BUILDING AND STANDARDS COMMISSION MEETING MINUTES Wednesday, June 25, 2025 BUILDING AND STANDARDS COMMISSION REGULAR MEETING MINUTES WEDNESDAY, June 25, 2025 The BUILDING AND STANDARDS COMMISSION convened in a REGULAR meeting on 25 June 2025, at the CITY OF AUSTIN PERMITTING AND DEVELOPMENT CENTER (PDC), 6310 WILHELMINA DELCO DRIVE, ROOM 1405, in Austin, Texas. VICE CHAIR BLAINE CAMPBELL called COMMISSION (BSC) Meeting to order at 6:42 p.m. the BUILDING AND STANDARDS Commissioners in Attendance: Vice Chair Blaine Campbell, Commissioners: Michael Francis, Grant Gilker, Kurt Lockhart, Maria Elena O Ibarra, Jeffrey S. Musgrove, Raisch Tomlanovich and Commissioners in Attendance Remotely: Chair Timothy Stostad, Ex Officio Commissioner Chief Stephen Truesdell. PUBLIC COMMUNICATION: GENERAL Neighbors Jason Lindenschmidt and Molly Barksdale addressed the commission concerning an abandoned residential structure located at 5103 Valley Oak Drive. APPROVAL OF MINUTES 1. Approve the minutes of the BUILDING AND STANDARDS COMMISSION REGULAR MEETING on April 23, 2025. The minutes from the meeting of April 23, 2025 were approved on COMMISSIONER MUSGROVE’s motion, COMMISSIONER LOCKHART’s second, with no objections. PUBLIC HEARINGS 2. Conduct a public hearing and consider case number CL 2025-036211; Property address: 212 Dunlap Street. COMMISSIONER FRANCIS moved to close the public hearing, COMMISSIONER LOCKHART’s second, with no objections. COMMISSIONER LOCKHART moved to adopt the findings of fact, conclusions of law and adopt City staff’s recommendation for repair of the residential structure within 45 days, with a civil penalty of $250 per week 1 BUILDING AND STANDARDS COMMISSION MEETING MINUTES Wednesday, June 25, 2025 beginning on the 46th day from the date the order is mailed and continuing until compliance is achieved, COMMISSIONER MUSGROVE’s second. The motion carried on a 7-0-1 vote. CHAIR STOSTAD was off dais. 3. Conduct a public hearing and consider case numbers CL 2025-049075; Property address: 1209 E 52nd Street. COMMISSIONER MUSGROVE moved to close the public hearing, COMMISSIONER IBARRA’s second, with no objections. VICE CHAIR CAMPBELL VICE CHAIR CAMPBELL moved to adopt the findings of fact, conclusions of law and modify City staff recommendation by changing the order from repair of the residential structure within 45 days to demolition within 45 days, and on the 46th day, if compliance is not achieved, authorize the Code Official is to proceed with demolition, COMMISSIONER FRANCIS’s second. The motion carried on a 7-0-1 vote. CHAIR STOSTAD was off dais. 4. Conduct a public hearing and consider case number CL 2025-050605; Property address: 1807 Ferguson Lane. VICE CHAIR CAMPBELL initiated a voice vote to recall the City’s admitted exhibits. The voice vote carried with one nay from COMMISSIONER MUSGROVE. VICE CHAIR CAMPBELL re-admitted the City’s exhibits. COMMISSIONER FRANCIS moved to close the public hearing, COMMISSIONER IBARRA’s second, with no objections. COMMISSIONER TOMLANOVICH moved to adopt the findings of fact and conclusions of law and adopt City staff’s recommendation for demolition of the residential structure within 45 days, and on the 46th day, if compliance is not achieved, authorize the Code Official is to proceed with demolition, COMMISSIONER IBARRA’s second. VICE CHAIR CAMPBELL made a friendly amendment to COMMISSIONER TOMALNOVICH’s proposed order, modifying the order from demolition to repair of the residential structure within 45 days, with a civil penalty of $700 per week beginning on the 46th day from the date the order is mailed and continuing until compliance is achieved, COMMISSIOER LOCKHART second. VICE CHAIR CAMPBELL withdrew the friendly amendment. COMMISSIONER TOMLANOVICH’s motion failed on a 0-8 vote. VICE CHAIR CAMPBELL moved to adopt the findings of fact and conclusions of law, and to amend City staff’s recommendation to order repair of the residential structure within 45 days, with