BUILDING AND STANDARDS COMMISSION MEETING MINUTES Wednesday, October 8, 2025 BUILDING AND STANDARDS COMMISSION SPECIAL CALLED MEETING MINUTES WEDNESDAY, October 8, 2025 The BUILDING AND STANDARDS COMMISSION convened in a SPECIAL CALLED meeting on 8 October 2025, at the CITY OF AUSTIN PERMITTING AND DEVELOPMENT CENTER (PDC), 6310 WILHELMINA DELCO DRIVE, ROOM 1405, in Austin, Texas. CHAIR TIMOTHY STOSTAD called the BUILDING AND STANDARDS COMMISSION (BSC) Meeting to order at 6:32 p.m. Commissioners in Attendance: Chair Timothy Stostad, Commissioners: Michael Francis, Grant Gilker, Kurt Lockhart, Maria Elena O Ibarra, Jeffrey S. Musgrove and Ex Officio Commissioner Fire Captain Stephen Truesdell Commissioners in Attendance Remotely: Commissioner Raisch Tomlanovich PUBLIC COMMUNICATION: GENERAL No one appeared before the Commission for public communication. APPROVAL OF MINUTES 1. Approve the minutes of the BUILDING AND STANDARDS COMMISSION REGULAR MEETING on July 23, 2025. The minutes from the meeting of July 23, 2025 were approved on COMMISSIONER FRANCIS’s motion, COMMISSIONER LOCKHART’s second, with no objections. PUBLIC HEARINGS 2. Conduct a public hearing and consider case number CL 1998-001351; Property address: 6706 Bluff Springs Road, also known as Horton-Duval House. COMMISSIONER FRANCIS moved to close the public hearing, COMMISSIONER MUSGROVE’s second, with no objections. COMMISSIONER FRANCIS moved to adopt the findings of fact, conclusions of law and adopt City staff’s recommendation to issue a new order that supersedes the prior order for repair issued on December 3, 1997, and 1 BUILDING AND STANDARDS COMMISSION MEETING MINUTES Wednesday, October 8, 2025 recorded in Volume 13076, Page 2066 of the Travis County Deed Records on December 8, 1997, and require: 1) that the accrued penalty of $358,607.14 from the prior order remain in place, and interest would no longer continue to accrue; 2) deconstruction through demolition within 45 days, and if not in compliance on the 46th day, authorize the Code Official to proceed with deconstruction through demolition, COMMISSIONER IBARRA’s second. The motion carried on a 7-0 vote. 3. Conduct a public hearing and consider case numbers CL 2023-015135; Property address: 7613 Jester Boulevard. COMMISSIONER FRANCIS moved to close the public hearing, COMMISSIONER GILKER’s second, with no objections. COMISSIONER GILKER moved to adopt the findings of fact and conclusions of law and adopt City staff’s recommendation to issue a new order that would supersede the prior order issued March 22, 2023 (TRV 2023034354) and the property, located on would require COMMISSIONER IBARRA’s second. COMMISSIONER IBARRA moved to close the public hearing, COMMISSIONER FRANCIS’s second, with no objections. COMMISSIONER LOCKHART moved to adopt the findings of fact, conclusions of law and adopt City staff’s recommendation to issue a new order that would supersede the prior order for repair (TRV 2024100573) and require: 1) that the accrued penalty of $50,571.43 from the prior order remain in place, and interest would no longer continue to accrue; 2) fence and secure all structures on the property within 7 days and maintain as a secured site, and if not fenced and secured within 7 days, authorize the Code Official to fence and secure 3) demolition within 45 days, and if not in compliance to proceed with demolition, the Code Official on COMMISSIONER IBARRA’s second. The amended motion carried on a 7-0 vote. the 46th day, authorize 5. Conduct a public hearing and consider case number CL 2025-054292; Property address: 5103 Valley Oak Drive. COMMISSIONER MUSGROVE moved to close the public hearing, COMMISSIONER FRACNIS’s second, with no objections. COMMISSIONER FRANCIS moved to adopt the findings of fact, conclusions of law and adopt City staff’s recommendation for repair of the residential structure within 45 days, with a civil penalty of $250 per week beginning on the 46th day from the date the order is mailed and continuing until compliance is achieved, COMMISSIONER LOCKHART’s second. COMMISSIONER FRANCIS proposed a friendly amendment to change the penalty for non-compliance from $250 per week to $1000 per day per violation. The friendly amendment was seconded by COMMISSIONER MUSGROVE. The amendment carried on a 7-0 vote. Conduct a public hearing and consider case numbers CL 2025-066008; Property address: 