until the Code Official finds that compliance with the provision of hot water facilities has been achieved. Commissioner Musgrove accepted the friendly amendment. The amended motion failed on a 5-2 vote. Chair Stostad, Vice Chair Francis, Commissioner Gilker and Commissioner Musgrove voted aye. Commissioner Ibarra was absent. Commissioner Garza AND Commissioner Martinez voted nay. The unamended motion passed on a 7-0 vote. Commissioner Ibarra was absent. 4. Conduct a public hearing and consider case number CL 2025-104937; Property address: 1808 Cedar Avenue. This case was pulled from the posted agenda at the request of City staff and was not heard. 5. Conduct a public hearing and consider case number CL 2026-010855; Property address: 2100 E Cesar Chavez Street. Commissioner Tomlanovich moved to close the public hearing, Commissioner Garza’s second, with no objections. Chair Stostad moved to adopt the findings of fact, conclusions of law and adopt City staff’s recommendation for repair of the residential structure within 45 days, with a civil penalty of $1000 per week beginning on the 46th day from the date the order is mailed and continuing until compliance is achieved, Commissioner Garza’s second. The motion passed on a 7-0 vote. Commissioner Ibarra was absent. 2 6. Conduct a public hearing and consider case number CL 2025-135581; Property address: 2015 Payne Avenue. Commissioner Musgrove moved to close the public hearing, Chair Stostad’s second, with no objections. Commissioner Garza moved to adopt the findings of fact, conclusions of law and adopt City staff’s recommendation to issue a new order that will supersede the prior repair order issued on July 22, 2020, and recorded as TRV 2020150513 in Travis County Deed Records, affirm the civil penalty of $284,428.57, assessed from the order issued July 22, 2020, and interest will no longer continue to accrue, and order demolition of all portions of the rear accessory structure, the carport, and any additional accessory structures within 45 days from the date the order is mailed, and on the 46th day, if compliance is not achieved, authorize the Code Official is to proceed with demolition; Commissioner Musgrove’s second. The motion passed on a 7-0 vote. Commissioner Ibarra was absent. 7. Conduct a public hearing and consider case number CL 2015-121990; Property address: 2100 Rosewood Avenue. Commissioner Musgrove moved to close the public hearing, Commissioner Garza’s second, with no objections. Commissioner Martinez moved to adopt the findings of fact, conclusions of law and order the remaining civil penalty of amount from $36,372.37 assessed from the prior BSC order (TRV 2015177765) be reduced to $0.00, Commissioner Garza’s second. The motion failed on a 0-7 vote. Commissioner Ibarra was absent. Commissioner Tomlanovich moved to adopt the findings of fact, conclusions of law and adopt City staff’s recommendation to affirm the remaining civil penalty assessed from the prior BSC order (TRV 2015177765) with one modification, i.e., to reduce the remaining civil penalty amount from $36,372.37 to $6000.00 if paid within 30 days from the date the order is mailed and, if not paid in full, on the 31st day, the unpaid portion of the remaining penalty shall be reinstated, Commissioner Stostad’s second. The motion passed on a 7-0 vote. Commissioner Ibarra was absent. DISCUSSION AND ACTION ITEM 8. Discussion about the possibility of holding a commission retreat on a future date. The Commission requested June 9, June 10, or June 11, 2026 for the date of the future Commission retreat. FUTURE AGENDA ITEMS 7620 Parkview Circle will return to be heard at the April 2026 regular meeting. Commissioner Musgrove moved to adjourn the meeting, Commissioner Tomlanovich’s second, without objection. The meeting was adjourned at 9:06 p.m. Commissioner Ibarra was absent. The minutes from the February 25, 2026 meeting were approved at the March 25, 2026 meeting on Commissioner Ibarra’s motion, Commissioner Garza’s second on a 6-0 vote.