a civil penalty of $700 per week beginning on the 46th day from the date the order is mailed and continuing until compliance is achieved, COMMISSIONER friendly LOCKHART’s amendment to the motion to include that the property be secured within 30 days, COMMISSIONER CAMPBELL accepted the friendly amendment. COMMISSIONER MUSGROVE’s friendly amendment carried on an 8-0 vote. VICE CHAIR CAMPBELL moved to extend the meeting to 10:15 p.m., second by COMMISSIONER TOMLANOVICH. The motion passed 8-0. CHAIR STOSTAD made a friendly amendment to order as currently amended, to provide that the property be secured within 14 second. COMMISSIONER MUSGROVE proposed a 2 BUILDING AND STANDARDS COMMISSION MEETING MINUTES Wednesday, June 25, 2025 days, and on the 15th day if the property is not secured, the $700.00 per week civil penalty will begin to accrue. If the property is secured, but repairs are not made to remedy the violations, the $700.00 per week civil penalty will begin to accrue on the 46th after the order has been mailed. VICE CHAIR CAMPBELL accepted the friendly amendment. VICE CHAIR CAMPBELL’s motion as amended passed on an 8-0 vote. 5. Conduct a public hearing and consider case number CL 2025-058648; Property address: 1122 E 51st Street. COMMISSIONER LOCKHART moved to close the public hearing, COMMISSIONER GILKER’s second, with no objections. VICE CHAIR CAMPBELL moved to adopt the findings of fact, conclusions of law and modify City staff recommendation by changing the order from repair of the residential structure within 45 days to demolition within 45 days, and on the 46th day, if compliance is not achieved, authorize the Code Official is to proceed with demolition, COMMISSIONER LOCKHART’s second. The motion carried on a 7- 0-1 vote. CHAIR STOSTAD was off dais. 6. Conduct a public hearing and consider case number CL 2025-057370; Property address: 6849 Auckland Drive. This case was not heard due to time constraints and will be added to next month’s agenda. 7. Conduct a public hearing and consider case number CL 2025-057979; Property address: 3824 Avenue F. COMMISSIONER MUSGROVE moved to close the public hearing, COMMISSIONER LOCKHART’s second, with no objections. COMMISSIONER FRANCIS moved to adopt the findings of fact, conclusions of law and adopt City staff’s recommendation for repair of the unit of the commercial structure within 45 days, with a civil penalty of $250 per week beginning on the 46th day from the date the order is mailed and continuing until compliance is achieved, COMMISSIONER MUSGROVE’s second. The motion carried on a 7-0-1 vote. CHAIR STOSTAD was off dais. 8. Conduct a public hearing and consider an appeal regarding case number CV 2023-039406; Property address: 2503 E Oltorf Street, Building 12 – Exterior; also known as 2317 S. Pleasant Valley Road, also known as 2502 E Oltorf Street, and also known as Trio Phase 2. COMMISSIONER MUSGROVE moved to close the public hearing, COMMISSIONER FRANCIS’ second, with no objections. COMMISSIONER MUSGROVE moved to adopt the findings of fact, conclusions of law and adopt City Staff’s recommendation to affirm the notice of violation thereby denying the appeal, COMMISSIONER FRANCIS’ second. COMMISSIONER FRANCIS moved to table the motion, COMMISSIONER LOCKHART second, with no objections. VICE CHAIR CAMPBELL moved to extend the meeting to 10:45 p.m., COMMISSIONER TOMLANOVICH’s second. The motion passed 8-0. COMMISSIONER MUSGROVE moved the motion, COMMISSIONER GILKER’s second. The motion passed on a 7-1 vote. Item 10, a discussion regarding the planning and drafting of the Annual Internal Review Report, will be added to the July agenda. COMMISSIONER TOMLANOVICH moved to adjourn the meeting, COMMISSIONER MUSGROVE’s second, VICE CHAIR CAMPBELL adjourned the meeting at 10:47 p.m. without objection. The minutes were approved at the July 23, 2025 regular meeting on COMMISSIONER MUSGROVE’s motion, COMMISSIONER TOMLANOVICH’s second on a 7-0 vote. CHAIR STOSTAD was absent. 4