808 Turtle Creek Boulevard. COMMISSIONER MUSGROVE moved to close the public hearing, COMMISSIONER FRANCIS’s second, with no objections. COMMISSIONER FRANCIS moved to adopt the findings of fact, conclusions of law and adopt City staff’s recommendation for repair of the residential structure with the modification that the compliance timeframe be changed from 45 days to 60 days, with a penalty of $250 per week beginning on the 61st day if compliance is not achieved, COMMISSIONER IBARRA’s second. The motion carried on a 7-0 vote. 7. Conduct a public hearing and consider case number CL 2025-072000; Property address: 2115 Courtney Street. COMMISSIONER FRANCIS moved to close the public hearing, COMMISSIONER MUSGROVE’s second, with no objections. COMMISSIONER IBARRA moved to adopt the findings of fact, conclusions of law and adopt City staff’s recommendation for repair of the residential structure within 45 days, with the modification that the penalty of $250 per week be changed to $1000 per week, beginning on the 46th day if compliance is not achieved, COMMISSIONER MUSGROVE’s second. The motion passed on a 7-0 vote. 8. Conduct a public hearing and consider case number CL 2025-082106; Property address: 4313 S 1st Street, also known as 4315 S. 1st Street, aka iConic at S.1st Apartments. COMMISSIONER LOCKHART moved to close the public hearing, COMMISSIONER MUSGROVE’s second, with no objections. COMMISSIONER LOCKHART moved to adopt the findings of fact, conclusions of law and adopt City Staff’s recommendation for repair of the residential structure within 45 days, with a civil penalty of $1000 per week beginning on the 46th day from the date the order is mailed and continuing until compliance is achieved, COMMISSIONER FRANCIS’s second. COMMISSIONER MUSGROVE proposed a friendly amendment to change the penalty for non-compliance from $1000 per week to $1000 per day per violation, COMMISSIONER LOCKHART’s second. The amendment failed on a 5-2 vote. COMMISSIONERS GILKER, IBARRA, MUSGROVE, TOMLANOVICH and LOCKHART voted aye. COMMISSIONER FRANCIS and CHAIR STOSTAD voted nay. The original motion passed on a 6-1 vote. COMMISSIONER MUSGROVE voted nay. 9. Conduct a public hearing and consider an appeal regarding case number CV 2024-010522; Property address: 201 W Powell Lane. This case was not heard and will be added to the next meeting’s agenda. 10. Conduct a public hearing and consider an appeal regarding case number CV 2025-091011; Property address: 1501 Summer Creek Drive. 3 BUILDING AND STANDARDS COMMISSION MEETING MINUTES Wednesday, October 8, 2025 COMMISSIONER IBARRA moved to close the public hearing, COMMISSIONER MUSGROVE’s second, with no objections. COMMISSIONER FRANCIS moved to adopt the findings of fact, conclusions of law and adopt City Staff’s recommendation to affirm the Notice of Violation thereby denying the appeal, COMMISSIONER IBARRA’s second. The motion passed on a 7-0 vote. DISCUSSION AND ACTION ITEM 11. Election of Vice Chair of the Building and Standards Commission CHAIR STOSTAD nominated COMMISSIONER FRANCIS for the office of VICE CHAIR. COMMISSIONER FRANCIS accepted the nomination. The nomination carried on a 6-0-1 vote. COMMISSIONER FRANCIS abstained. 12. Approval of the 2026 Building and Standards Commission regular meeting schedule. COMMISSIONER FRANCIS moved to adopt the proposed meeting schedule to include December 9, 2026 as the date for the regular December meeting, COMMISSIONER LOCKHART’s second, with no objections. The motion passed on a 7-0 vote. FUTURE AGENDA ITEMS 1. 2. CV 2024-010522; 201 W Powell Lane will be heard at the October 29, 2025 meeting. The Commission agreed at the July meeting to hear 5207 Prock Lane regarding penalty relief. This case will be heard at the October 29, 2025 meeting. 3. Add a discussion item regarding a Building and Standards Commission retreat to the October 29, 2025 agenda. 4. Add a discussion item on the October 29, 2025 or December 9, 2025 regarding the preparation of a formal statement to City Council to address vacancies on the Building and Standards Commission. COMMISSIONER IBARRA moved to adjourn the meeting, COMMISSIONER MUSGROVE’s second. CHAIR STOSTAD adjourned the meeting at 9:13 p.m. without objection. The minutes were approved at the October 29, 2025 special called meeting on COMMISSIONER FRANCIS’ motion, COMMISSIONER IBARRA’S second on a 9-0 vote. 4
