BUILDING AND STANDARDS COMMISSION MEETING MINUTES Wednesday, February 26, 2025 BUILDING AND STANDARDS COMMISSION REGULAR MEETING MINUTES WEDNESDAY, February 26, 2025 The BUILDING AND STANDARDS COMMISSION convened in a REGULAR meeting on 26 February 2025, at the CITY OF AUSTIN PERMITTING AND DEVELOPMENT CENTER (PDC), 6310 WILHELMINA DELCO DRIVE, ROOM 1405, in Austin, Texas. CHAIR TIMOTHY STOSTAD called the BUILDING AND STANDARDS COMMISSION (BSC) Meeting to order at 6:43 p.m. Commissioners in Attendance: Chair Timothy Stostad, Vice Chair Blaine Campbell, Commissioners: Michael Francis, Kurt Lockhart, Edwarf Selig and Raisch Tomlanovich Commissioners in Attendance Remotely: Commissioner Luis Osta Lugo, Ex Officio Commissioner Chief Stephen Truesdell. PUBLIC COMMUNICATION: GENERAL Ron Herzfeld and Brooks Loflin appeared before the Commission to speak about the status of the property located at 1613 Jester Boulevard. Paul Coroneus appeared before the Commission to request a penalty relief hearing pertaining to penalties accrued from a Building and Standards Commission order regarding his property located at 7207 E. Meadow Bend Drive. APPROVAL OF MINUTES 1. Approve the minutes of the BUILDING AND STANDARDS COMMISSION REGULAR MEETING on January 22, 2025. The minutes the meeting of January 22, 2025 were approved on COMMISSIONER LOCKHART’s motion, COMMISSIONER FRANCIS’ second, with no objections. from PUBLIC HEARINGS 1 BUILDING AND STANDARDS COMMISSION MEETING MINUTES Wednesday, February 26, 2025 2. Conduct a public hearing and consider case number CL 2024-148420; Property address: 5338 Thunder Creek Road. COMMISSIONER FRANCIS moved to close the public hearing, COMMISSIONER LOCKHART’s second, with no objections. VICE CHAIR CAMPBELL moved to adopt the findings of fact, conclusions of law and amend City staff’s recommendation by changing the order from repair to demolition of the commercial structures within 45 days, and on the 46th day, if not in compliance, authorize the Code Official to proceed with demolition; and, order a perimeter fence be installed within 15 days, with a civil penalty of $250 per week beginning on the 16th day, COMMISSIONER FRANCIS’s second. COMMISSONER TOMLANOVICH proposed a friendly amendment to amend the timeframe from 45 to 55 days, and on the 56th day, if not in compliance, authorize the Code Official to proceed with demolition. The maker accepted the friendly amendment. The motion carried on a 7-0 vote. COMMISSIONER SOKOL was absent. 3. Conduct a public hearing and consider case numbers CL 2025-002138; Property address: 1803 Briar Hill Drive. VICE CHAIR CAMPBELL moved to close the public hearing, COMMISSIONER LOCKHART’s second, with no objections. VICE CHAIR CAMPBELL moved to adopt the findings of fact, conclusions of law and modify City staff recommendation by changing the order from repair of the residential structure within 45 days to demolition within 90 days, and on the 91st day, if compliance is not achieved, authorize the Code Official is to proceed with demolition, COMMISSIONER FRANCIS’ second. The motion carried on a 7-0 vote. COMMISSIONER SOKOL was absent. 4. Conduct a public hearing and consider case number CL 2025-002998; Property address: 2000 Burton Drive, Bldg. 25 (Foundation), also known as 2101 Burton Drive, and also known as Array Apartments. COMMISSIONER FRANCIS moved to close the public hearing, COMMISSIONER SELIG’s second, with no objections. VICE CHAIR CAMPBELL moved to adopt the findings of fact, conclusions of law and adopt City staff’s recommendation for repair of the Repeat Offender Program commercial, multi-family structure within 45 days, with a civil penalty of $1,000 per week beginning on the 46th day from the date the order is mailed and continuing until compliance is achieved, COMMISSIONER SELIG’s second. The motion carried on a 6-0-1 vote. COMMISSIONER TOMLANOVICH recused himself from this item due to a conflict of interest and left the dais. COMMISSIONER SOKOL was absent. 5. Conduct a public hearing and consider case number CL 2016-056078; Property address: 7913 Lee Hill Drive. VICE CHAIR CAMPBELL moved to close the public hearing, COMMISSIONER SELIG’s second, with no objections. COMMISSIONER SELIG moved to adopt the findings of fact and conclusions of law and adopt City Staff’s recommendation to issue a new order that would supercede the prior order for repair (TRV 2016085192) and would require: 1) that the accrued penalty of $185,820 from the prior order remain in place, and 2 BUILDING AND STANDARDS COMMISSION MEETING MINUTES Wednesday, February 26, 2025 interest would no longer continue to accrue; 2) demolition within 45 days, and if not in compliance on the 46th day, authorize the Code Official to proceed with demolition, VICE CHAIR CAMPBELL’s second. The motion carried on a 7-0 vote. COMMISSIONER SOKOL was absent. 6. Conduct a public hearing and consider case number CL 2019-051029; Property address: 503 W. 14th Street. VICE CHAIR CAMPBELL moved to close the public hearing, COMMISSIONER FRANCIS’s second, with no objections. CHAIR STOSTAD moved to adopt the findings of fact, and conclusions of law and order that the civil penalties be reduced to $1 if paid in full within 30 days from the date the order is mailed, and on the 31st day, if not paid in full, that interest, second. The motion carried on a 7-0 vote. COMMISSIONER SELIG’s COMMISSIONER SOKOL was absent. the original penalty be reinstated with the remaining portion of FUTURE AGENDA ITEMS It was determined that the property located at 7207 E Meadow Bend Drive remained out of compliance with the Building and Standards Commission’s order in case CL 2021-002264, therefore the case was not considered for a penalty relief hearing at this time. VICE CHAIR CAMPBELL’s motion the meeting, COMMISSIONER LOCKHART’s second, was approved without objection. CHAIR STOSTAD adjourned the meeting at 8:42 p.m. without objection. to adjourn The minutes were approved with one correction (item #2 – “VICE FRANCIS” changed to “COMMISSIONER FRANCIS”) at the April 23, 2025 meeting on COMMISSIONER LOCKHART’s motion, COMMISSIONER FRANCIS’ second on a 6-0 vote. 3
